Mills was fatally shot through the abdomen on Tuesday, February 8, 1910. He died at eleven o'clock P.M. on Friday, February 11, 1910. Richard Nation was accused of the killing which took place at Mills Whitley's home during a dance there on Tuesday night. The trial was opened at the county courthouse in Pearsall, Frio county,Texas, but was moved to Laredo,Webb county, Texas, in order to get a more unbiased trial. After a lengthy and bitter trial Richard Nation was acquitted of the murder.
