     William Henton was born on 26 September 1718 in Berks Co., Pennsylvania.1,2 He married Mary Jones, daughter of Peter Jones and Elizabeth Lycon, in Berks Co., Pennsylvania.1 William died circa 1779 in Rockingham Co., Virginia.1
     

     The following information is from notes on the Henton family provided by John Callarman. Compiler in the following refers to John Callarman.

     "Primary evidence establishing most of the children of William Henton comes from a court case transcribed in Lyman Chalkley's "Records of Augusta County," identified as Henton vs. Henton, O.S. 178, N.S. 63. The text, as published by Chalkley, reads:

     "Henton vs. Henton - O.S. 178; N.S. 63 - Complainants are, viz William and Evan Henton, and Jacob Laswell and Sarah, his wife, late Henton, say that William Henton, grandfather of orators, died in 1779 testate (will in Rockingham), devised land to son William and, after death of his wife, to son Thomas and daughters Mary and Rebecca.

     "Before his death, William had contracted to sell part of his land to Ingle Bowyer. After William died, George Henton and Ingle Bowyer entered a caveat in General Court.

     "William's heir at law was Joseph Henton, who removed to Kentucky in 1780 and was killed by Indians, leaving Thomas Henton, his oldest son and heir, an infant of tender years. Mary Henton, a devisee, died in May 1787 testate (will in Rockingham) and devised her estate to her brothers, Peter and Thomas. William Henton Jr. died testate (will in Rockingham) and devised his estate to orator and oratrix.

     "Thomas Henton is heir-at-law of Joseph Henton, who was heir-at-law of William Henton Sr. Rebecca Henton has married Joseph Grider and resides in Kentucky.

     "One James Henton and Asher Waterman have located a survey on the land, and Peter Henton, devisee of Mary, and also as purchaser from Ingle Bowyer.

     "Orators and oratrix are children of Evan Henton who went away from Virginia. Orator William lives in Kentucky.

     "Will of William Henton of Rockingham, blacksmith, dated 17th December, 1779. Recorded in Rockingham

     "Estate to be kept together until son Thomas arrives at age. Wife, Mary; sons William, Joseph, Evan, Peter; daughters Mary and Rebeckah; executors, wife and Michael Warren.

     "Will of Mary Henton of Rockingham, dated 13th May 1787. Mother, Mary Henton; sister Rebeckah; devisee brother Peter Henton, brother Thomas. Recorded in Rockingham.

     "Will of William Henton of Rockingham. Legatee Mary Cowan; legatee Henry Cowan; cousin Sarah Henton, daughter of brother Evin Henton; cousin, William and Evin Henton, sons of brother Evan Henton. Dated 1st October 1802. Recorded in Rockingham 21st June 1803.

     "Deed 1st August 1802. James Henton and Elizabeth, his wife, of Rockingham, to Asher Waterman, 117 acres on Smith's Creek, patented to James 1801. Recorded in Rockingham, December 1801.

     "Deed 31st July 1805. Asher Waterman and Sally to William Henton of Shelby County, Ky., conveys above. Recorded in Rockingham, September 1805.

     "Conveyance by Thomas Henton of Shelby County, Ky., to William Henton of same place. Tract on Smith's Creek decreed to Thomas's grandfather by the General Court, 12th September, 1804.

     "Power attorney by Jacob Gryder and Rebekah Gryder, formerly Henton, of Rockingham County, but now of Baron County, Kentucky, to friend and kinsman, William Henton, of Shelby County, Ky. Rebekah is daughter of William Henton, September 1804."

     Prior to the litigation of this lawsuit, John Warden of Richmond, Virginia, apparently an attorney hired by William Henton's grandson, William, of Shelby County, Kentucky, wrote the following document on August 17, 1803

     "William Henton, 1st, made his will on the 19th day of December 1779, which was proved 27th March 1780. At his death, he left a widow, Mary, to whom he gave his whole estate, during her life, and five sons and two daughters. Joseph was his oldest son. He survived the testator and died in the year 1780, leaving a widow and three children.

     "The will was proved by Engle Bower and George Henton, the latter of whom was a brother of the deceased and both being the subscribing witnesses, soon after, two wit in the same year, George Henton and Engle Bower entered a caveat with the register of the land office to prevent the issuing of a grant for certain lands, in the county of Rockingham, to any of the family of William 1st, on which caveat Joseph Henton, William 2nd Henton and Mary Henton, the widow, were defendants. The Court, by consent of the said parties, George on the one part and William 2 and Mary on the other part, decided that a grant should be made to the heir at law of the testator, on his complying with what the law requires, and paying twelve pounds with interest from 1st of April 1783, to George and also his costs.

     "Thomas is the name of the eldest son of Joseph, and is alive, but the will of William the first, having given certain mills, &c, to his son William 2nd, and certain disinheriting legacies to his sons, Joseph, Evan and Peter, declares his will to be "That after his wife's decease, the residue of his estate should be divided among his son, Thomas, and his daughters, Mary and Rebecka, Thomas to have two shares and Mary and Rebecka share and share alike.

     "Mary died of full age and made a will in which she devised part of her estate to Thomas, her brother. Thomas is still alive; but before the decease of William 2nd, assigned all his interest, arising out of the wills of his father and his sister, Mary, to his brother, William 2nd. William 2nd died in Feb. 1803, leaving neither wife nor child; but having made his testament and last will, wherein after some small legacies, he gives the residue of his estate, to be divided according to the directions of that will, among William, Evan, and Sarah, the children of his brother, Evan, who was then dead.

     "The lands in the caveat above mentioned continued in the possession of William the second until his death, and are now in possession of William, the son of Evan, as a devisee of William, the second, though son (James) of George, the original caveator, has located the same, has surveyed them, and obtained a grant for them as containing 117 acres, which is dated in March 1801, the survey originally caveated to him being only 100 acres.

     "On this statement I am requested to point out the measures which ought to be pursued by William, the son of Evan, in order to his obtaining possession of the land contained in the original survey made by his grandfather, and caveated aforesaid, and in order to his establishing the rights of the devises of his Uncle William therein. The judgment of the General Court seems to establish two things, First that the right to a grant during the joint lives of William Henton, 1st, and his brother George, the witness to his will, the former caveator, and the present grantee, was in William, grandfather of the present possessor, who was also the testator first above named, and that in obtaining the right he had received assistance from the said George, in money for the amount of twelve pounds.

     "It seems also that the will first above mentioned, was not before the Court and that all the parties knew the right to a grant was in none of them independently on that will, which as appears to me, none of them had considered as affecting the case. Had there been no will, it appears to me, that the judgment of the General Court would have been correct, and in that case, Thomas, the son of Joseph, was the son of William Henton 1st, deceased, mentioned in the judgment (who was the original testator) was the only person to whom a grant could be issued in consequence of that judgment, for he, Thomas, and he only is the heir at law of William therein mentioned, through Joseph, and therefore, I do suppose, that the Register is authorized by that judgment to issue a grant to no other than him; and primogentive give a right to inheritance at all times between the first settlement of (two or three words unreadable in taped fold) 1st day of Jan. 1787.

     "Besides this, I know that anterior to the said first day of January, a man could not devise land whereof he was not possessed, but in the present case, I think that this principle had no influence as the Testator, though without a patent, will, in my opinion, be considered as entitled to convey his interest, his location and survey being considered, as if he had possession and I think that these lands did pass by the words in his will 'all the residue of my estate.'

     "If I am right in this, Thomas, the son, and Mary and Rebecka, the daughter, are entitled to a grant to the land in question, notwithstanding the judgment, originally there were no parties to the caveat but the complainants, George Henton and Engle Bower, and William Henton 2nd, and Joseph Henton, Joseph whose title to a grant was affirmed by the General Court, being dead, and his son no party at the time of the judgment, but Mary, the widow of William, the first, having been introduced, tho the reason of her introduction is not easily discerned, Thomas certainly cannot be bound by the judgment, as he was not a party and in all probability was an infant at the date thereof and Mary and Rebecka, the daughters, could not be bound thereby for the first and perhaps also for the second cause.

     "Being of the opinion from these circumstances that the will never was before the Court, and that the interest of those claiming under it, never has come regularly in question, and also that it has properly conveyed the right to a grant, I consider the rights arising out of it to be a right in Thomas to two-thirds and a right in Mary and Rebecka to one third thereof between them, that is 2/3 and 1/3 and 1/3 equals 1.

     "Such being my opinion, I would advise Mr. William Henton 3rd, the son of Evan and devisee of William, the second, to procure a copy of the will of his Aunt Mary, and a copy of the will of his Uncle William, and a confirmation from his Uncle Thomas of the assignment from him to William for that assignments with the power of attorney to conduct the business in his name; but for the uses of the will of William, and then to bring a suit in chancery in the names of Thomas, and Rebecka, stating their rights, and praying that the grant to James, son of George, might be set aside and then rights under the will be established. The defendants in that suit must be Thomas, the son of Joseph, and James, the patentee, and it must be brought to Staunton.

     "I would also advise that all the papers in the Land Office on the original survey and caveat, beginning with the warrant, and also the like papers leading to the grant to James, may be procured with a copy of the grant itself.

     "I think if the twelve pounds with interest and costs were paid to George, it ought to be proved.

     "I wish much to see the record in the General Court on the first Caveat. The suit must go against Thomas, though a non resident. (Here I mean Thomas, the son of Joseph.)

          "17th August 1803."

     It is interesting to note in the discussion of Henton vs. Henton, that William Henton also made "certain disinheriting legacies to his sons, Joseph, Evan and Peter."

     Compiler found a typed copy of this document in a folder marked "Henton" in the files of the Kentucky Historical Society Library in Frankfort. It had been typed by Nancy Wells on Sept. 24, 1925. Nancy Wells reported the document was in the possession of Miss Sallie Henton, a granddaughter of William Henton (the third) and son of Evan, son of William.

     On March 27, 1780, "The last will and testament of William 'Hinton' was proved by Engle Bowyer and George Hinton, two of the wintesses," according to the Rockingham County Minute Book transcribed by Constance A. and Louise C. Levinson. "Mary, the widow, and Michael 'Waren,' the executors therein named, entered into bond with security and having made oath according to law, certificate is granted them."

     Two children of William and Mary (Jones) Henton not named in the Henton Vs. Henton lawsuit are Elizabeth Henton and Persis Henton. Records of St. Gabriel's Church, Molattan, Pennsylvania, show that on September 8, 1753, two children of William of William and Mary "Hinten," were baptised. They were William "Hinten," born September 26, 1750, and Elizabeth "Hinten," born March 25, 1753. "Perses" Henton is found in the will of Elizabeth Jones Bell, dated ---- 31, 1769, with letters of testimoney granted to Mounce Jones. Among the bequests in the will of Mary (Jones) Henton's mother are"Item. I give and bequeath unto my daughter, Mary Henton, in cash 10 pounds ... Item. I do also give and bequeath unto my daughter Mary Henton my blue gown ... Item. I do also give and bequeath unto my granddaughter, Perses Henton, daughter of my daughter, Mary Henton, one pewter quart tea pott and iron griddle."

     We find no further documentation for Elizabeth or Persis, indicating the may have died young ... unless the following refers to this Persis Henton

     The Rockingham County Minute Book, 1778-1792, transcribed by Constance A. Levinson and Louise C. Levinson, reports that on May 26, 1783, a Rockingham County Grand Jury "returned into court and made the following presentments... Pierey Henton for having a baseborn child." Eleven other women, including Elenor "Nedom," were also named for the same "presentment" on that date. We do not know which Persis/Pierey Henton is so involved.

     Compiler shows this notation under George Henton, who also had a daughter named Persis, Peasee or however the handwriting readers interpreted it. The 1810 census record for Abraham Phillips, shown under Persis Henton, tilts toward George's daughter.

     William Henton had served on juries in Rockingham County as late as March 23, 1779, (with Michael 'Wearing,' among others, the Rockingham County Minute Book reports.

     On May 22, 1780, the inventory of William's estate was returned and recorded. On September 23, 1783, it was ordered that "John Thomas, Josiah Davison, and Reuben More be commissioned to see the laying out of a seven-acre tract of land agreeable to the will of Wm. Henton, deceased, for Wm. Henton, Jr. for a mill seat and to make report to the next court.

     The will came up twice on April 26, 1784, when it was ordered "that Reuben Harrison and Wm. Dunlap settle with Michael 'Warin' and Mary Henton, executors of the estate of Wm. Henton, deceased, and make return to this court of the same," and that a "Deed of lease and release from Michael 'Warin' and Mary Henton, executor and executrix of the estate of Wm. Henton, deceased, to Wm. Henton, Jr., was acknowledged by Michael 'Warin' and ordered certified.

     On May 25, 1784, "Reuben Harrison and Wm. Dunlap, Gent., being appointed by a former court to adjust and settle the accounts of the estate of William Henton, deceased, returned the same and ordered recorded." A similar entry had been made the day before, but was lined out, the Levinsons reported.

     On June 28, 1784, "On the motion of Michael 'Waren' on behalf of Mary Henton, ordered that she be allowed to open a road from the house of the late Wm. Henton, deceased, over the mill road to a field she has beyond the mill. Ordered also that John Bright and John Harrison do view the same and mark the most convenient way the least prejudicial to Wm. Henton, son of the deceased, and make a report thereof.

     "In 1782 ...," Lane writes, "the widow Henton, William Henton and Peter Henton (grouped as a family) paid taxes; and Mary, widow, owned 70 acres, nine of which she conveyed to William and continued paying taxes on the remaing 63 acres through 1803."

     Lane notes that in 1807, Peter Henton was paying taxes on this 63 acres plus 400 more on Smith's Creek, where Joseph Scothorn, Sr., had owned land. Some of this land later came into the possession of B. Frank Armentrout, who married a descendant of Peter, and the location of his property on an 1874 map of Rockingham County shows us where this branch of the Henton family lived.

     William Hinton (shown as 'Sr.' in the History of Summers County), was a son of David Hinton, of Indian Creek, near Greenville, Monroe County, West Virginia. William Hinton was a Civil Engineer and an Inventor. He was a resident of Summers County. William Hinton held three (valuable) U.S. Patents: 1) A surveyor's compass, called a trigonometer, which recorded its work as it was done; 2) A monkey wrench; 3) A bottle stopper; and a specialized engineer's and surveyor's instrument. The Hinton's are English and came to this county (Summers) from Rockingham County, Virginia (from "History of Summers County").1

     William Hinton was listed at age 17, born in Virginia, as a member of the household of David Hinton in Division No. 39 1/2, Monroe Co., Virginia, in the Census of 1850, enumerated 3 August 1850.2

     William Hinton was listed at age 27, born in Virginia, occupation as a County Suveyor with personal estate value of $500, as a member of the household of David Hinton in Peterstown, Monroe Co., Virginia, in the Census of 1860, enumerated 24 July 1860.3

     In the Census of 1870, enumerated 9 August 1870, William Hinton was listed as a head of household in Springfield, Monroe Co., West Virginia. He was listed at age 37, occupation as a farmer with real estate value of $6021 and personal estate value of $1193, born in West Virginia. Also enumerated in the household: Mary Francis Hinton, Unnamed Hinton, Mannie Peck and John Moyers Henton.4

     In the Census of 1880, enumerated 8 June 1880, William Hinton was listed as head of household in Springfield, Monroe Co., West Virginia. He was listed at age 47, occupation as a farmer, born in West Virginia. Also enumerated in the household: Mary Francis Hinton, William Lindley Hinton, Maury Dale Hinton and Nancy Peck.5

     William Henton was listed as the head of a family on the 1900 Census enumerated 7 June 1900, in Miami, Saline Co., Missouri. He was listed at age 33, occupation as a farmer, born in Missouri. Also enumerated in the household: Ada E. Henton.3

     William Henton was listed as the head of a family on the 1910 Census enumerated 10 May 1910, in Miami, Saline Co., Missouri. He was listed at age 52 (should be 42), occupation as a farmer, born in Missouri. Also enumerated in the household: Ada E. Henton.4
