Last Will & Testament - Ann Lankshear of Witney - 17 Feb 1803 The last will and testament of me Ann Lankshear (Wife of John Lankshear of Witney in the County of Oxford Blanket Weaver) ???? to be me given for this purpose by the Will of my late Sister Mary Dorne deceased as follows First I give and devise unto my friends Samuel Tagg of Kiddington in the County of Oxford Yeoman and ???? of ???? in the County of Berks Yeoman All all other my Messuages Cottages Lands wheresoever to be   mentioned unto the said Samuel Tagg and Robert King their heirs and assigns for ever or as fully as I have power to dispose of the same Upon Trust that they the said Samuel Tagg and Robert King and the Survivor of them his heirs and assigns Do and shall during the natural life of my said Husband John Lankshear pay apply and dispose of the ???? yearly rents issues and profits of the said messuages hereditaments and premises as often as the same shall be received (and after the costs charges and expences laid out and expend in the necessary repairs thereof shall be deducted thereout unto such person or persons and in such parts and proportions manner and form as the said John Lankshear shall from time to time by any writing or writings under his hand direct or appoint the same to be paid And for want of such direction or appointment That then the said Samuel Tagg and Robert King and the Survivor of them his heirs and assigns do and shall pay the same into the proper hands of the said John Lankshear or otherwise permit and suffer him the said John Lankshear and his assigns to receive the same to and for his or their own use and benefit Also I give and bequeath unto the said Samuel Tagg and Robert King after payment of all my just debts and funeral expences and the costs and charges of proving this my Will All and Singular my household goods furniture and Implements of household and all my personal estate whatsoever To hold the same unto the said Samuel Tagg and Robert King their executors administrators and assigns (Upon Trust nevertheless) that they the said Samuel Tagg and Robert King their executors and administrators do and shall during the natural life of my said Husband John Lankshear permit and suffer him the said John Lankshear to have the use of my said household goods furniture and implements of household And my Will is and I do hereby expressly declare that my said Trustees their hiers executors and administrators shall not be chargeable with or answerable for any loss which shall happen to them of the rents and profits of my several estates so as aforesaid directed to be received by them or of my said personal estate or any part thereof respectively so as such loss happen without their Wilful default or neglect nor the one of them for the other of them but each of them for himself and for his own acts deeds and disbursements only And also that is shall and may be lawful for them my said trustees their heirs executors administrators and assigns In the first place out of the rents and profits of my said hereditaments and premises ???? to them as aforesaid or any part theresofor out of any part of my personal estate to deduct and reimburse to themselves or himself respectively All such costs charges and expences as they or either of them shall or may sustain expend or be put unto for or by reason of this my last will and testament or the trusts hereby in them reposed And from and after the decease of my said Husband John Lankshear I will and direct that all and Singular the messuages lands tenements and hereditaments so as aforesaid given and disposed of by this my Will and all and every part of my said personal estate which shall then remain and can be found shall be sold and disposed of by the said Samuel Tagg and   Robert King or the Survivor of them his or their heirs executors administrators or assigns And that the ???? by such sale after decucting all costs charges and expences attending such sale and disposal and after payment thereout of the Sum of ten guineas each to Mr John ???? and Mr Thomas Williams both of Witney aforesaid executors and trustees named in the Will of my late Sister Mary Dorne deceased) to whom I give and bequeath the same for the trouble they have been at in the execution of the trusts reposed in them by the said Will) shall be divided into five equal parts or shares And I give and bequeath one equal fifth part thereof unto my Kinswoman Eleanor Tagg the Wife of the said Samuel Tagg I also Give one other equal fifth part thereof unto my Kinswoman Jane King the Wife of the said Robert King one other equal fifth part thereof I give to my Kinswoman Susanna Williams Wife of John Williams late of Burford in the County of Oxford Mealman one other equal fifth part thereof I give to my Kinswoman Ann Wasting Wife of Wasting of Epsom in the County of Surry Labourer and the remaining fifth part thereof I give to my Kinswoman Sarah Start Wife of Thomas Start of Witney aforesaid Blanket Weaver and which said several parts or shares I will and direct to be paid to my said Several Legatees as soon after my decease as the said estates can with convenience be sold and disposed of And I nominate constitute and appoint the said Samuel Tagg and Robert King to be joint executors of this my Will And order will and direct that the receipt or receipts of any person or persons who may be or become purchaser or purchasers of all or any part of the estate or estates herein before by me given divised and directed to be sold as aforesaid shall be to the person or persons paying the same to my executors a good and sufficient discharge for the purchase money it being my express Will that no purchaser shall be answerable or accountable for the application or non application of the monies arising by such sale In Witness whereof I the said Ann Lankshear have to this my Will contained in three sheets of Paper to the first and second Sheets set my hand and to this the third sheet my hand and seal this seventeenth day of February in the Year of our Lord One thousand eight hundred and three - Ann Lankshear - Signed sealed published and declared by the said Ann Lankshear as and for her last Will and Testament in the presence of us who at her request and in her and each others presence and sight subscribed our names as Witnesses thereto Jno. Leake - Mary Leake Thomas Leake Ann Lankshear Wife of John Lankshear of Witney in the County of Oxford Blanket Weaver do direct that this Codicil may be taken as part of my last will and testament and annexed thereto Whereas I have by my said last will and testament by virtue of a certain ???? therein mentioned given and devised unto Mr Samuel Tagg and Mr Robert King their heirs and assigns certain messuages cottages lands tenements and hereditaments upon certain trusts therein mentioned Now I do hereby ???? the said ???? or bequest ???? so far only as the same relates to the messuages or Tenement Outbuildings Stables and appurtenances thereunto belonging in Witney aforesaid by the   standing or being near to or adjoining the said ???? premises or ???? thereof And I do hereby Give devise direct and appoint the said last mentioned messuage or tenement Outbuildings Stables Cottage or tenement and premises with their appurtenances unto and to the use and behalf of the said Samuel Tagg and Robert King their heirs and assigns for ever Upon Trust never- theless- to make Sale and dispose of the same and the fee simple and Inheritance thereof as soon as conveniently may be after my decease And I do declare and direct that the receipt or receipts of my said trustees or the survivor of them shall be a good and sufficient discharge to the purchaser or purchasers of the said premises or any part thereof for so much as in such receipt or receipts shall be expressed to be received and that the purchaser or purchasers thereof or of any part thereof shall not be afterwards answerable for any loss misapplication or nonapplication of such purchase monies And as to the monies arising by or from the sale of the said premises after deducting thereout all costs charges and expences incident to and attending such sale and disposition Upon Trust that they my said Trustees and the survivor of them his executors or administrators do and shall pay satisfy and discharge all my just debts and funeral expences and after payment of the same to pay Mr Trimnell the Legacy of ten Guineas given unto him by my said Will and also ten Guineas unto my friend Mr John Buswell to whom I give the same accordingly and as to the rest and residue thereof Upon Trust to place the same out at Interest on such securities as they shall think proper and pay the Interest to and for the Benefit of my said husband during his life in such manner as they shall judge proper so that his Creditors may be totally excluded from all benefit thereof and after the decease of my said husband Then Upon Trust to pay and divide such residue of monies arising from the sale of the said premises as aforesaid and all unapplied interest thereof in manner following that is to say one equal fifth part thereof unto Eleanor the Wife of the said Samuel Tagg one other equal fifth part unto the three children of the said Robert King one other equal fifth part unto Susanna Williams Wife of John Williams late of Burford in the County of Oxford one other equal fifth part unto Ann Wasting Wife of Wasting of Epsom in Surry and the remaining equal fifth part unto Sarah Stait Wife of Thomas Stait of Witney aforesaid and whereas since the making of my said Will Mrs Jane King a legatee therein named hath departed this life Now I do hereby give bequeath and direct the Legacy monies and effects therein given to her unto the said three children of this said Robert King her husband and that the same shall be paid and payable to them at the time or times the said Jane King their mother would have been entitled to receive the same if living And I do hereby ratify and confirm my said will in every particular that is not hereby altered or revoked In Witness whereof I have hereunto set my hand and seal this twenty ninth day of October One thousand eight hundred and five. Mrs Brown ????? Surrogate by the Oath of Samuel Tagg the surviving Executor therein named to whom adm??? was granted being first sworn duly to ad??? John Lankshear the husband having first by a proxey under her hand & seal consented to a probate of the sd. Will and Codicil passing in common for unto the said Exors
