On 13 Nov1846 Thomas Blackall (came free to the colony) was charged with carnally knowing and abusing a girl under ten years of age, namely SarahGilbert, at the Police Office in Parramatta.
James Russell Ordinary Constable in the Parramatta Police on oath states -
Yesterday about twelve oclock I apprehended the prisoner at Castle Hill under the authority of the warrant produced under the hand and seal of Gilbert Eliott Esquire Police Magistrate bearing date the twenty ninth day of August last since which time it has been in my possession without being acted on the prisoner having gone out of the way. Signed James Russell Affidavidt of Charles Gilbert which is hereunto annexed having been read in
the presence of the prisoner swears the contents of it to be true. Charles Gilbert Sawyer residing at Castle Hill in the District of Parramatta came personally before me Gilbert Eliott one of Her Majesty's Justices of the Peace for the Colony of New South Wales escepting the City of Sydney and Town of Melbourne and on his oath states that in consequence of a child Sarah Snowden in my charge complaining to me yesterday the twenty eighth day of August instant that she was hurt in her private parts and from enquiring of the child I understood that a man named Thomas Blackall of Castle Hill had laid her down on Sunday last the twenty third day of August instant at Castle Hill aforesaid and committed violence upon her person the child is now suffering from the injuries she has received as aforesaid I therefore charge the said Thoms Blackall with assault with intent to commit a rape and pray that a warrant may be granted for the Apprehension of the said Thomas Blackall
to answer the said complaint. Signed Charles Gilbert Charles Gilbert on oath states the Presoner at the bar is the person alluded to in my affidavit of the twenty ninth of August last which has just now been read. The prisoner has been two or three times in the District since I obtained the warrant for his apprehension but left again before I had time to get the Constable to apprehend him. Signed Charles Gilbert Sarah Snowden residing with her mother at Castle Hill on oath states I know the prisoner at the bar his name is Thomas Blackall. I remember his going by the place where I reside on Sunday morning some weeks ago with his horses it was early about breakfast time. I was carrying the baby in company with my brother. The prisoner took the baby out of my arms, we were a short distance from the house within sight of it at this time. He gave the baby to my brother and he then carried me in his arms into the bush some distance from the house
and he then laid me down and he unbuttoned his trousers and pulled up my clothes and put his cock into my private parts. He hurt me very much. I called out and he said he never would speak to me if I called out and that my mother would beat me. The prisoner lay upon me. He was not long upon me when he got up he went away. My mother first spoke to me about it. I am eight years old.Cross examined by prisoners Counsel states. When my mother discovered I was hurt I forget what she said to me. You took me. You took me into the bush in your arms and laid me down. You had no fence to cross with me when you had me in your arms. I was not far away from the road when you took me in your arms.I don't remember what my father said when he first it it. Signed "X" the mark of Sarah Snowden.
Isabella Gilbert wife of Charles Gilbert residing at Castle Hill in the District of Parramatta on oath states I am the mother of Sarah Snowden on Friday the twenty eighth of August last I noticed in Sarah Snowdens dress several pins but previous to this I remarked that when she went out to make water she cried--I asked her where she got the pins knowing that I had none in the house when the boy next he's of five years of age said she got them from Marris's Tom meaning the prisonerSarah Snowden then burst into tears and said Mother don't beat me and I'll tell you the truth she said Tom gave the little boy her brother two pins to mind the baby and that he then carried her into the bush away from the other
children and then she said to me while you were in the hospital he often pulled up her clothes but that he never hurt her so bad as the last time. A neighbour of mine Mrs Richards who is now ill in bed and myself examined the child Sarah Snowden and found her private parts very much inflamed and she complained very much that when she went to make her water it hurt her. I saw no discharge nor do I think there was any - Sarah Snowden said when Tom meaning the prisoner took her into the bush he pulled up her clothes and that he then unbuttoned his trousers and that he put his cock to hers and that he lay on top of her a long while and that she cried and that he said to her don't cry or else your mother will beat you and that he would never speak to her again if she told her mother of it. Sarah Snowden will be eight years of age the fifth of next month. Sarah Snowden told me on Friday that the occurence took place the Sunday previous and her father brought her to Parramatta on the day after I examined her which was Saturday.
Cross examined by the prisoners Counsel states I have seen the prisoner twice in the District since the warrant was issued. I did not offer to settle this matter with him for three pounds. Direct examination states the prisoner resides about as far as the other side
of the street from where I reside. Signed Isabella Gilbert.
William Spence Brown Esq Surgeon residing in George Street Parramatta on oath states I remember about two months ago exaining a child which was brought over to me by the man now in court Charles Gilbert - myself and Doctor Robertson agreed as to the appearances which were a slight inflamation of the labia and urinary passages together with a little mucus - The hymen was entire and there were no marks of bruises or other scars about her person - there might be penetration without rupturing the hymen but I do not think it could occur in a child of her age.
Cross examined by the prisoners Counsel states both Doctor Robertson and myself agreed that there had been no penetration whatever. Signed Dr W S Brown

Herald, Dec 29 1847 - Supreme Court - Criminal Sessions.
Thomas Blackall was found guilty of having, in August last, assaulted one Sarah Snowden, a girl about twelve years old, with intent to violate her person. He was sentenced to be imprisoned for two years; to pay a fine of 50; to find two sureties in the sum of 50 each, and himself to be bound also in 100, to keep the peace for three years; and further to be imprisoned till the fine should be paid, and the sureties entered into.
No further information is known about Sarah Snowden. She possibly married John
Price, Widower, on 16 Feb1853 at St James Church in Sydney. Witnesses were
Edward and Ann Haycock of Philip St in Sydney.
