1. William Calvin1 Brooks, born 1817 in Horry Co., South Carolina; died 4 Feb 1881 at home near Pineapple, Wilcox Co., Alabama; son of Evan Brooks and Sarah Graham. He moved with his parents to Tennessee and then migrated to Wilcox County, Alabama, stopping first in Pike, Coffee and Conecuh Counties.

He married (1) abt 1838 to Nancy King, born 1825 in Alabama; died 1868 in Wilcox Co. She was the daughter of Ephriam King and Sarah "Sally" ________; after her death he married (2) on 25 Apr 1869 in Camden, Wilcox Co., Alabama to Sarah Catherine (Henderson) Brittingham, born 14 Oct 1832 in Camden, Wilcox, Alabama; died 5 Mar 1905 in Wilcox Co. Alabama; the daughter of Robert Henderson and Elizabeth McCowan. Sarah Catherine was the widow of Isaac Monroe Brittingham who died while serving in the Confederate States Army during the War Between the States. William Calvin Brooks, Nancy King, and Sarah Catherine Henderson are buried in the Friendship Cemetery, about 4 mi. north of Pineapple, Wilcox Co., Alabama..

William Calvin Brooks was reported to have served in the Indian Wars. An Indian Wars Pension Application was filed in 1904 by his widow, Sarah C. Brooks. However, her application was rejected for reason that an official record of his service was not found.

Awin, Wilcox County, widow of Wm. C. Brooks who enlisted 5 June 1836 as private in Company
Commanded by Capt. McCondichio, Colonel Jessup's Regiment. Was discharged at Talledega,
Alabama 15 September 1836......... The soldier died at Pineapple, Alabama on 4 February 1881.
The soldier and Sarah C. Brooks were married near Camden, Alabama on 25 April 1869 by Wm. Huff. Her previous husband died 1865.
Previous wife of the soldier died in 1868.
At the time of entering service, the soldier was 21 years of age, 5'9" tall, and had dark eyes, black hair,
dark complexion, was a farmer. He was born in Conecuh County, Alabama.
Witnesses to the Declaration were J. A. Mills S. Coward.

EVANT BROOKS, of Evant, Coryell County, Texas, upon whose farm the town of Evant is located, was born in Pike County, Alabama. His father subsequently moved to Barbour County, same State, and there he was reared and received a limited education. W. C. Brooks, his father, who was born in South Carolina about 1824, was a son of Evant Brooks, also a native of that State, and by occupation a farmer and stock-raiser. They moved to Tennessee, and both father and son served in the campaigns against the Indians in 1836. Evant Brooks first married a Miss Graham, of South Carolina, Abbeville district, and by her had nine children, W. C. being the oldest. Evant Brooks, grandfather of the gentleman whose name heads our sketch, died in 1876.
W. C. Brooks was married at twenty-one to Miss Nancy, daughter of Ephraim King, the founder of Elba, Alabama. The children born to them were as follows: Evant; Lucinda wife of James Garner; William a resident of Alabama; Nancy wife of Lewis Henderson; Luke of Alabama; George in Irion County, Texas; Henry in Hill County, Texas; Richard of Alabama; Sallie who died in 1871; Lazarus and Martha twins, the former in Alabama and the latter is now Mrs. Johnson; LaFayette in Texas; Davis in Alabama; and Isaac also of Alabama. The mother of these children died in 1868 and in 1871 the father married Sallie Brittenham, who bore him three children: Joseph, Qwen Arrie and Frankie.....

Note by E. D. Rayburn: Since Mary “Polly” Brooks was enumerated on the 1850 census (age 4) it is obvious birth
dates after 1850 are in error. Aunt Polly never married and she never had any children of her own, but she help to
raise several children including my father, Henry Franklin Rayburn, whose mother died 7 days after his birth.

SOURCE: History of Coryell County, Texas - Pg 218: ..... Evant is on the Hamilton-Coryell County line near its western end. The area was first named Langford Cove because Asa Langford established a settlement there in the mid-1850's and because the area is located in a cove of mountains. Langford Cove was one-half mile south of the present town of Event ....... The town of Evant was founded by Evant Brooks; who was also known as Evan Brooks. Mr. Brooks, along with his wife Charlotte and their three children, moved from Alabama to Hamilton County in the late 1870's. In February 1878, he bought 160 acres of land known as the E. C. Glover Survey No. 68, it being part of the land previously purchased by Asa Langford in August 1855. A short time after 1878, Mr. Brooks built his home about 140 yards inside Hamilton County and resided there until his death in 1921. On February 13, 1881, he "set apart for sale and settlement as a town" about 60 acres of land in the southeast corner of this 160-acre tract and the town was eventually named Evant, May 23, 1884.
Mr. Brooks devised a farsighted plan for the development of this town site. It consisted of straight-line streets and twenty blocks 240 feet square, five blocks 541 feet long and 240 feet wide, and a few fractional blocks along the southern line of the townside. Mr. Brooks designated one 240 feet square block, centrally located as the public square, hoping that a courthouse would later be built there; but, to his disappointment, the subsequently formed Mills County was located further west. However, to this day, the public square serves to the advantage of the people of the Evant area. ....

EVANT BROOKS, of Evant, Coryell County, Texas, upon whose farm the town of Evant is located, was born in Pike County, Alabama ……..
At the age of seventeen the subject of our sketch concluded that life at home was not a success so far as he was concerned and he accordingly left without permission. He went to Barbour County, and was employed as overseer at $15 per month, for John C. McNabb, with whom he remained three years and a half. He then married and began farming in Conecuh County, on rented land and at the end of one year was again employed as an overseer on Lee's plantation.
The war coming on, he enlisted in the Second Regiment of Alabama Cavalry, Company K, Captain McCoory, Colonel Hunter. The first year his regiment was on the Florida coast, after which it was transferred to north Mississippi, where Mr. Brooks served till the spring of 1864; was in no regular engagements, but participated in a number of skirmishes. He regiment joined the Army of the Tennessee in time to participate in the battle of Resaca and others initiatory to the Atlanta campaign. He was in the charge of July 22, with Wheeler's Corps of Cavalry, and then followed in the wake of Sherman's army until near Savannah, when they passed him and entered the city. From Savannah Mr. Brooks was with the forces that operated in the Carolinas until the war closed. At Washington, Georgia, he was paid $25 in silver, and at Forsythe, he was paroled by General Wilson.
On reaching home, at noon, May 20, 1865, he began life anew with his $25 and a Government mule. With the mule he plowed his cotton the first year. He farmed rented land about six years, and during that time made sufficient to buy a farm in Wilcox County, where he lived till 1879. That year he sold out and came to Texas. He bought the 160 acres on which Evant is now located. He saw the necessity for a village, and accordingly surveyed and platted the place.
Mr. Brooks was Justice of the Peace and an exofficio Notary Public. He was elected Commissioner of Hamilton County, in 1888, and reelected in 1890.
In 1859 he was united in marriage with Charlotte, daughter of George W. Benson of Alabama. Their children are as follows: Susan A., wife of Samuel Snyder, has four children; W. C., who married Miss Nannie Winters, has two children; Mollie, wife of S. E. Smith, has five children; Alonzo, and Thomas Jenkins.
The Brooks family are identified with the Baptist Church.

Luke J. Brooks b. Aug 1846 in Coffee Co., Alabama; d. 1 Apr 1913 at Kings Daughter Hospital in Temple, Bell Co., Texas. Luke J. Brooks was son of William Calvin Brooks Nancy King.
In late March, 1913, while working on his farm northwest of Evant in Hamilton Co., Texas; Luke J. Brooks was kicked in the head by a horse. His injury was so severe that he was taken to Kings Daughter Hospital at Temple, Texas for treatment. He survived only a few days.
His body was placed on a train at Temple and shipped to Goldthwaite, Texas. There, his family and friends met the train and loaded his body onto a wagon. The wagon, pulled by a team of horses, lead the funeral procession to the Hurst Ranch Cemetery in Hamilton County where he was laid to rest among other members of the family.

OBITUARY: The Hamilton Record, Hamilton, Texas; dated April 10, 1913
Confederate Veteran Dead -- Friends in Evant sent a message conveying the sad news of the death of Capt. Luke Brooks, a pioneer citizen of that community and a Confederate veteran.
After only a week's illness the brave old soldier answered the summons April 1 at 4 o'clock p.m. his death occurring in a Temple sanitarium. The remains were brought home and buried in the Hurst Ranch cemetery on Wednesday April 2. Rev Mr. Hall of Evant conducting the funeral services.
Captain Brooks was a native of Alabama and served four years in the Civil War, coming to Texas in 1893. He served for a number of years as mail carrier between Evant and Lampasas. He afterward settled on a farm in the southern portion of the county where he lived until the great Captain called him "across the river to rest under the shade of the trees."

Comment by E. D. Rayburn: There is a conflict in the date of death for Sarah Isabella “Bell” (Rayburn) Brooks. The grave marker indicates she died 19 Dec 1887. The Brooks family has a memorial card that indicates she died 24 Aug 1891. However, since her husband Luke Brooks married second to Lula Vaughn on 28 Aug 1890, I believe the 19 Dec1887 death date for Sarah Isabella “Belle” Rayburn is most likely to be the correct date.

Comments:
1. I do not think Marie Lula are children of Nathaniel Martha A. Brooks due to age of Martha A. Brooks and also since Marie was not included in the hh on the 1910 Census. Since daughter Elizabeth Belle was not included in the family hh and is now age 30 and back with her father, it seems likely she was married at time of the 1910 Census and her husband died or they divorced. I think Marie Lula may be children of Elizabeth Belle.
2. The 1910 Census indicated that Martha A. was the mother of 12 children and 11 living at that time, all the children were accounted for at that time and the names of Marie Lula were not included.

Henry (no other initial) Brooks was born in Ala. DoB is not exactly known but about 1849. He married Fannie Elizabeth Carroll abt 1876 in Alabama. She was b. Dec 21, 1841 and she died April 15, 1917 and he d. March 1924. Both buried in the Pleasant View Cem in Hill County, about 20 miles southwest of Hillsboro (Texas). To them were born 2 daughters, Annie Elizabeth Brooks and Ida Pearl Brooks.

Abilene's legal fraternity lost one of its most colorful senior members Wednesday with the death of Judge E. T. Brooks, 80, of 426 Grape St.
Judge Brooks died unexpectedly at his home about 12:45 p.m. Wednesday.
He became ill at his office in the Alexander Building and went home shortly before 9 o'clock, planning to go to Anson on business. However, he became quite ill after arriving at home, and a doctor was called.
The prominent jurist's condition became critical, and he died within a matter of hours.
"Unusually Good"
Apparently in good health, Judge Brooks had made the comment Wednesday morning that he felt "unusually good," but got sick after he arrived at his office to begin the day's work.
A native of Pine Apple, Alabama, he was born on Nov. 16, 1873, the son of the late William Calvin and Sarah Catherine Brooks.
He attended high school in Alabama and graduated from Highland Home College, also in Alabama. He received his degree there in 1893, and a short time later headed for Texas, where he was to become an outstanding civic leader and well-known attorney.
He was married to the former Mame Fergus in Killeen, Texas, on Oct 30, 1899.
Funeral for Mr. Brooks will be held at 2 p.m. Thursday at St. Paul Methodist Church, where he was a member, and served for many years on the Board of Stewards.
Dr. J. O. Haymes, former pastor of the St. Paul Church, and now pastor of the First Methodist Church of Plainview, will officiate.
Burial will be in Elmwood Memorial Park with Kiker-Warren Funeral Home in charge of arrangements.
Honorary Pallbearers
Pallbearers will be Cecil Warren, Ernest Pitzer, Minor Alexander, Earnest Yeatts, Richard Boyd, Judge Owen Thomas H. L. Hays, Jr., Judge Milburn Long, and Emmitt Boyd.
All members of the Abilene Bar Association will be honorary pallbearers.
Judge Brooks had spent more than 30 years practicing law in Abilene, having moved here in 1919 from Anson in Jones County.
The elderly lawyer was very active, despite his age, and was daily at his office, transacting business right along with the youngest of lawyers.
He was known as "Judge" to his friends, stemming from a time in 1934 when he was appointed Special Chief Justice of the Court of Civil Appeals at Eastland.
He was a member of the Lions Club, the Masonic Lodge, and the Knights of Pythias Lodge. He was a Master Mason, member of Abilene Lodge 559, and served on the legal advisory committee for many years.
Coombes and Stinson
A member of one of the city's oldest law firms, he was widely known in West Texas legal circles.
In 1919, he joined the law firm here started by the late Clint Chambers and the late S. P. Hardwicke.
Mrs. Chambers died in 1925 and the firm was then joined by the late Charles C. Coombes, and became known as Stinson, Coombes and Brooks. The late James P. Stinson had joined the first earlier.
On Aug 31, 1899, Brooks and his boyhood friend, Stinson, were admitted to the bar in Bell county. Throughout the next 47 years, the two men were partners with only brief interruptions.
Mr. Stinson moved to Anson, Jones County, in 1900 and began to practice law. He was joined a short time later by Judge Brooks.
Mr. Stinson moved to Abilene in 1917, and Mr. Brooks came two years later.
The firm of Stinson, Coombes and Brooks was well-known throughout this area and handled an unusual amount of litigation.
Hair Joins Firm
Coombes moved to Stamford in 1927, to become general counsel for the Swenson interests. At that time, the late Will Hair joined the Abilene firm, which became known as Stinson, Hair and Brooks.
A few months later, the firm name was changed to Stinson, Hair, Brooks, and Duke, when Roy L. Duke joined the firm. Hair resigned in 1946, because of failing health. Stinson died the same year.
The firm was then joined by B. L. Templeton.
Next change in the firm came in 1945 when Maurice Brooks, son of Judge Brooks, joined the organization.
The firm remained Brooks, Duke, Templeton and Brooks until 1951, when Dan M. Fergus joined the firm, which is presently known as Brooks, Fergus and Brooks.
Battled Stinson
While Brooks' friend, Stinson, was district attorney of the 39th District Court, which included the counties of Jones, Fisher, Scurry, Kent, Stonewall, Haskell and Throckmorton, Brooks often represented the defendant against Stinson, who was prosecuting for the state.
Mr. Brooks often made the statement, "Jim gave me everything he had," during those trials. And spectators would never have known that they were the closest of friends.
Together, Stinson and Brooks defended scores of persons charged with capital crimes, at one time having had 15 clients in murder cases simultaneously.
Judge Brooks, Judge Stinson and Judge Hair, all friends of former days in Bell County, were active here in the organization of the Bell County Reunion, which was formed in 1940, and met annually at Buffalo Gap.
Judge Brooks served as president of the reunion in 1947.
Active Democrat
Judge Brooks was very active in the Democratic Party and named many outstanding Democrats among his personal friends, including Sam Rayburn, Tom Connally, and many others.
He was active in the Abilene Bar Association, as well as the Texas Bar.
He had a license and had practiced before the Federal Fifth Circuit Court of Appeals at New Orleans, and the Federal Court of Appeals at Denver, as well as the U. S. District Court here, and the U. S. Supreme Court.
Survivors include his wife; three sons, Maurice and Meryl, both of Abilene, and Aubrey of Lubbock; one daughter, Mrs. Jack T. Anderson of San Angelo; one sister who lives in Alabama; and three grandchildren.

Mrs. E. T. Brooks, 83, widow of a early day attorney, died Saturday at 10:15 p.m. at her home, 426 Grape St., after a year's illness.
Born Feb 1, 1878, in Bell County, she married E. T. Brooks in Killeen on Oct 30, 1899. They moved to Anson and Abilene in February of 1918 where Mr. Brooks practiced law. He died in 1954.
Mrs. Brooks was one of the organizers and served as first president of the Abilene Woman's Club. She was a member of the St. Paul Methodist Church in the Wesley Bible Class there for some time. She was a member of the Wednesday Study club and the WSCs at the church.
Funeral will be held Monday at 3 p.m. in St. Paul Methodist Church with Dr. John Donaho, pastor, officiating. Burial will be in Elmwood Memorial Park beside the grave of her husband, Kiker-Warren Funeral Home in charge.
Surviving are two sons, Aubrey of Lubbock and Maurice of 1165 Grand Ave; one daughter Mrs. Jack Anderson of 4317 S. 5th St; two granddaughters and one grandson; a brother, Marvin Fergus of Killeen; three nephews of Abilene, Dan and Max Fergus and Clyde Brooks.
