Articles of an agreement made concluded and agreed upon this 2nd day of August Anno Domini 1853.  Between Aldolphus Ake, Samuel Ake Permelia Lewis, Delilah Wetzel, Susan Koons, Lucinda Pringle, Kinsey Ake, Winfield Scott Ake, and Margaret Ake widow of Jos. B. Ake, deceased of Union Township Bedford County Penna of one part and John H. Ake and Caselton Ake administrators of the said Joseph B. Ake deceased of the other part.  Whereas the said Joseph B. Ake died ____ in his demeane as of fee of and on a ____ tract of land situated in Union Township County and State aforesaid adjoining lands of Dr. P Shoenberger and others bounded by  and described as follows to wit-  Beginning at a chestnut ____ for a corner thence north one hundred perches to a post thence east two hundred and thirteen perches to a post thence south one hundred perches to a post thence west two hundred and thirteen perches to the place of Beginning, containing one hundred and twenty five acres and one hundred perches with the usual allowance of six percent for roads for being part of a lager tract of land granted to Jeremiah Jackson on warrant dated 10 May 1794 which said trust by ____ deeds of conveyance became vested in Dr P Shoenberger and Sarah his wife and by their deeds duly executed bearing date the 5th day of May A.D. 1843 conveyed the same to Joseph B. Ake Samuel Garn and John Conrad, and the said Joseph B. Ake, being to thereas seized of in and to the undivided part thereof died intestate  and his administrators, to wit John H. Ake and Caselton Ake by a certain agreement in writing dated 20 December 1852 agreed for the consideration therein mentioned to sell the said undivided part as aforesaid to Henry Ickes of ____
this agreement witnesseth that no the said parties of the first part do for ourselves our heirs ____, administrators or assigns agree to and with the said John H. Ake and Caselton Ake the adms. of aforesaid that they shall convey unto the said Henry Ickes of ____ the said undivided part of the said tract of land for the consideration mentioned in the said agreement ____ ____ agreeing that the same shall be as ____ ____ though the said land had been sold by an order of the Orphans Court, we hereby releasing all our right title interest property claim and demand whatsoever unto us or either of us belonging unto the said John H. Ake and Caselton Ake adms. of aforesaid-- In Testimony whereas we have hereunto set our hands and seals this day and year aforesaid--

    On the 2 day of August A.D. 1853 personally came before me the Subscriber one of the justices of the peace of said County the above named Aldolphus Ake, Samuel Ake, Permelia Lewis, Delilah Wetzel, Susan Koontz, Lucinda Pringle, Kinsey Ake and Windfield Scott Ake and Margaret Ake and acknowledged the foregoing ____ of ____ to their and each of their act and deed and desired the same as such might be recorded--In testimony whereas I have hereunto set my hand and seal the day and year above written.
