Second Generation

2. WILLIAM THOMAS1,2,3,4,5,6,7,8,9 was born in 1719.10 He died on 22 December 1794 at the age of 75 in Pittsylvania County, Virginia.10,11,12

George Thomas' family records gave a birth year of 1722 for William. The Bible record of his wife Joyce indicates he was born in 1719.

William and George, brothers, are traditionally the immigrants. However, in Goochland where many of the Pittsylvania Co folks previously lived, there was a Philip Thomas and William will name his first-born son, Philip. I believe this is the often seen error that when earlier researchers could not back up an ancestor any further - they then "assumed" he was just off the boat.

CAVALIERS & PIONEERS, Vol III, reveals that PHILIP THOMAS patented 400 acres in Goochland Co on the North side of the Appomattox River adj John Owen on 30 Jun 1730 [PB 13, p.464] A patent for Nathaniel Maxey on 11 Dec 1730 for 400 acres was adj to PHILIP THOMAS on the North side of the Appomattox and East of the Old Licking Hole Branch. Names neighbors Richard Williamson, John Owen, Richard Parker & Col William Randolph. [PB 14, p.45]. Patents for Ashford Hughes & JOSEPH THOMAS on 27 Sep 1729 for two tracts of 400 acres in Goochland in W main fork of Muddy Creek, near head of Maxey's Branch, adj their own land. [PB 13, p.408-9] A patent for Henry Breazeale for 400 acres, Goochland at Appamatock R, adj PHILIP THOMAS, Ralph Hudspeath, & William Randolph, Esqr. on 28 Sep 1730 [PB 14, p.129] A patent for William Mayo for 9350 acres in Goochland Co on South side of James, upper Manakin Crk to Deep Crk adj lands of Thomas Jefferson, Gent., DANIEL THOMAS, William Allen, Mathew Lygon, William Randolph Esqr, Abraham Micheaux, John Saunders, William Lax, John Woodson Gent, Bartholomew Stoval, Mathew's Licking Branch, Daniel Stoner Gent on N side Fine Crk. 100 acres part granted Thomas Randolph on 2 June 1722, 400 acres granted Mathew Cox on 18 Feb 1722, 7950 acres waste land. [PB14, p. 138] DANIEL THOMAS patented 300 acres in Henrico Co on S side of the James R on Jones' Creek adj John Radford, 16 Jun 1727 [PB13, p.81]

Earlier evidence of the surname Thomas in Henrico is the following. On 13 Nov 1713, Joseph Pleasant patented 1029 acres in Henrico Co for import of 21 persons, one of whom was HENRY THOMAS. [PB 10, p.93] John Burton also counted Henry Thomas when he patented 341 acres in Henrico Co, on Deep Creek of the S Sdie of the James, 16 Jun 1714 [PB 10, p.134]

CAVALIERS, VOL. IV, Charles Thomas - 400 acres in Goochland Co, Willis's River adj. William Mayo, Henry Cary & William Megginis. 20 Mary 1746. Goochland Deeds, DB 4 & 5 contain several deeds concerning a Charles Thomas of Henrico Co and a deed from DB 4, p.358: John Povall of Henrico Co for love & affecton to my son Richard Povall of Goochland ...400 acres already in his possession ...William Randolphs land ..on his line ...John Stuarts line on 6 Aug 1744, is signed by witness William Thomas. [These seem to be rather amazing coincindences.] In Goochland DB 7, p.87 is a list of debts due David Murray delivered by his attorney in fact, John Carlyle, and includes the name William Thomas - the list presented 18 May 1756; the debts presumably contracted some time prior to that date.

There was also a Patent for a William Thomas in Amelia Co, 400 A on 5 Jun 1746. Adj Anthony Haynes & George Foard. A later patent reveals that this Thomas may still have been in Amelia in 1758 - several years after "my" William Thomas is found in Halifax Co.

There is an entry in Stith's Entry Book, dated 13 Dec 1763 - George Thomas, 400 acres, South side Stanton adj Jeremiah Ward - doesn't seem to be the same land.]

The following Halifax records refer to the Ferry and lands that apparently William Thomas continued to maintain even after he relocated to Pittsylvania Co. Although the dates overlap with records in Pittsylvania, I have kept these together.
Halifax Co Pleas Book 1, p.168
18 Sep 1753 William Thomas granted license to keep ferry over Staunton below the Long Island ford and allowed 6d for a man and 4d each wheel on carriage. Thomas Dillard, James Collins, & Joseph Fair ordered to mark the best way for a road from the ford below the Long Island on Stanton R to the Courthouse and report to the next court.

I'm not sure that William ever completed the process and patented this land.]

The above is an abstract. The following differences were found in reading the deed book microfilm. The witness signed as J.R.Spearpoint. One of the witnesses proved the deed at Court on 26 Nov 1773. The other two witnesses proved the deed on 27 May 1773 & it was recorded. Obviously one of these dates is wrong – likely the single witness proved the deed in November of 1772.

<VAPITTSY-L@rootsweb.com> by Jan Lindley <jlindley@centurytel.net>, 28 Sep 2003.

William had a brother George whose widow Mary [traditionally Mary Woodson] married Edmund King. Here is a summary from May term, 1784 of the Pittsylvania Co Court:
George Thomas supposedly wrote a will 2 Apr 1770 - William may even have written it for him.
Mary & Edmund King first brought their petition in Sep of 1771 claiming that after the death of George, William Thomas, unknown to Mary, had applied to the court for administration declaring that George died intestate. So in the space of less than 18 months, George died, Mary remarried, William was appointed by the court to be the administrator of his brother George. One of the witnesses will later testify that Mary had been to court to give up the admin of her husbands estate to William - directly in opposition to Mary's original petition that she didn't know when William asked for the administration. [Perhaps there's more about this in probate records - would be in 1770/1771.]
Throughout 1772, the case is continued because William Thomas fails to show up in court with answer against the complaint. [Typical legal maneuvering even today - stalling tactic. Maybe Mary & Ed will give up or die off.] There's a gap in dates from 25 Mar 1773 to 17 Sept 1779. This would be partially during the Revolution and the Court simply may not have met for some of this time or some of the records are missing, maybe part of both. Maybe William and Ed both off with the militia.
In 1779, William did concede that George did die at the time proposed and his brother's widow remarried but there was no Will that would be agreeable to law. [Something about the will is not consistent with the Law - there weren't the proper witnesses, etc.]
On 18 Sep 1782, the court decreed that the Negroes and moveable estate be delivered to Edmund & Mary. William immediately appealed which would have halted any such delivery.
THEN, the next entry says 19 Aug 1773 ...this is so far out of date sequence that I'm assuming it's either a typo or even an error by the Court Clerk. At any rate, this appeal produced the right to a jury trial in May of 1784 which seems consistent with a date of 1783.
17 May 1784 - The Trial. Among the depositions is one by James Sounders, I think this may be James Saunders/Sanders as I've seen his name before in connection with the family.
Other depositions in writing by Frances Shackelford, Ann Gill, James Gill, & William Ramey. Elenor Bingham gave her testimony that the widow of George Thomas had been to court to give up administration of her husband's estate to William Thomas and on returning home...declared she was well satisfied with what she had of her husband's estate ...believed the will of George Thomas was of no account.
The jury did decide that the Will was legal BUT the court was of the opinion that the legality of the evidence was insufficient and William was granted an appeal. I'm guessing something to do with the depositions from residents of North Carolina rather than in VA.

There has been confusion over whether or not there was a George Thomas Sr, father to William and George. This probably comes from a July 1770 Court Order in Pittsylvania that says "Ordered that William Thomas, Son and Heir at Law of George Thomas deceased and the widow of the said George be summoned to appear here at the next Court to take upon them the Administration of the Estate of the said George, if to them or either of them it shall seem expedient." The word "Son" is obviously an error on the part of the court scribe or a lawyer - but has created conflict nevertheless.

21 Sep 1786 Henry Dillian, Edmund King, both of Halifax Co, William Thomas of Pittsylvania Co to Joseph Echols of Halifax, for £820 to them in hand paid according to their several agreements, they have jointly sold to sd Joseph Eckhols, 4 tracts in Halifax and on the Stanton River, mostly adjoining the Long Island Sluice, containing about 800 acres in the whole "being Grant by patent just two of which to the said William Thomas and one of Abram Eckhols" which are bounded as per general record may appear, except about 8 acres at the upper end, "adj all which tracts being together" are bounded by Stanton River in sd Joseph Echol's line, John Barbers line, Jonadab Georges line, Jones, John Word, Luck's line, Henry Dilling, the mouth of a Branch at the Long Island Ford. signed: Henry Dilling, Edmd King, Wm. So here was the proof that William did indeed retain at least two tracts in Halifax Co on the banks of the Staunton River for all these years - this would also be the ferry at the Long Island Ford. Here is also proof that Edmund King was now married to an Elizabeth.

1820 Census. Peyton Thomas is listed although he may already be living in Missouri. There is a female over age 45 listed by his name, which follows that of Phil Thomas and Phil Thomas as Adm. for Asa Thomas. I think this may very well be Joyce.

Departed this life in the 99th year of her age. Another place in the Bible - age 99 years, 8 months, 20 days.
Another note in the Bible states that she wrote these in the year 1802, Sept 20th.

L. Starling Thomas stated that she died about 1818 and that she lived with her son Philip in her later years. Certainly she lived several years longer.

WILLIAM THOMAS and JOYCE WATKINS had the following children:

The following deeds were found in Rockingham Co NC. It appears a William Thomas bought 150 acres to given to Sarah Lewis. It is curious that he has the same name & is probably about the same age as this William. There seems to be no connection. Most of the associates of the William Thomas of Rockingham appear to be associates of James Holderness as well, but neither can be found to have a connection to those of the same name in Caswell Co..

George THOMAS8 was born on 15 March 1771.11 He died on 19 October 1799 at the age of 28.11

There is a marriage record in Halifax Co, William Thomas to Frances Crowder, 31 Jun 1794; George Thomas bondsman. When George's brother died, his will left everything to his brothers or nephews and no wife was mentioned. Could this William be the son of the Philip Thomas who died in Halifax before 1803? Multiple William Thomases or found, not so many Georges.

The following John Lewis was often referred to in legal documents as John Lewis "Byrd" to differentiate him from all the other John Lewises. The fact that Asa & George Thomas were witnesses to this document in Pittsylvania Co may indicate prior ties between these families as far back as Goochland Co. John Lewis, the son of John "Byrd" Lewis eventually ended up as owner of the lands of George, left jointly to Asa and Peyton.
