33. Benjamin JOHNSON (Benjamin12, William2, Henry1) was born on 18 Nov 1763 in Goochland Virginia and died in 1812 in Goochland Virginia at age 49.

General Notes:
Benjamin Johnson Jr. was born November 18, 1763 according to the Douglas Register son of Benjamin Johnson and Susanna Pace. The 1782 and 1784 Goochland County tax lists for the western part of the County have Benjamin Johnson with Benjamin Jr. infant. (This would mean Benjamin Jr. was over 16 but under 21 years old at the time the list was taken.) Benjamin Jr. married Rachel Pace daughter of John Pace and Susanna Houchins on 20 December 1784. A copy of the marriage bond can be found today in the Goochland Circuit Court. It was witnessed by Francis Pace, brother to Rachel Pace.

We find the 140 acres of land that Benjamin Sr. had purchased from Josiah Pace tied up in a Chancery Cause filed November 20, 1815. Although there is no recording of the land being transferred to Benjamin Jr. It appears his mother Susanna did not sell the land as stated in Benjamin Sr.'s will but had given it to Benjamin Jr.

Benjamin Jr. and Rachel were both dec'd by 1812. (see Goochland County Chancery File 1815-007 at the State Library of Virginia) In this case, we find all living children of Benjamin and Rachel Pace Johnson along with sons in law Augustine Shepherd and James Shepherd.

November 20, 1815 we find the Order recorded in Goochland Circuit Court: John Johnson was appointed guardian to the minor children: Elizabeth Johnson, Susanna H. Johnson, Benjamin Johnson, Stephen Johnson, Marianne Johnson and Eliza Johnson orphans of Benjamin Johnson dec'd. and gave bond in the penalty of $3,000.00 with Robert French, Robert Pace & William Salmon Jr. as his securities.

Robert Pace (father in law to John Johnson) was appointed guardian to the minor children for the purpose of the Chancery Cause.

Transcription of Complaint as follows:

Complaint: John Johnson, James Shepherd and Rachel his wife, Augustine Shepherd and Ann his wife, together with Elizabeth, Susanna H., Benjamin, Stephen, Marianne, and Eliza infants v. Robert Pace guardian to the infant children.

To the worshipful Court of Goochland in Chancery sitting. Humbly complaining shew to the courts our orators & oratrices, John Johnson, James Sheppard & Rachel, his wife, Augustin Sheppard & Ann his wife, That ____________ in December in the eary of our Lord 1812, a certain Benjamin Johnson departs this life leaving your orators John & your oratrices Rachel & Anne children & heirs together with Elizabeth, Susanna H., Benjamin, Stephen, Maryann, & Eliza Johnson infants, and possessed at the time of his death of a certain tract or parcel of land containing one hundred & forty acres - lying in the aforesaid county of Goochland on the waters of the Little Byrd Creek & bounded on the West by the land of John Miller, by the land of Stephen Johnson on the south, & on the east & north by the lands of William Ware, Joseph Pace, & Robert Pace - & that the land is in such a quantity that the dividend of each heir would fail short of the value of a hundred dolers. Your orator & oratrices further alledge that the said Benjamin Johnson dec'd left at his death, two negro slaves named Julia and her child Matilda to descend to his heirs before named which can not be divided in kind among them. Your orators & oratrices now pray that the said Elizabeth, Susanna H., Benjamin, Stephen, Maryann, & Eliza Johnson infant children of the said Benjamin Johnson dec'd be compelled to answer____________________________ the court doth herein order & decrfee that the aforesaid tract of land & the before named negroes be sold & the proceeds thereof be divided between the said heirs of the said Benjamin Johnson dec'd according to the legal rights. & that the court would grant such other & further _____________________ with equality and good conscience.

The answer of Robert Pace guardian of Elizabeth, Susanna H, Benjamin, Stephen & Maryann & Eliza Johnson infant children of Benjamin Johnson dec'd to a ___ of complaint _____ against them in the worshipfull court of Goochland by John Johnson, James Sheppard, & Rachel, his wife, & Augustin Sheppard & Ann his wife.
This respondent for answer saith that he admits the truth of the allegation in the said bill & consents to such a decree as is prayerfer & prays to be dismissed hence within his ___________.

When reading this, we are struck by how odd it was that the Clerk writing the complaint listed Susanna's middle initial and none of the other children's. One must wonder if someone was trying to correct his spelling as he was writing: "Sir, Susannah - with an h"

Recent DNA tests showed a perfect match between the descendents of two of Benjamin and Rachel's sons.

Noted events in his life were:

Land Transactions & Sources: In Chancery Case 1815 Johnson Heirs vs Johnson Heirs filed at the State Library of Virginia we find Benjamin has died and the 140 acres his father had purchased from Josiah Pace ordered to be sold to the highest bidder.

This case also lists all of Benjamin and Rachel's Children.

Benjamin married Rachel PACE, daughter of John PACE and Susanna HOUCHINS, in 1784 in Goochland Va. Rachel was born on 21 Dec 1766 in Goochland Va and died before 1813 in Goochland Va.

General Notes: This Rachel (Daughter of John Pace) is sometimes confused with another earlier Rachel Pace (Daughter of Joseph Pace) who moved to Kentucky.

Rachel's brother Francis Pace signed as surety on the marriage bond of Benjamin and Rachel.

Noted events in her life were:

Marriage: 1784, Goochland Va. Rachel died at the same time or before her husband around 1813

Children from this marriage were:

+ 47 M    i. John JOHNSON was born in 1784 in Goochland Virginia.

General Notes: Susanna Johnson married Edward Pace on September 21, 1784. Edward was the brother of Rachel Pace who married Benjamin Johnson Jr. According to Pace family researchers, Edward and Susanna moved to Kentucky.

Susanna married Edward PACE, son of John PACE and Susanna HOUCHINS, on 21 Sep 1784. Edward was born in 1761 in Goochland Va and died before 1820 in Warren Co KY.

35. William JOHNSON (Benjamin12, William2, Henry1) was born on 16 Dec 1768 in Goochland Virginia and died in KY.

General Notes: The marriage bond of William Johnson and Susanna Holland is found in the Goochland County Circuit Court. Although no parents are listed in the bond or in the marriage register, Edward Matthews is listed as surety.

William Johnson married Susanna Holland on August 18, 1788.

Although it seems William did not receive any land from his father's estate, there was a guardian account for 1786 through 1788 filed in the Goochland Circuit Court DB 20, pg 529 showing that he did receive a portion of his father's estate. This account was not recorded until many years later in 1809. Of note: Edward Matthews is listed as succeeding M. Mims in the guardianship of his property.

William's sister, Susanna Johnson married Edward Pace who is found on the 1825 Edmonson KY tax list and the 1830 US Census as does William. It would appear that William Johnson is the identical William Johnson found in Edmonson KY.

William married Susanna HOLLAND on 18 Aug 1788. Susanna was born on 13 Sep 1758 in Goochland County and died in KY.

General Notes: At the time of this writing, some researchers have theorized that Susanna Holland was actually Susanna George who had previously married George Holland Nov 7, 1779. At this time we have not proven this and (for the time being) will continue to list her as Susanna Holland until we can prove otherwise.

Children from this marriage were:

+ 56 F    i. Christian JOHNSON was born in KY and died in KY.

+ 57 F    ii. Nancy JOHNSON was born in KY and died in KY.

+ 64 F    ix. Margaret JOHNSON was born in KY and died in KY.

36. Curtis JOHNSON (Benjamin12, William2, Henry1) was born on 21 Sep 1770 in Goochland Virginia.

General Notes: Little is known of Curtis Johnson. It would appear that his sister's (Susanna Johnson) husband Edward Pace was appointed guardian of Curtis.

Goochland County Order Book 18, pg.729: Thomas Smith, James Winston, Col. Thomas Meriwether & Doct. Andrew Todd or any three of them are appointed to state, audit and settle the accounts of Edward Pace Guardian to Curtis Johnson Orphan of Benjamin Johnson Decd. & report the same to Court.

Curtis married Sarah Bragg on Oct. 7, 1793. Edward Pace was a witness. Also in 1793,
Curtis purchased land from William Baskett in Fluvanna County:
DB#3, p 66. Nov. 1, 1793. William Baskett sells to Curtis Johnson for 50 pounds, 109 a. Bounded by Samuel Richardson, William Benthy, John Timberlake. Wit: William Baskett, Walter Johnson., John Kent, Robert Kent. Signed: William Baskett. Ackn. & rec. Feb. 6, 1794.
