James Plank et al by CCC to Roger W. Butterfield, deed Received for record June 1st 1881 at 9:13 o'clock am.

This indenture made the Tenth day of December in the year of our Lord one thousand eight hundred and eighty Between Edward M. Adams a Circuit Court Commissioner in and for the County of Kent, Michigan residing in the City of Grand Rapids in said County party of the first part and Roger W. Butterfield of the same place party of the second part Witnesseth Whereas At a session of the Circuit Court for the County of Kent in Chancery sitting at the Court House in the said City of Grand Rapids on the Twenty Second day of January in the year one thousand eight hundred and eighty  it was among other things ordered adjudged and decreed by said Court in a certain cause then pending in said Court between Isaac Butterfield as Complainant and James Plank, Susan M. Plank (also known as Susan M. Butts) Henry W Butts Morris N. Streeter Ebenezer G. D. Holden Andrew J Reeves, Albert W. Davies, George S. Curtis and Eleanor Butts as Defendants for the purpose of foreclosing on a certain Mortgage bearing date on the twelfth day of June 1871 and recorded in the office of the Register of deeds in and for the County of Kent aforesaid in Liber 39 of Mortgages on page 9 on the Thirteenth day of June 1871. which Mortgage was executed by James Plank and Susan M. Plank to Isaac Butterfield. That all and singular mortgages premises mentioned and set forth in the pleadings of the said cause described hereinafter or so much thereof as may be necessary to satisfy the amount due said Complainant for principal and interest and costs of this suit be sold by or under the direction of one of the Circuit Court Commissioners in and for said County at Public Auction in the County where the said mortgages premises or the greater part thereof are situated the said Commissioners first giving public notice of the time and place of said sale according to the course and practice of said Court. And whereas the said party of the first part to these presents in pursuance of the order and decree of the said Court did on the Tenth day of December in the year one thousand eight hundred and eighty sell at Public Auction at the front door of the Court House of said County of Kent to wit Court Block so called in said City of Grand Rapids the said mortgaged premises hereinafter particularly described having first given the previous notice of the time and place of said sale as required by the order and decree aforesaid at which sale the premises were struck off to the said party of the second part to these presents for the sum bidder for the same and be the highest bidder therefore. Now Therefore this Indentures Witnesseth that the said Edward M. Adams said Circuit Court Commissioner for the County of Kent  and State of Michigan and the party of the first part to these ?? in order to carry into effect the said sale so made as aforesaid in pursuance of the said decree and order of said Court and also by virtue of the Statute in such case made and provided and in consideration of the premises and of the sum of Two hundred and fifty dollars paid by the said party of the second part to these presents to the parry of the first part hereto the receipt whereof is hereby confused and acknowledged hath granted bargained sold ?? released conveyed and confirmed and by the presents doth grant bargain sell alien? release convey and confirm unto the said party of the second part and to his heirs and assigns forever all the following lands and premises situated in the township of Cannon in Kent County and State of Michigan and known described as follows the Southwest quarter of the Northwest quarter of section number Eight (8) in township number eight (8) North of range ten (10) containing Forty (40) acres. Together with all and singular the rights titles members? privileges hereditaments and appurtenances to these are belonging or in anywise appertaining To have and to hold the said premises above described and hereby  intended to be granted and conveyed unto the said party of the second part his heirs and assigns to his and their only proper use benefit and  behoove forever. In Witness whereof the said party of the first part Circuit Court Commissioners as aforesaid has hereunto set his hand and seal the day and year first above written.  Signed sealed delivered in presence of W.A. Shinkman, Gershom Powers. Edward M Adams, Circuit Court Commission, Kent County Michigan.

On this tenth day of December AN 1880 before the undersigned personally appeared Edward M. Adams a Circuit Court Commissioner for the County of Kent in said State known to use to be the person described in and who executed the above Indenture and acknowledged that he executed the same freely for the uses and purposes therein mentioned.
