Milly Jane Mitchell was supposed to have been a Cherokee woman according to family tradition. Can't find anything on any of the Cherokee rolls. She was most probably only part Cherokee.
In 1922 Milly made application to the State of Texas for a Confederate Veteran's Widow's Pension. I have a copy of the papers which I obtained from Austin. They are filed under Pension No. 38058. The name of the applicant is shown as Millie Jane Boyd of Potter County, Texas. Her address was R#A-Box 103, Amarillo, Texas, filed on February 13, 1922 and approved on March 6, 1922. Pension allowed from March 1, 1922.

The application states she is the widow of Moses E. Boyd, deceased who departed this life on 18th day of July, A.D. 1902 in the county of Swisher, State of Texas. It states that she had not remarried since the death of Moses E. Boyd, and that she had never voluntarily abandoned him during his life, but remained his true, faithful and lawful wife up to the date of his death. They were married on the 19th day of January A.D., 1865 in the county of Forsyth, State of Georgia. It further states:

"My husband, the said Moses E. Boyd, enlisted and served in the military service of the Confederate States during the war between the States of the United States, and that he did not desert the Confederate service. I have been a resident of the State of Texas since prior to January 1, A.D. 1900, and have been continuously since a citizen of the State of Texas. I do further state that I do not receive from any source whatsoever money or other means of support amounting in value to the sum of $300.00 per annum, nor do I own in my own right, nor does anyone hold in true for my benefit or use, estate or property, either real, personal or mixed, either in fee or for life, of the value of one thousand dollars, exclusive of the home of the value of not over $1000.00; nor do I receive any aid or pension from any other States, or from the United States, or from any other source, and I do further state that the answers given to the following questions are true:

1. What is your age? 72
2. Whre were you born? Forsythe Co. GA
3. How long have you resided in the State of Texas? About 48 years

Millie Jane (her X) Boyd Witnessed by R. C. Johnson and County Judge,
of Potter County, TX on the 8th day of December, 1921.

There is an Affidavit of Witnesses executed by H. R. Airheart and G. W. Daugherty swearing that they personally know Millie Jane Boyd, and that she is in fact the widow of Moses E. Boyd, deceased, and they personally know that she has not married since his death. Dated January 23, 1922.

There is another Affidavit of Witnesses executed by J. L. Cantrell and J. F. Brown who swear that they personally know that Millie Jane Boyd is a bona fide citizen of the State of Texas. Dated December 17, 1921.

There is a Certificate of State and County Tax Assessor certifying that Mrs. Millie Jane Boyd is charged on the tax rolls of Amarillo, Potter County, TX with a homestead of the value of $600.00. Dated January 16, 1922.

Another sworn Affidavit:
I, Millie Jane Boyd, do solemnly swear that I am the widow of Moses E. Boyd, who died in the County of Swisher, State of Texas, on July 18th, 1902, and I have not since his death remarried. that my husband rendered valuable services as a soldier of the southern Confederacy, and to the best of my information was honorably discharged from the Southern Army; that her said husband was a member of Co. "F" 28th Regiment Georgia Infantry, CSA; I further state upon my oath that I have searched for witnesses who served in the army with my said husband and have been unable to find any living witness who served in the army with him or who has personal knowledge that my said husband served in the army. I did write the war department and procured information that my husband was discharged from a hospital after the war. Sworn to by Millie Jane Boyd on the 12th day of February, 1922.

"The name M. E. (not borne Moses E.) Boyd, Co. F, 28th Regt. GA Inf. C.S.A. appears on a register of Jackson Hospital as admitted August 17, 1864, of Febrile Contd. was furloughed Sept. 1864, for 30 days. No later record found.

Application for Mortuary Warrant, signed by Jennie Freeman. Stating I, Jennie Freeman, do hereby certify that I am the person to who is entrusted the paying of the accounts and indebtedness of the late Mrs. M. J. Boyd, who was a pensioner of the State of Texas, and whose number is 38058. The said pensioner Mrs. M. J. Boyd died on the 7th day of August, 1922 in the town of Amarillo, County of Potter, State of Texas. Then pensioner died in the home of Jennie Freeman who was related to the pensioner as daughter.

CERTIFICATE OF UNDERTAKER.
I, N. S. Griggs, do certify that I am undertaker in the town of Amarillo, County of Potter, State of Texas, and that I had charge of the body of Mrs. M. J. Boyd, who died in the town of Amarillo, County of Potter, State of Texas, on the 7th day of August, 1922. That said body was buried in the Tulia Cemetery, which is located in the County of Swisher, State of Texas and that I am of the opinion that warrant herein applied for should be issued to the said Mrs. Jennie Freeman, who makes the foregoing application. Signed N. S. Griggs, Undertaker.

Milly Boyd died about three months after the State of Texas approved the pension.

Milly's death certificate shows that her death was due to kidney failure. Milly's death certificate shows her mother's name as "Jenny Mitchell". It shows her father's name as "Unk". The information for the death certificate was furnished by Milly's youngest daughter, Jenny Freeman. Apparently, Jenny never knew the name of her grandfather.

She is listed with her parents and siblings as follows:

Family tradition has passed down through Joseph Earl Andrew Boyd's family that Milly Jane Mitchell was a Cherokee woman. This is very possibly true as picture of her indicate. Probably unable to prove however. As she probably was never counted on any of the Indian census that were taken.

Boyd died on the 7th day of August, 1922 in the town of Amarillo, County of Potter, State of Texas. Then pensioner died in the home of Jennie Freeman who was related to the pensioner as daughter.

Boyd, who died in the town of Amarillo, County of Potter, State of Texas, on the 7th day of August, 1922. That said body was buried in the Tulia Cemetery, which is located in the County of Swisher, State of Texas and that I am of the opinion that warrant herein applied for should be issued to the said Mrs. Jennie Freeman, who makes the foregoing application. Milly Boyd died about three months after the State of Texas approved the pension.

Milly's death certificate shows that her death was due to kidney failure. Milly's death certificate shows her mother's name as "Jenny Mitchell". It shows her father's name as "Unk". The information for the death certificate was furnished by Milly's youngest daughter, Jenny Freeman. Apparently, Jenny never knew the name of her grandfather.

She is listed with her parents and siblings as follows:

Family tradition has passed down through Joseph Earl Andrew Boyd's family that Milly Jane Mitchell was a Cherokee woman. This is very possibly true as picture of her indicate. Probably unable to prove however. As she probably was never counted on any of the Indian census that were taken.
