     The Kincaids were involved in the unsuccessful Stuart Rebellion in 1715. Having ties with the Stuarts, some of the children of James were obliged to leave Scotland and came to America. They first came to Pennslyvania settling in Lancaster Co. David went to Spotsylvania Co., Virginia shortly after arriving, Thomas went to Augusta Co., Virginia, and William may have remained in Pennslyvania.²

     James Kincaid was born circa 1571 in Scotland.² He married Margaret Hamilton, daughter of Robert Hamilton and Unknown Kincaid, circa 1605 in Scotland.² James died on 18 January 1645.³
     

     James married his cousin, Lady Margaret Hamilton, daughter of Sir Robert Hamilton. On 13 July 1609, at Edinburgh, James VI granted a charter to George Fouillis of the land of Craglokhart, resigned by James Kincaid of that Ilk with consent of Lady Margaret Hamilton, his spouse and Robert Hamilton of Godslingtoun.

     His son Malcolm was involved in a raid on the lands of the Cunninghams in Stirlingshire in 1641.

     In 1604, James Kincaid of that Ilk and James Kincaid his son were bound in 500 marks not to slay slamon in the waters of the Clyd, Lewin, Blanis, Kelvin or branches thereof.⁴

     On 15 February 1574, at Halyrudehouse House, , James VI granted a charter to James Kincaid, son of the heir apparent of James Kincaid of that Ilk and Christine Leslie, his spouse of the land of Craglokhart with tower, fortalice, manor, gardens and orchards (occupied by Stevin Kincaid), County Edinburgh. On 9 February 1582, a charter by James Kincaid younger of that Ilk, and of Craglokhart, with consent of Cristine Leslie his spouse, in favor of Stephen Kincaid, partioner of Broughton, in life rent, and of Robert Kincaid, his second son, and his heirs male, etc. of an annual rent of L-20 Scots from the lands of Craglokhart, manor-place, etc.

     His tombstone has the Kincaid Armor bearings and this inscription: Heir lyis one Honorabil man, James Kincaid, of that Ilk Wha desist ye 13th of Bebrover, Anne 1604.⁵
