Daniel Link (Group 17) Will

State of Missouri, Co. of Cape Girardeau

December 8th, 1849

 

I, Daniel Link, of the State of Missouri and county of Cape Girardeau, being weak in body but sound of mind, do make this my last will and testament and revoking all former wills heretofore made by me.

 

1.  I do bequeath to Catherine, my third daughter, one hundred acres of land being the north end of a tract containing two hundred acres, formerly confirmed to Darault/Davault Crites.

 

2.  I do bequeath to Elenor and Elisabeth a certain tract of land originally confirmed to Cousins, bound South and west by lands belonging to John Strong and Aaron Link containing 160 acres.

 

3.  I do bequeath to my sons, John and Lafayete, the place on which I now reside containing one hundred and eighty-four acres.  I also want it divided equally from North to South and Lafayette shall have the East end of it.

 

4.  I bequeath to my daughter, Mary, one hundred dollars in cash.

 

5.  I bequeath to my four daughters, Catherine, Elinor, Elizabeth, and Mary, one bed a piece. 

 

6.  I bequeath to my son John, a sorrel mare, she is now with foald, and if she should be safe in bringing a colt, I want that my son Lafayette shall have it.

 

7.  I also wish that a reduction be made from the shiars [shares] of those of my children that have received a horse back to the amount of thirty-five dollars apiece, out of my estate, and be given to those that received none. 

 

8.  I also will, that all the other things that I have not willed for the Executor to make sale of, and collect, and [be] divided amongst them or pay them their portion as they become of age.

 

9.  I will that my executor take all my notes and accounts, and money on hands, to collect them, and pay over as is stated in foregoing clause.

 

10.  I will that in case my children would wish to stay on the place, one year’s provision should be allowed and if they stay and take care of it, they shall have it rent free for four years.
