Will of Jonathan Via, Sr., 1858

I, Jonathan Via Sr. of the County of Albemarle and State of Virginia do hereby make my last will and testament in manner and form following; That is to say:

1st, I desire that my just debts and funeral expenses should be paid out of such property as my Executrix and Executor hereafter named shall think proper.

2nd, After This payment of my debts & funeral expenses, I give to my wife Elizabeth Via all my estate both real and personal for and during her life.

3rdly I give to my wife Elizabeth Via the one half of my estate, at her death to dispose of to whom she may Think proper.

4thly I give to my Son John A. Via one dollar, to be paid to him by my executrix or executor in The final Settlement of my estate.

5thly, I give to my children herein after named, the one half of my estate remaining after The death of my wife to be equally divided among them (except one dollar to John A. Via) to wit: James B, Mary E., Henry O, Adam L, George A., Samuel M., Tho. D., & Maria P. Via, and Frances Anne Lane, which I give to them Their heirs administrators and assigns forever.

And lastly, I do hereby Constitute and appoint my wife Elizabeth and my son Adam L. Via as my executrix and Executor of This my last will and testament, hereby revoking all other or former wills or testaments, by me heretofore made.

In witness whereof, I have hereunto set my hand and affixed my seal This 10th day of Sept. in the year 1847.

This Instrument of writing purporting to be the last will of Jonathan Via Sr. was produced into open Court and being proved by the oaths of F.M. Wells and Nimrod Via Subscribing Witnesses, thereto, was ordered to be recorded.
