Thomas D. Via, Confederate and Union Soldier

Thomas D. Via (1842-1913), son of George A. Via, fought for the Confederate 7th Regiment of Virginia Volunteers between June 3, 1861 and July 3, 1863, when he was wounded and captured at the Battle of Gettysburg. On February 1, 1864, he enlisted in the 1st Regiment of U.S. Infantry Volunteers from the prison camp at Point Lookout, MD. Although it is unclear why Thomas D. Via changed sides in the conflict, it seems probable that he did so in order to be released from the POW camp at Point Lookout. Below are some of the most important documents in Thomas D. Via's pension file.

    On this 30th day of April, A.D. 1895, personally appeared before me the Clerk of the County Court in and for the aforesaid County, duly authorized to administer oaths John F. Boothe aged 41 years, a resident of the City of Charlottesville, in the County of Albemarle, and State of Virginia, whose Post-Office address is Charlottesville, Va. ... well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: 

I have known Thos. D. Via ever since I have been able to know anything and to the best of my knowledge and belief the kidney disease which he alleges as ground for pension claim was not brought on by vicious or bad habits. 

I can remember Thos. Via before the war and knew him after the surrender and have known him ever since. With the exception of my absence once or twice for a short time, I have lived at Charlottesville all my life, and Thos. D. Via has lived here during the whole time. I have been thrown with Thos. Via during all these years and I know of no bad vicious habits at all. 

The statements contained in this affidavit were written in my presence, and from my oral statements made to C. Wallin, [?] the person preparing this statement. The oral statements herein contained are made to the person preparing this affidavit on this the 30th day of April 1895, at the City of Charlottesville, Va., and in making the same I did not use, and was not aided or prompted by any written or printed statement or recital, prepared or dictated by any other person. I further declare that I have no interest in said case and am not concerned in its prosecution.

    On this 23 day of March, A.D. one thousand nine hundred and three, personally appeared before me, E. G. Haden a Justice of the Peace, within and for the  County and State aforesaid, Thomas D. Via, aged 62 years, a resident of the [sic] Charlottesville of A[lbemarle] County of County, [sic] State of Virginia, who, being duly sworn according to law, declares that he is the identical Thomas D. Via who was enrolled on the 1st day of Feby 1864, in Co., A. 1st U.S. Vols in the service of the United States in the war of the rebellion, and served at least ninety days, and was honorably discharged at Fort Leavenworth, on the 1st [illegible] day of May 1866. That he has not been employed in the military or naval service otherwise than as stated above. That he was not employed in the Military or Naval service BEFORE the 1st day of Feby 1864, or AFTER the 1st day of May 1866. That he is partly unable to earn a support by manual labor by reason of disease of kidneys and gunshot wound of left leg. That such disabilities are not due to vicious habits, and are, to the best of his knowledge and belief, permanent. That he has applied for pension under application No. 723.943 Rejected because of former service in Confederate armie [sic]. That he makes this declaration for the purpose of being placed on the pension-roll of the United States, under the provisions of the Act of June 27, 1890, as amended by the Act of May 9, 1900. DECLARATION FOR PENSION

    On this 6th day of March, A.D. one thousand nine hundred and seven, personally appeared before me, a notary public, within and for the County and State aforesaid, Thomas D. Via, who, being duly sworn according to law, declares that he is 65 years of age, a resident of Charlottesville county of Albemarle, State of Virginia; and that he is the identical person who was ENROLLED at Point Look Out, Va. under the name of Thomas D. Via, on the 1st day of February, 1864, as a Private, in Company A, 1st Regiment United States Volunteers in the service of the United States, in the Civil was, and was HONORABLY DISCHARGED at Fort Leavenworth, Kans., on the 10th day of May, 1866. That he also served _______. That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follows: Height, Five feet, Eight inches; complexion, Light; color of eyes, Gray; color of hair, Light; that his occupation was Farmer; that he was born November 1st, 1841, at Albemarle County Cleveland, Ohio.

Via deceased, that in said book affiant's date of birth is stated to be the 13th day of March 1863, and that the date of the birth of Thomas David Via is given as the 1st day of November 1842, and the handwriting, ink and paper of said page has all the indication of old age and affiant believes that the statement therein contained is the true age of Thomas David Via.

    On this 20th day of October, A. D. one thousand nine hundred and thirteen, appeared before me, a notary public within and for the county and State aforsesaid, Mrs. Nellie E. Via, aged 33 years, a resident of Rose Hill, Charlottesville, County of Albemarle, State of Virginia, who being duly sworn according to law, makes the following declaration in order to obtain the pension which had accrued to her husband, named below, at the time of his death. 
    That she is the widow of Thomas D. Via who served as a private in Co. A 1 Regiment United States Volunteer Infantry and who was a pensioner of the United States by certificate No. 1098513, on the roll of the Pension Agency at Washington, D. C.; that the last payment of his pension was made to the 4th day June , 1913; that he died on the 2nd day of August, 1913.
    That she was married under the name of Nellie E. Detamore to said pensioner at Charlottesville, Alb. Co., Va. on the 11th day of March, 1913 by J. W. Johnson; that there was no legal barrier to the marriage; that she had been previously married; that the soldier had been previously married. Her husband died June 9th, 1910 and his wife Nov, 1911.
    That her post-office address is Preston Ave. c/o People's National Bank, Charlottesville, Va., County of Albemarle.

His first wife was Sallie E. Via. She died the latter part of 1911. His second wife was Nellie E. Via. He was married to her March 11th 1913. Thomas D. Via's wife had been previously married to John Detamore. He died before she married Thomas D. Via.
