Phillip Orton Roberts was born in Chester, England , Nov. 8, 1803. He
was a dry goods merchant in London, England for 12 years. His father was
John Roberts, a sugar refiner, who was born in Wales. John Roberts had a
brother Thomas, a tallow candle and soap chandler.
John Roberts married Mary Orton, a daughter of Thomas Orton,
a well-to-do farmer. They had 6 children of whom 2 died in infancy, the
others being John, Phillip Orton, Jane and Sara Roberts. Mary Orton was
born in Chester and her father was a farmer there known as Squire Orton.
Phillip Orton Roberts married a Miss Whiltrear (?) by whom he had one
child, Sara, who died. He then immigrated to America, settling in
Connecticut, where he married Martha Brown Phillips of Hampton (or
Windham) Conn., Dec. 24, 1843. She died Dec.27 1895. Phillip Orton
Roberts died in Connecticut, Feb. 2, 1885. Three children were born of
his second marriage, George, Albert Orton, and Martha Jane Roberts
Whiltrear died in England. She married Philip Orton Roberts.

I give to my wife Mary Kimlin during her natural life the use of all my household furniture goods & property of every name and kind used by her in housekeeping - also the use of the house and lot now occupied by us on the west side of South Hamilton street in the city of Poughkeepsie provided however if my son William R Kimlin lease[?] to the north her then I give to said William the use during her life or so long as she remains my widow of the south part of said house and lot. I also direct that so long as my said wife occupies or has the use or benefit of said house she shall keep the same in all necessary repairs - insured against fire in a reasonable amount and in the name and for the benefit of my estate and to pay all taxes and assessments ordinary and extraordinary that may be imposed thereon from time to time.And if said house be damaged or destroyed by fire then I direct that the insurance money recovered for such damages or destruction shall if sufficient be appropriated to the repair or rebuilding of said house - if insufficient for that purpose - then I direct my executors to loan the same on proper security & to pay the net interest thereof to my said wife during her natural life or so long as she remains my widow.I hereby direct that the insurance money if any so _ _ ? _ _ shall be _ _ ? _ _and _ _ ? _ _ as real estate for the purposes of this my will and as part of said house and lot.And in case said William shall during the life of my said wife or during her widowhood become entitled by virtue of this my will to the occupancy of the south part of said house - then I direct that my son [John - crossed out] William shall thenceforth pay his proportionate share of such repairs taxes and assessments and insurance and shall be entitled to his proportionate share of the interest of said insurance money so loaned as aforesaid.I also give to my said wife during her natural life or so long as she shall remain my widow an equal one third part of the net rents of all the remainder of my real estate wherever situate - the taxes & assessments to be paid out of the gross rents before such division is made.Second[sic] - I give and devise unto my son William R. Kimlin the whole of my real estate lying on the west side of South Hamilton street in said city subject however to the rights of my said wife by virtue of this my will during his natural life - if he die leaving children him surviving then I give the same to such children or both then I give the same to such children or issue of such of said children as may die before said William in fee such issue to take the deceased parents share.I also give to my son William R a lot on the south side of Holmes Street in said city & lying next west of and adjoining the lot of W[?] Talbot - said lot to be one hundred feed wide in front on Holmes street and same width in rear.Third, I give to my son John Kimlin a lot of land lying on the south side of Holmes Street aforesaid lying next west of and adjoining said lot hereinabove give to my said son William - said lot to be one hundred feet wide on Holmes Street and one hundred feet wide in rear.I also give to my said son John my brick house on the lot on which it stands lying on the south side of Franklin street in said city of Poughkeepsie - said lot to be forty two feet wide on Franklin street & the same width in read and one hundred feet deep.I also give to my son John my house and lot on the east side of South Hamilton street in said city bough by me of Mrs. Smith.I also give to my son John a lot on the south side of Church street in said city of Poughkeepsie, excepting so much thereof as had been or shall be taken by the City of Poughkeepsie for widening [?] streets &c.Fourth - I give to my son Thomas Kimlin during his natural life the use of all my real estate not hereinbefore disposed of lying on the south side of Holmes street in said City of Poughkeepsie and west of and adjoining the lot hereinbefore given to my son John - If my said son Thomas died leaving children or issue of such children or both - then I give said real estate to said children & issue in fee such issue to take the deceased parents share - If without issue then I give the same to his surviving brothers and if either of said brothers be then dead leaving issue him surviving - such issue shall take the deceased parents share.And I hereby direct that the real estate hereinbefore devised to my said sons respectively shall be taken and accepted by them subject to the provisions herein contained for the benefit of my said wife.And I also direct and declare that if my said wife shall marry again then and from thenceforth each & every provision herein made for her benefit shall cease and be null and void as fully and entirely as if she was not my wife or had not survived me.Fifth On the death of my said wife or her marriage whichever event shall first happen I give to my son William R Kimlin the bed upon which he sleeps with all bedding belonging thereto with the furniture in the room occupied by him. and to my son John the bed and furniture in the Kitchen and all bedding belonging thereto and furniture in the back room - the above bequests are all made subject to the rights of my said wife under this my will.Sixth - I give all my moneys in Bank Evidences of debt and all money I or my estate may secure[?] from the City of Pokeepsie for my lands on the south side of Church street in said city taken by the City of Poughkeepsie for widening streets &c to my sons William R. Kimlin John Kimlin & Thomas Kimlin share and share alike - But if either of my said sons die before me leaving no children him surviving & intestate then I give the share of him so dying to the survivor or survivors of them & the issue of such of them as may be dead. such issue to take the deceased parents share.And in consideration of the provisions herein made for my said sons William R John and Thomas I do hereby charge each of them with the payment of fifty dollars to my step-daughter Mary Ann Proctor within six months after my decease - or if any executors thin it best to do so I hereby authorized them to pay to said Mary Ann Proctor within said six months the sum of one hundred and fifty dollars and to charge each of my said sons shares of my personal estate with fifty dollars of said amount.I hereby declare that the provisions herein contained for the benefit of my said wife shall be taken and accepted by her in lieu and full satisfaction of her dower right & all rights & interest whatever she may have in my estate.And I hereby also declare & direct and this provision shall be paramount to all other provisions of this my will that if either of the parties for whom provision is made in this my will shall contest the probate or validity of said will or shall undertake to set the same aside for any reason whatever - then I revoke all gifts herein made to him or her so contesting said will or undertaking to set the same aside & such gifts shall thenceforth be null & void.And I hereby order and direct that my executors shall place on my burial plot a suitable monument with the following inscription thereon "Erected to the memory of William Kimlin - He came from Loughgall County Armarth Ireland"I hereby appoint my brother John Kimlin & my friend William J.
