Last Will and Testament of Daniel Sutton

This is the last Will and Testament of me Daniel Sutton of Wardington in the County of Oxford, Innkeeper. I give and devise all the real estate of or to which I am or shall be seized or entitled or over which I shall have any disposing power at the time of my decease unto Stephen Root of Wardington, aforesaid, Farmer and William Herbert of Banbury in the County of Oxford, Fellmonger and their heirs. To the use of my Wife Susannah Sutton during her life if she shall so long continue my Widow and after the decease or marrying again of my said Wife To the use of the said Stephen Root and William Herbert their heirs and assigns. Upon trust that they, the said Stephen Root and William Herbert and the survivor of them and the heirs and assigns of such survivor do and shall sell and dispose of all my said real estate either by public auction or private contract in such lots and subject to such conditions as my said Trustees or Trustee shall think expedient with power to buy in and afterwards resell my said Real Estate or any part thereof and enter into, make and execute, such agreements and any conveyances for effecting any such sale or sales as my said Trustees or Trustee shall think fit. And I direct that my said Trustees or Trustee shall receive the monies to arise from the sale of my said real estate and after payment thereout of the costs and expenses of any such sale shall stand possessed of the residue thereof. In trust for my child if only one or all my children if more than one who shall attain the age of twenty one years or marry under that age and if more than one to take in equal shares as tenants in common, I give and bequeath all the personal Estate of which I shall be possessed or over which I shall have any disposing power at the time of my decease unto the said Stephen Root and William Herbert, their executors, administrators and assigns. Upon the trust following that is to say Upon trust that my said Trustees or the survivor of them his executors, administrators or assigns, shall permit my said Wife during her life if she shall so long continue my Widow to carry on the trade or business in which I shall be engaged at my death for the maintenance of herself and the maintenance and education of my children and for that purpose to use and employ all or any part of my said personal estate and after the decease or marrying again of my said Wife I direct that my said Trustees or Trustee shall sell dispose of and convert the whole of my said personal estate into money and stand possessed of the monies arising therefrom upon the trusts herein before declared of the monies to arise from the sale of my said Real Estate herein before directed to be sold. And I empower my said Trustees or Trustee to apply the whole or any part of the yearly income of the shares of each of my said children under the devises and bequests herein before contained whether such shares shall be vested or contingent for or towards his or her maintenance and education or otherwise for his or her benefit during his or her minority. And I declare that the receipt and receipts of the said Stephen Root and William Herbert or the survivor of them or the heirs executors administrators or assigns of such survivor for the monies to arise from the sale and getting in of my said real and personal estates under or by virtue of the aforesaid trusts or for any other sum or sums of money which they or he shall be entitled to receive under this my Will, shall effectually discharge the person or persons paying the same and such person or persons shall not afterwards be liable to see to the application or be answerable for the misapplication or nonapplication thereof. And I further declare that my said Trustees or Trustee shall be responsible only for their or his own respective acts defaults and receipts and shall not be answerable for any Banker Broker Auctioneer or other person in whose hands any of the trust monies shall be placed, nor for the insufficiency or deficiency of any stocks funds or securities nor otherwise for involuntary losses and shall be at liberty to deduct and allow to each other all expenses incident to the execution of the trusts of this my Will. And I appoint the said Stephen Root and William Herbert Executors of this my Will. And I revoke all former Wills by me made. In witness whereof I the said Daniel Sutton the Testator have to this my last Will and Testament contained in three sheets of paper set my hand this first day of August One thousand eight hundred and sixty eight.

At Oxford, on the Twenty second day of August 1871, Administration (with the Will annexed) of the personal Estate and Effects of Daniel Sutton, late of Wardington in the County of Oxford, Innkeeper, deceased, who died on the Thirteenth day of May 1871, at Wardington aforesaid, was granted to Susanna Sutton, Widow, the Relict of the Deceased, the residuary Legatee during Widowhood named in the said Will, she having been first sworn. Stephen Root and William Herbert the Executors and residuary Legatees in Trust named in the said Will, having renounced the Probate and execution thereof and also the Letters of Administration with the said Will annexed of the personal Estate and Effects of the said Deceased.--

Wardington
WARDINGTON, a chapelry in that part of the parish of CROPREDY which is in the hundred of BANBURY, county of OXFORD, 5 miles (N.E. by N.) from Banbury, containing, with the hamlets of Coton and Willscott, 825 inhabitants. The chapel is dedicated to St. Mary Magdalene. This chapelry is in the jurisdiction of the peculiar court of Banbury in the Cathedral Church of Lincoln. CROPREDY, a parish comprising the chapelry of Mollington, which is partly in the Burton-Dasset division of the hundred of KINGTON, county of WARWICK, but chiefly in the hundred of BLOXHAM, county of OXFORD, and the chapelries of Bourton, Claydon, and Wardington, and the hamlet of Prescott, in the hundred of BANBURY, county of OXFORD, 4 miles (N. by E.) from Banbury, and containing 2395 inhabitants. The living is a vicarage, within the peculiar jurisdiction of the Dean and Chapter of Lincoln, rated in the king's books at £26. 10. 10., and in the patronage of the Bishop of Oxford. The church is dedicated to St. Mary. Walter Calcott founded a free school, and endowed it with an annuity of £13, for teaching forty children; two others are educated for a rent-charge of £2 per annum, given by John Ditchfield in 1708. Stephen Root
Stephen Root was born about 1840 in Wardington. I have first found him in the 1881 census, where he is living as a boarder at the WheatSheaf Inn in Wardington. The proprietor of the Wheat Sheaf Inn was Mrs Elizabeth Ann Duddy, a widow born about 1838 in Rugby, Warwick. In 1888, Stephen and Elizabeth were married. In the census of both 1891 and 1901, Stephen and Elizabeth are still at the Wheat Sheaf Inn in Wardington, with Stephen listed as proprietor. Who was Stephen Root to Daniel Sutton? A close friend? A relation?
William Herbert
William Herbert is more a of a mystery. In the 1852 Banbury directory, there is a William Herbert (Eating Houses) & Fellmonger, in Fish Street. There is also a William Herbert Proprieter of George and Dragon in Horsefair. In Daniel's will, William is listed as a fellmonger, so the first one listed is probably him. Again, what is his relation to Daniel Sutton? Good friend? Workmate?
