Last Will and Testament of Moses Wheeler
Last Will and Testament of Moses Wheeler of Augusta County of Oneida and
State of New York: I Moses Wheeler considering the uncertainty of this mortal
life and being of sound mind and memory (blessed be Almighty God for the same)
do make and publish this my last Will and Testament in manner and form
following (that is to say) I give and bequeath to my mother Joanna Wheeler so
much of my property as shall be necessary for her comfortable support during
her natural life, providing she remains in my family, or whatever part of the
time she may choose to remain in the family. I give and bequeath unto my
beloved wife Lucinda one third of all my property after paying the debts that
may be found against me. Also for the better education of my children John C.
Wheeler, Mary Jane Wheeler, and Lucinda Wheeler do give & dispose of the
tuition and custody of them unto my wife for such time as they shall remain
unmarried or under the age of twenty one years & my wife shall remain my
widow but if my said wife should marry or die during the single life or nonage
of any of my said children I then give the tuition & custody of them to my
executor Asa Munn and further it is my desire that each of my children receive
a good English education.
I also give and bequeath unto my daughter Mary J. Wheeler the sum of forty dollars to be paid to her at the time my eldest son shall be twenty two years of age or at the time he would be twenty two years of age if not living.
I also give and bequeath unto my daughter Lucinda Wheeler the sum of forty dollars to be paid to her in two years from the time that my daughter Mary Jane shall receive her pay. And my will is and I do hereby appoint my friends Asa Munn & Harvey White executors of this my last and Will and Testament. And also my will is and I do hereby expressly declare that my said executors or their executors shall not be charged or chargeable with or accountable for more of the aforesaid monies or Estate than he or they shall actually receive or shall come into their hands by virtue of this Will, without his or their willful default or neglect. And also it shall and may be lawful for them my said executors or their executor or executors in the first place out of the said premises and out of my personal estate to deduct & reimburse him and them respectively all such loss, costs, charges and expenses as he or they shall sustain, expend or be put unto for or by reason of the performance of this my Will or any other thing relating thereto.
And finally all the rest residue of my property, Real or Personal whatsoever not before disposed of, to my son John C. Wheeler excepting a small red cow which I give to my Sister Cynthia Wheeler.
