Last Will & Testament - Thomas Lankshear of Witney - 28 Apr 1792 [transcription] The last Will and Testament of me Thomas Lankshear of Witney in the County of Oxford Gentleman as follows First I recommend my Soul to God who Gave it, and my Body to the Earth, to be decently Buried at the discretion of my Executrix hereinafter named And as for such Worldly Estate wherewith it hath pleased God to bless me, I dispose thereof as follows In the first place I Give and devise to my Wife Mary Lankshear All and every the real Estates Messuages Lands Tenements and hereditaments whereof I shall stand seized or possessed at the time of my decease, To hold to her my said Wife and her assigns for and during the Term of her Natural life Also I Give and bequeath to my said Wife all my Wearing Apparel plate Linnen and other my household Goods and furniture And I Give to my said Wife all the Interest Income and produce of all such Sum and Sums of Money which shall be due and owing to me at the time of my decease, To be had received and taken by her my said Wife and her assigns during her Natural life only, And from and immediately after the decease of my said Wife I Give and devise unto my Son Joseph Lankshear the Messuages or Tenements yard Garden and all other the premises with the Appurtenances which I bought and purchased of Palmer Gray (Excepting and reserving thereout to my Son William Lankshear his heirs and assigns for ever a Free Way and passage at all times and on all occasions with horses Carriages or otherwise through the Gateway Yard or Backside of and belonging to the said Messuages or tenements and premises, by me purchased of the said Palmer Gray as aforesaid, to the back Door or part of the premises now in the occupation of my said Son William Lankshear as aforesaid) To hold the same unto my said Son Joseph Lankshear his heirs and assigns for ever Also I Give and bequeath unto my said Son Joseph Lankshear his Executors and Administrators from and after the decease of my said Wife the sum of seventy pounds of lawful money of Great Britain now due to me from Benjamin House of Charlbury in the said County of Oxford with all Interest which shall be then due for the same Also from and after the decease of my said Wife I Give Devise and bequeath unto my Daughter Ann Lankshear all that my Messuage or tenement Mill Lands and premises with the appurtenances, situate standing and being at or in the parish of Brodwell in the said County of Oxford To hold the same to my said Daughter Ann Lankshear and the heirs of her Body And for Want or in default of such Issue I Give and devise the said Messuage or tenement Mill Lands and premises last mentioned unto my Son Thomas Lankshear for and during the term of his Natural life and from and after his decease I Give and devise the same last mentioned premises with the appurtenances unto and amongst and to be equally divided between all and every the Sons and Daughters of my said Son Thomas Lankshear who shall be then living and to their respective heirs and assigns for ever And whereas there will become due and owing to my Executors or Administrators from my Son William Lankshear his heirs Executors or Administrators on or by virtue of a certain Bond or Obligation Entered into by my said Son William Lankshear bearing Date the first day of March instant the sum of eighty pounds to be paid and applied as in and by the said Bond is directed Or as I the said Thomas Lankshear should by my last Will and Testament Order direct or appoint the same to be paid I do therefore hereby Will and Order direct and appoint that the said Sum of eighty pounds shall be paid by my said Son William Lankshear his heirs Executors or Administrators unto my Sons Joseph Lankshear and Thomas Lankshear Equally to be divided between them share and share alike Or to the respective Executors or Administrators of my said Sons Joseph Lankshear and Thomas Lankshear Equally as aforesaid in case they my said Sons or either of them shall be then dead within three Months next after the decease of the Survivor of me the said Thomas Lankshear and my said Wife and on payment whereof I will and direct that the said Bond shall be delivered up and Cancelled Also from and after the decease of my said Wife I Give and bequeath to my Son Robert Lankshear the Sum of One hundred pounds of lawful money of Great Britain part of the money now due and owing to me from my said Son Roberts Lankshear Also I Give to my Trustees hereinafter named three Guineas each for the trouble they may be at in the Execution of the Trusts hereby in them reposed, to be paid to or received by them in one Month next after the decease of my said Wife All the rest and residue of my Estate Goods Chattels and Effects whatsoever not herein before by me disposed of I Give devise and bequeath the same to my said Wife to be disposed of by her as she shall think fit And I nominate Constitute and appoint John Leake of Witney aforesaid Gentleman and Thomas Wright the younger of Curbridge in the parish of Witney aforesaid yeoman to be the Trustees for the purposes aforesaid of this my Will And also together with my said Wife Executors and Executrix thereof And I hereby revoke all former Wills by me at any time heretofore made In witness whereof I have to this my Will Contained in two Sheets of paper, to each Sheet set my hand and Seal the twenty eighth day of April in the year of our Lord One thousand seven hundred and ninety two. Leake Tabitha Leake Sarah Leake September the 13th 1792 Mary Lankshear Widow of the Deceased & Executrix; and John Leake and Thomas Wright Gentlemen Executors; in this Will named, were sworn to the Truth thereof and as usual & also that the Deceased effects do not amount in value to the Sum of One Thosand pounds.
