Deed: James and Mary Via to David McAlexander, 1848

 

This Indenture made this 13th day of October in the year of our Lord Christ One Thousand eight hundred and forty eight between James Via and Mary his wife of the County of Patrick and State of Virginia of the one part and David McAlexander of the same County of the other part Witness that the said James Via for and in consideration of the sum of sixteen dollars and fifty cents to him in hand paid by the said David McAlexander before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath bargained & sold unto the said David McAlexander a certain piece or parcel of land lying and being in the County of Patrick and State of Virginia on big Wiggeon Containing One acre be the Same more or less and bounded as follows to with Begining at a Persimon tree in the Bank of said Creek thence up said Creek a north west Course about nine poles to a ledge of Rocks thence near a south west Course about three poles to a mahogany Corner thence South some seventy five or eighty degrees West Supposed to be a little over nine poles to a persimon bush in a fence at the edge of a lane thence with the edge of the land supposed to be near West course then supposedly he believes seven or eight poles to a locust Stump thence near the same course a little over four poles to a hickory bush some __ __ on side of the said McAlexander line thence with his line to the begining To have and to hold the said land to him the said David McAlexander and his heirs forever and the said James Via doth bind himself and his heirs to forever warrant and defend the right and title of the said land against the claim and demands of all and every person or persons whatever unto the said David McAlexander his heirs and assigns as witness our hands & Seals this 13th day of October 1848

We John Tuggle and Jeremiah Burnett Justices of the peace in and for the County aforesaid do hereby certify that Mary Via wife of James Via party to the within deed bearing date on the 13th day of October 1848 personally before us appeared in our County aforesaid and being examined by us privily & apart from her husband and having the deed aforesaid fully explained to her She the said Mary Via acknowledged the Same to be her act and deed and declared that She had willingly Signed Sealed and delivered the Same and that she wished not to retract it Given under Our hand & seal this 9th day of November 1848
