Will of Jonathan Via, Jr., 1888

I, Jonathan Via being of sound mind and memory do make and publish this my last will and testament in manner and form following (that is to say,

Item 1st. Whereas I have given my daughter Cynthina J. Nailor nine hundred and fifty dollars and it is my wish to give her one half of my estate and my daughter Mary E. F. Via and her husband Rodes J. Via the other half, I hereby will my tract of land upon which I live containing about one hundred and forty six acres to my daughter Mary E. F. Via and her husband Rodes J. Via which tract of land I value at fifteen hundred dollars that will leave five hundred and fifty dollars which my daughter Cynthia J. Nailor is to have out of my estate at my death unless I give her that amount before my death. When Cynthia J. Nailor receives fifteen hundred dollars in money and my daughter Mary E. Via and her husband Rodes J. Via the land at fifteen hundred dollars, the balance of my property which consists in stock bonds in fact every thing I own at my death one half of which is to belong to Cynthia J. Nailor and the other half to my daughter Mary E. F. Via and her husband Rodes J. Via.

Item 2, If my son in law Rodes J. Via should die before his wife then what I have willed to him is to revert back to his wife Mary E. F. Via.

Item 3rd I hereby appoint Rodes J. Via and William A. Naylor my sole executors of this my last will, and it is my wish that they qualify as such without giving security. Witness my hand and seal this the thirtieth day of January eighteen hundred and eighty six.

At a court held for Albemarle County March 7th 1888

A paper writing purporting to be the last will and testament of Jonathan Via decd was produced in Court and was proved by the oath of W. C. Early + W. G. Wood the attesting witnesses thereto, thereupon said paper writing is considered fully proven and ordered to be recorded as the last will + testament of Jonathan Via decd.
