WILL
OF
ANDREW BAKER
MONROE COUNTY,
MISSOURI
1835
In
the name of God amen I Andrew Baker of the county of Monroe & state of
Missouri feeling indisposed but being of sound and disposing mind do make this
my last will and testament in word and form following (to wit), 1st after
payment of my just debts I give and bequeath to my beloved wife Phebe all of my
personal and real estate during her natural life or widowhood for the support of
her and my children which may remain under her jurisdiction.
2nd
As some of my children has already received some of my property which I intend
they shall keep each as herin after set down to be deducted out of their equal
part in order that all my children may receive an equal part. My daughter Nancy
Snell has received one cow at $10 , one ---- (?) at $4, one bed at $20 amounting
in all to $34. My second daughter Polly Hayden has received one cow at $10, one
bed at $15 amounting in all to $25. My son Isaac has received one man at $35 and
$50 I gave him to buy forty acres of land amounting to $85. My son Andrew has
received a horse at $35, one cow at $6 and $50 I gave him to buy land amounting
to $91. And my son William has received 1 filly at $35.
3rd
Now my will desire is that the balance of my children to wit, Moses Elizabeth
Phoebe and Elijah Baker, my stepson who now resides in Shelby County and state
of Indiana, shall receive a full equal share of my estate except Nancy Snell
& Polly Hayden the balance which may be coming. I leave to George Buckhart
in trust for them and their children as I don't want their husbands to have any
control over it or ant part thereof.
4th
All my desire is that at the deseas of my beloved wife that my plantation be at
a twelve month credit and the proceeds be divided among my children agreeable to
my will as specified above.
6th
I require my exectutor to have my estate appraised & the amount lodged in
the clerks office of their proper county and that the County Court shall have no
control over my exectutor in making him settle annually unless he see cause to
do in arranging the estate among my heirs.
7th
For divers good causes I have thought proper to name my good friend George
Buckhart my exectutor to carry out the provisions of this my last will and
testament. In testimony whereof I have hereunto set my hand and affixed my seal
this 9th day of our Lord Eighteen Hundred and Thirty

of Missouri County of Monroe County Court of Monroe County in probate before the
clerk thereof in vacation of said court the foregoing instrument of existing
purporting to be the last will and testement of Andrew Baker deceased was
produced before the clerk of said court and forever by the oaths of Reese Davis
& C. F. Buckhart two of the transcending witnesses thereto and ordered by
the said clerk to be recorded.
