VESTING OF LEGACY
The will of a Carterton sheep farmer, the late Henry Robert Bunny, was the subject of legal argument before the Chief Justice (Sir Michael Myers) in Ihe Supreme Court yesterday afternoon. j Among other things, the will £10,000 to provide an income for the widow during her life, the capital to be divided after her death between two sons, Henry Archer Bunny and Francis Charles Bunny. Before the death of the widow, Henry Archer Bunny died without issue, and the question placed before the Court was whether his estate was entitled to "half of the £10,000 or whether the money passed into the residue of Henry Robert Bunny's estate; in other words, did the legacy vest in Henry Archer Bunny at the date of death of the testator, or did it vest only at the death of his widow?
The Chief Justice held that it vested immediately on the death of the testator and that Henry. Archer Bunny's estate was entitled to half the £10,000.
The plaintiff wa. Francis Charles Bunny, of Carterton, executor and trustee of the will, and.the defendant was Frederick Harold Bunny, of Wahroonga, New South Wales, his brother.
Mr. C. C. Marsack appeared for the plaintiff, Mr. H. H. Daniell for the defendant, and Mr. E. P. Hay for the Public Trustee as executor of the estate o£ Henry Archer Bunny. Mr. Daniell explained on behalf of a daughter, Catherine Mary McKay, that she would submit to the order of the Court without taking part in the proceedings and a similar explanation was made by Mr. H. R. Biss for another daughter, Clara Cecilia Tatham.
Henry married Elizabeth Ann VENNELL, daughter of Samuel VENNELL and Pamela LARTER, in 1871. (Elizabeth Ann VENNELL was born in 1849 and died in 1928.)
