Daniels Creek Man Dies Here Monday After Hammer Attack
Waller Indictment May Be Changed To Murder Charge
An indictment for murder is expected to be returned today against
Cecil Waller, about 40, of Daniels Creek, by the grand jury, County
Attorney Don C. Van Hoose said today.
Waller was charged last week with striking and wounding with intent
to kill James Martin also of Daniels Creek. He was placed under a
$2,000 bond Martin died about 8:30 p.m. Monday from his wounds in a
local hospital. County Attorney Van Hoose said the indictment is
expected to be changed to a charge of murder.
Sheriff Wince Trimble said Martin went to the home of Waller on
Friday, January 16, 1959, where Waller told him he struck the victim
three times with a hammer to prevent being cut with a knife. Waller
and his family then, left the house after Martin was attacked,
leaving him lying on the floor. Neighbors removed him to a cot the
next afternoon, the Sheriff said.
Sheriff Trimble said he was called to the Waller home on January 17,
1959, and that he removed the injured man to a local hospital in a
jeep. He said the man had bruises and lacerations on the back of his
head and had apparently been struck from behind.
Martin about 53, and a native of Floyd County, had moved to Fallsburg
some time ago, but had recently returned to the Daniels Creek
section?
He was born June 10, 1905, a son of the late Thomas Martin and Josie
Cornette Martin. He was married to Lovie Hill who survives him.
Also surviving besides his mother, are three daughters, Thelma
Dennison, Wabash, Ind., Eula Jane Crace, and Evelyn Martin, both of
Daniels Creek; one brother, Joel David Martin, Flatwoods, Ky. And
three sisters, Oma Lafferty, Lancer, Hazel Music, Prestonsburg, and
Dora Blankenship, Endicott, Ky.
Funeral services will be held at 11:00 a.m. Thursday, January 29,
1959, at the Church of Christ on Daniels Creek by Herschel Short and
Leonard Webb.
Burial will be in the family Cemetery.
