This Indenture made the 7th day of June in the year of our Lord 1803 Between William Theames of Cumberland County and State of North Carolina the one part and David Theames of the County and State [afore]said of the other part Witnesseth That the said Wm Theames the good will love and affection that he bears for his son David Theames doth give grant and ?? unto David Theames heirs & assign by these presents doth ?? confirmed aforesaid all and singular the piece and parcel of land containing 140 acres be the same more or less ?? and being the County and State aforesaid ?? piece on the ?? of the ?? River ?? and Dun[']s being part of a patent by Henry Sims ?? 1735 and by him conveyed John Stevens and by ?? conveyed to Jesse Theames & by the Jesse Theames conveyed to ?? Theames and by him to William Theames is now conveyed ?? the said William Theames to David Theames and his heirs & assigns forever Begins at a white oak on the River bank grays ?? line and runs ?? 20 chains to John Newber[r]y[']s line and with it ?? 15 chains & 18 links to Dun[']s line and with it to the River and ?? the River to the ?? containing 40 acres be the ?? more or less the other piece of land lying and being in ?? County aforesaid on the ?? at the ?? River a ?? Dum Creek Beginning at ?? by the River side ?? 116 chains then So[uth] 40 ?? 10 chains then So[uth] 80 ?? 116 chains to the ?? the ?? of the ?? to the first ?? containing 100 acres more or less being a part of a tract of land granted to John Dun by Patent and by John Dun conveyed to Richard Dun and by Richard Dun conveyed to Robert Dun and by Rob[er]t Dun conveyed to Thomas Theames his last Will give the same to his Son Samuel Theames and dying underage it became the property of the aforesaid Jesse Theames as by record may appear and the ?? Jesse Theames ?? their lawfully possessed of the ?? mentioned ?? them to Joseph Theames and then conveyed to William Theams and now is conveyed by William Theames to David Theames ?? & assigns forever together with ?? and with the improvements ?? road & water courses ?? and ?? whatsoever thereunto belonging ?? have and to hold the aforesaid land ?? as ?? unto the said David Theames his heirs assign forever together with all the Privileges Thereunto belonging with the following exceptions That is all this part of the land on the Rear ?? under Fense with the Privileges of Rail Timber during the natural life of this s[ai]d William Theames and no longer ??...

?? which land I sold to William B Grave as will appear by deed to s[ai]d Grave and I William Theames will forever Warrant ?? defend ?? and clear of all encumbrances Except the above Exception ?? William Theames ?? myself my heirs ?? assign at any ?? hereafter at the request of the ?? David Theames to sign seal and deliver any ?? conveyance that shall the nessessary ?? the ?? actual conveyancing of the premises aforesaid unto David Theames his heirs & assigns forever ?? hereof I have set my hand & seal this day and year first above written
