I John ROTCHELL of the Co. of Southampton, Va. Being very sick weak in body but of perfect mind and memory thanks be given to allmighty God Therefore calling unto mind the mortality of any body and knowing that it is appointed for all men once to die do make and ordain this my last will and testament that is to say principally and for all I give it and my body I recommend to the earth to be buried in decent Christian burial at the descretion of my executors not doubting but at the general resurrectio I shall receive the same again by the mighty power of God and as Touching worldly estate as it pleased allmighty God to bless me in this life with all I give dismiss of the same in the following manner and form: Imprimis: I give and bequeath unto my Dear beloved son in law Raman ENNIS the sum of five shillings amount money of Va. to be raised ought of the estate by the hands of my exec. Item: I give unto my dear beloved son George ROTCHELL five shillings amnt. money of Va. to be paid to him or his heirs by my exec. as before mentioned. Item: I give unto my daughter Elizabeth SALLS five shillings to be raised and paid to her or her ordr. by my exec. Item: I give unto my dearly beloved son John ROTCHELL all the remainder of my estate that I have in this county after my wifes decease to him and his heirs or assigns forever and I do hereby utterly disallow revoke and disannul all and every other former wills and testament whatsoever before named and I do rectifie and confirm this and no other to be my last Will and Testament in writing whereof I have hereunto set my hand and fixt my seal. of Southampton on Thursday the day of Nov. 1753. This writing
was proved by the oath of Saml. Atkinson a witness thereto and
at a court held for the said co. on Thursday the 13 day of Dec.
1753. The same was further proved by the oath of Wm. Bynum another
of the witnesses thereto and it was ordered that the widow of
the testator be summoned to declare whither she will administer
with this writing annexed there being no exec. named therein.

of the time thereof make constitute and ordain this my last will
and testament in manner and form following, At a court held for Sussex Co., Va. the 21st day of Sept. 1759 The aforewritten Last Will and Testament of John ROCHELL, decd presented in court by Mary ROCHELL the exec. therein named who made oath thereto according to law and the same was proved by the oathes of Levi GILLIAM and Cornelius LOFTIN, two of the witnesses thereto and by the court ordered to be recorded and on the motion of the said exec. certificate is granted her for obtaining a probate thereof in due form. In the name of GOD amen I Nathaniel ROCHELL of the Co. of Sussex being sick and weak of body but of good sound mind and memory and calling to mind the mortality of my body and knowing that it is appointed for all men one to die, do make and ordain this my last will and testament that is to say I give and recommend to the earth and as touching my worldly estate, I give and dispose of the same in the manner and form following:Item 1, I Lend the use of the plantation I now live on with all the land there unto belonging to my two sisters namely Sealah HARWOOD and Jemima ROCHELL, during their natural life, except they marry and should either of them marry the other to possess their part and should both marry the land return agreable to the second.Item 2, I give and bequeath to my nephew Robert ROCHELL son of Levy ROCHELL, the land and plantation where on I now live after the death or marriage of my two sisters Sealah HARWOOD and Jemima ROCHALL to him and his heirs forever.Item 3, I give and bequeath to my nephew John ROCHELL son of Hinchy ROCHALL one negro man DICK to him and his heirs forever, his father to take the said DICK into his estate pay this John ROCHALL ten pounds per year.Item 4, I Give and bequeath to Benjamin ROCHALL son of John ROCHALL one negro woman, SARAH to him and his heirs forever.Item 5, I give and bequeath to my nephew John ROCHELL son of John ROCHELL, one negro boy, ISAAC to him and his heirs forever.Item 6, My will and desire is that my brother John ROCHALL will take the two said negroes SARAH and ISAAC into his estate and not hire them out but pay to the said Benjamin and John ROCHALL such hire as may be just and right, the said negroes to be delivered when they are to the age of twenty one.Item 7, I give and bequeath to my sister Mary KNIGHT one negro man IRELAND to her and her heirs forever.Item 8, I give and bequeath to my sister Jemima ROCHALL one negro girl CHARLIOT to her and her heirs forever.Item 9, My will and desire is that all the rest of my estate of what kind or quality so ever be sold and turned into cash all bonds with other accompts collected and my just debts to be paid and the balance to be appraised to the support and maintenance of my loving mother Mary ROCHELL.Item 10, I do hereby ordain constitute and appt. my brother Levy ROCHALL whole and sole exec. of this my last will and testament for which service I give him the sum of twenty pounds.Revoking all wills heretofore by me made ratifying and confirming this and no other to be my last Will And Testament as witness my hand and seal the day and year first above mentioned. In the name of God amen, I John ROCHELL of the Parish of St. Lukes and Co. of Southampton, being sick and weak of body but of sound mind and memory thanks be given to Almighty God, for the same do make and constitute this my last will and testament in form and manner following: Imprimis: I lend to my loving wife Judith the use of all my lands and plantations in Southampton Co. as also all my personal estate. Bonds, notes and private accounts during her life or widowhood to use the same and profits therof after payments of my debts as she may think proper, but should she marry, I give liberty to make use of such timber only on the land and tenements as is sufficient for the use of the Plantations. I also lend my wife Judith the use of all my slaves for the term of twenty years or till marriage for the support of herself and the education and support of my children but should she marry or survive the term of twenty years from the date hereof in either case, I lend her the use of the following slaves only, viz SAM, DICK, FRANK, GREAT NED, DAVY, OLD HANNAH, TABB, LUCY, PATIENCE, YOUNG HANNAH and EASTER. My desire further is that should my said wife marry or survive the term of twenty years all my negroes not herein particularly named shall be hired out for the common benefit of ALL MY CHILDREN that in the town of Petersburg Prince Town, as also my fisheries on the Chowan and Meherrin Rivers. My Will is that they be rented out yearly and the profits arising therefrom be divided equally between my wife and such of my children as may be then living, but my will further is that in renting out my lands in Sussex Co., Va. and Halifax Co, NC. No timber shall be made use of more than for the necessary support of the several plantations theron, nor any more lands cleared on either. Lastly, at the decease of my wife, Judith, my will is that the whole of my estate that is then left be equally divided between such of my children as may be then living or the heirs of such as be dead, if any draw a parents part. I hereby appoint my brother Levi ROCHELLE Exec. of this my last Will and Test. allowing him 5% for trouble in settling my estate or should he die before my estate is settled, I appt. my friend James BUTTS to succeed him as my exec. to whom I allow the same 5% for what part shall remain unsettled. I Hincha ROCHELL of Sussex Co., Va. being in bad health of body, but perfectly sound in mind and memory, do make this my last will and testament as follows; 1st, I give unto my daughter Sally BARHAM one bed and furniture to her and her heirs forever. 2nd, I Give unto my daughter Elizabeth MCGEE also, one bed and furniture to her and her heirs forever. 3rd: I give unto my daughter Nancy ROCHELL also one bed and furniture to her and her heirs forever. 4th: I wish and desire that my land may be sold and the money arising therefrom should or shall be equally divided between by daughters Sussana DUNN, and Nancy ROCHELL and my son George ROCHELL ? to them and their heirs forever. 5th: I also will and desire that my crop of every discription, all my stock, household and kitchen furniture and plantation tools should be sold and the money therefrom arising to be equally divided between by daughters Susana DUNN and Nancy ROCHELL and my son George ROCHELLE to them and their heirs forever. 6th, I also wish and desire that all my negroes (to wit) DANIEL, JERRY, FEGIN, HARTWELL, MANNY, DICK, JIM, and CAROLINE Thereto be valued, and that my son in law John DUNN, to take them at fair valuation one third of which to be paid in money to my daughter Nancy ROCHELL ? one third to my son George ROCHELL and the other third to reserve to himself, to them and their heirs forever. 7th, I wish and desire that my son in law John DUNN to be exec. to this my last Will and Testament and in case of his failure that Arthur APPLEWHITE exec. the same given under my hand and seal this second day of August, A.D. one thousand eight hundred and thirty one. Witness: Malcom FLOWERS Joel LEE Edward LEE. At a court held for Sussex Co. The 2nd day of Jan.1834, the last Will and Test. of Hincha ROCHELL deceased was presented into Court and proved by the oaths of Absalom FLOWERS and Joel LEE two of the subscribing witnesses and ordered to be recorded. Whereupon John DUNN and Arthur APPLEWHITE the exec. therein named by writing under their hands refused to take upon themselves the burden of the exec. thereof. and on the motion of Joel LEE who made oath and entered into bond with security according to have adm. on the said estate with the Will annexed is granted him in due form. In the name of God Amen, I Helen ROCHELL of Fairfield District, being at present in low state of health and mindful of the uncertainty of life have thought proper to make this my last will and testament.In the first place I desire that all my just debts and funeral expences be paid and afterwards that all the property of which I am possessed be disposed of as follows. Secondly, I give devise and bequeath to my neice Hellen ROCHELL, daughter of Allen ROCHELL and his wife Cynthia, a negro boy named David, to her and heirs and assigns forever, but if she should die before marriage and without leaving issue living at her death, then the said boy or his value to be divided among her surviving brothers and sisters. Thirdly, I give devise and bequeath to by exec. hereafter named a negro woman named Barbara, in trust for the use of Margaret STARKE, wife of Thomas STARKE during her natural life,and after her death, in trust that the said negro and her increase be equally divided among the children of the said Margaret then living freed from all further trusts. Fourthly, I give and devise to my said executors a negro man named Tony in Trust for the use of my sister, Dorcas PEAY, wife of George PEAY during her natural life and after her death to to to her children then living freed from the said trust. Fifthly, I give and devise to James STARKE, son of my sister Margaret STARKE, a child of the negro woman Barbara, named MACKAY to the said James his heirs and assigns forever. Sixthly, I give and devise to my sister, Arabella E. PEAY, a mulatto boy named Alfred to her her heirs and assigns forever. Seventhly, all the money due me by my brothers James and George ROCHELL and my brother in law Thomas STARK, I will and direct to be collected by my execs., and invested in the purchase of a negro girl to be held in trust by my Exec. for Mary KENNEDDY, daughter of Charlotte KENNEDY, my sister until the said Mary arrives to the age of 21 years or marries when the said girl and her increase if any, and the value of her services is to be delivered to her absolutely freed from all further trust, and if the money due me at my death after paying debts and expences are not sufficient, in such case I direct my exec. to put it out on interest until it shall be sufficient for that purpose. Eighthly, The residue of what property I may posess at my death I give and devise the same to my dear mother Margaret ROCHELL. To my dear and beloved brothers James ROCHELL and George ROCHELL, I owe an apology for not noticing them in the provisions of my will, they posess an equal share of my love and esteem with my other relations; but they have received a larger share of my father's property than my sisters and a sense of Justice induces me to give my property to my sisters and their children. Lastly I nominate and appoint my brothers in law John PEAY and Thomas STARKE, Executor of this my last will and testament.
