Will of James McCurdy Deceased
In the Name of God Amen.  I James McCurdy of the Township of Fairfield County of Westmoreland & State of Pennsylvania being sick & weak in body but blessed be God, of sound & perfect mind & memory calling into mind  the mortality of my body and that it is appointed for all men once to die do make ordain and publish this my last will & testament that is to say that first and principally I recommend & resign my soul into the hands of God who gave it & my body  I recommend to the dust to be buried in a decent Christian manner at the discretion of my Executors nothing doubting but at the general resurrection I shall receive the same by the mighty power of God, and as touching such worldly (Estate) substance wherewith it hath pleased God to bless me in this life I give __& dispose of in a manner & form following Viz. First I give & bequeath to Elizabeth my dearly beloved wife the whole of my personal estate after paying my funeral expences my Just debts of the expences of patenting my land claim I give & bequeath to my son Robert the undivided half of my real estate both with respect to quantity & quality to him his heirs & assigns forever the said Robert to enter into the full possession thereof as soon as he shall attain to the age of twenty one years.  Item & if my wife Elizabeth who is now pregnant is delivered of a son I give & bequeath to the said son the other undivided half of my real Estate he attaining to the age of twenty one years shall enter into the possession thereof & to enjoy by him his heirs & assigns forever.  Item I give & bequeath to my two daughters Jane & Elizabeth the
sum of fifty pounds each to be paid by my two sons [provided my said wife shall be delivered of a son equally in manner following viz one third in Cash & two thirds in property my said sons are not to pay any thing untill one year after they enter into the possession of their estates as above specified at which time one third of the above sums bequeathed to my Daughters shall become due & then to be paid in three equal yearly payments Roberts fifty pounds which will be first due to my said daughters shall as he yearly pays it be equally divided between them& so with respect to the fifty pounds which will be due from my other son it shall be divided in the same manner. But if my said wife shall be delivered of a daughter then the last mentioned undivided half of my
real estate to be equally divided between my said three daughters which division is to take place at the time my daughter Jane arrives at the age of eighteen years untill which time my wife Elizabeth is to remain in the full & entire possession of the said Estate for the raising Supporting & educating my said children after which time [in case she is pregnant with a daughter] & untill my son Robert attains to the age of twenty one years she is to possess & enjoy his half thus divided & if with a son then hers to possess & enjoy the whole untill my son Robert comes of age as above & then the other half untill my other son shall attain to the age twenty one years for which raising & educating my said children my wife Elizabeth shall stand accountable and in case of the death of my wife Elizabeth then the Estate to be rented and the profits arising therefrom to be divided between my said children in equal perportions if any remains after deducting what will be necessary for their education & support.  But in case she should marry she may still reside on the said Estate with giving Sufficient Security that it shall not be injured damaged or wasted either in its timbers or otherwise untill my daughter Jane becomes of age & in case she remains my widow untill my plantation goes out of her possession agreeable to the terms of this my last will & Testament then she is to receive a sufficient & reasonable support from whole of my real estate during her natural life the remaining the remaining my widow. And I do hereby appoint & Constitute Mon July 18 Elizabeth my wife Executrix & Joseph Ogden &
Thomas Pollack Executors of this my last will & Testament hereby Revoking & Disannulling all former wills & Testimonies by me made & Ratifying & confirming this my last will & Testament In Witness whereof I have hereunto set my hand & Seal this twenty sixth day of February Anno Domins one thousand eight hundred & three.

In the name of God Amen. I John McCurdy of Hempfield Twp., Westmoreland County and State of Pennsylvania, being sick and weak in body, but of sound mind memory and understanding (Praised be God for it) and considering the certainty of Death and the uncertainty of time thereof, and to the end I may be the better prepared to leave this world whenever it shall please God to call me. Hence, Do therefore make and declare this my last will & testament in manner following that is to say, first and principally I commend my soul into the hands of Almighty God my creator, hoping for free pardon and remission of my sin, and to enjoy everlasting happiness in the heavenly kingdom, through Jesus Christ my Savior, My Body I commit to the earth at the discretion of my executors herein after named, and as to such wordly estate wherewith it hath pleased God to entrust me. I dispose of agreeably to the laws of PA. It is my will that my executors make a settlement with the warrantees of the land which I settled in Butler Co., and procure a patent on the settlement which I made, and sell and convey the same to the best advantage for the benefit of my estate, and I make and ordain my beloved wife Ann McCurdy my executrix of this my last will and testament.

Will of Joseph T. McCurdy
Joseph T. (J.T.) McCurdy, 1899, Armstrong Co., PA (vol. 6, page 71, #6066)

  I, J. T. McCurdy of Kittanning, Armstrong County, being of sound mind, memory, and understanding do make and publish this my last will & testament hereby revoking and making void all former wills by me any time heretofore made.
   As to such estate as it hath pleased God to interest me with I dispose of the same as follows by:
 Item I give devise and bequeath to my beloved wife Nancy M. McCurdy, the first two hundred acres of land more or less situate in West Franklin Township, Armstrong County, Pennsylvania that I own bounded by George Campbell, Thomas Story, David Barr and others. Also the one ******** one third of forty acres of land I own situated in the same township bounded by O. D. McMillen, Frank Ruth, George Paff, Mrs. Monroe and others. And all the real estate that I now own or may own at the time of my death with full right to sell the same and make deed or deeds for the same or any part as soon as she can get a fair price for the same and should she sell the same or any part she is to have one third of the purchase money and the balance is to be distributed amongst my children and heirs at law as hereinafter stated should she not sell the same during her lifetime.  After her death the same is to be sold as soon as a fair price can be obtained and this money is to be distributed amongst my children and heirs at law as hereinafter  stated.
 Item I give and bequeath to my beloved wife Nancy M. McCurdy all my many personal property, goods and chattels and at her death what is left is to be distributed amongst my children and heirs at law as stated here below.
 Item I give and bequeath to Mary Caroline McCurdy thirteen hundred dollars as soon as she needs it to make here even with what my other children get for setting up ***
 Item after the above bequeath having been first taken out of my estate for the said Mary Caroline McCurdy I bequeath the balance of my estate as follows by:
One fifth to Margaret M. Monroe wife of William Monroe, one fifth to Mary Caroline McCurdy, one fifth to Cora Bell Campbell wife of M. A. Campbell, one fifth to Martha J. McCane wife of Harry McCain, and one fifth to William McCurdy child of my dead son James S. McCurdy after taking out the five hundred dollars I heretofore advanced to my dead son James S. McCurdy which is due me from him. Should my grand son William McCurdy die before I do then all his share and interest in my estate is to go to and be divided amongst my children Margaret M. Monroe, Mary Caroline McCurdy, Cora Bell Campbell and Martha J. McCain.
   I do hereby nominate constitute and appoint Nancy M. McCurdy my beloved wife sole executor of this my last will and testament.
   In witness whereof I, J. T. McCurdy the testator have to this my will written on one sheet of paper set my hand and seal this 31 day of March 1897

SAMUEL McCURDY
1865, Westmoreland Co., PA (vol. 5, page 31)

     "In the name of God assert I Samuel McCurdy of Derry Township, Westmoreland County, being sound in mind but weak in body and considering the certainty of death and the uncertainty of the time thereof and I may be the better perpared when it pleaseth God to call me home , do publish this, my last will and testaments.
     First and principly, I commend my soul to God who gave it and my body to Earth to be buried in a decent and becoming manner. And to such worldly goods as it has pleased Got to entrust me with, I dispose of the same as follows. I give and bequeath unto my beloved wife Ellinor her
choice or either mares and buggy harness ect. and further my said wife the use of and control of all the live stock on the place.  During the life time of John Old and Peggy Duncan, they all to remain on the premises, as now situated during life to be maintained in a comfortable living during said time my said wife to have control of the dwellings and farm not otherwise desposed of during life.
     I will and bequeath to my son John A. McCurdy, the premises on which he now resides to the amount of one hundred acres beginning at Township road near S house thence by said road westward to within fifteen rods of the barn then at right angle southward fifteen rods then westward to Land of A. Holestone said hundred acres to be John A. Brisom from my estate.
     I further direct that after the death of my wife Ellinor, the balance of my real estate to be sold at public or private sale to the best advantage, the procedes to be desposed of as follows, To Alexander H. McCurdy, the sum of four hundred dollars. To Samuel M. Rutledge, the sum of one dollar. To Ann Rutledge, the sum of six hundred dollars. To Elizabeth Roberts, the sum of three hundred dollars. At the death of my wife Eleaneor, I direct all my personal property household goods etc to be sold. All the debit and funeral expenses cast etc to be paid, the balance or a final settlement if any should be devided share and share alike to Alexander H. McCurdy my son and Ann Rutledge and Elizabeth Roberts my daughters. as I am part owner of a piece of ground near
Livermore Baptist Church I direct interest in the same to be sold soon after my death the procede after paying all charges to be paid to my wife Elinor. I further direct my son John A. McCurdy to have one third of the apple, cherries & pears on the place each year for the term of 5 years or as long as Elinor my wife shall live. I direct my two share of Bridge stock to be sold soon after my death the procedes to be paid my wife Elinor who is to have the procedes of the farm and further she to pay all funeral expenses doctor bills etc of my self John Old, Peggy Duncan. In case of the death of my wife Elinor before direct my execetor hearafter named to make provisions for them on the said homestead farm until their death and further I appoint James Rutledge my execetor to carry out all and every of my directions- make sale of real estate perfect title thereof as fully as I myself could do this and there present. In witness I set my hand and seal this first day of Sept. AD 1865 by request testator and in the presince of each other we witness the same.
