Will of Jane Graham, 1854

February 16th 1854

if I should die and my daughter Rebecca M. without issue I want all my property that is left with Archibald Ballengee I want Elizabeth his wife to divid it between him and Rebecca Ballengee children as she may think best it is my will that Florenc Nowlan is to give to Cynthia Jane Ballengee a bed and cover to it out of my property, my bonds that is left with Arcable Ballengee I wish Rebecca M. to have the use of all during her life with out any controle of her husband and then to go to the children if they live to have any issue, if tha have no issue it is to go back to the colateral branches of my sister children, when this property fal to Martha, I want her to by my niecs Rebecca Jane Graham, Cynthia Jane and Mary Jane Ballengee a dress as she may choose and at her death if no issue as before me [?] I wan Rebecca Jane to have twenty dollars if any thing should remain and Mary Elizabeth ten dauters of Lanty Graham, all the rest of my property unmention I give my dauter Rebecca M. to do as she thinks best without any control of her husband all property that may hereafter fall to me by my fater or any heirship. I will it to my dauter Rebecca M. during her life and then devid between my sister children as she thinks bes. Given under my hand and seal

At Monroe County Court September Term 1854
    A paper purporting to be the Last Will and testament of Jane Graham deceased was produced in Court and there being no subscribing witnesses thereto John Noland, Stephen Eads and James Ellis were sworn and severally deposed that they are well acquainted with the Testatix handwriting and verioly believe the said writing and the name thereto subscribed to be wholly written by the Testatix own hand. Whereupon the said writing is Ordered to be recorded as a true last will and testament if the said Jane Graham deceasd. And on motion of Rebecca M. Miller the daughter (& Legatee of the Testatix, The Estate of the said Jane Graham decd. is Committed to the hands of John W. Lanius sheriff of this County who is directed to take the same into his hands and administer the same according to the law & the will annexed of the said decd.
