Will of Caspar Eichelberger ~ 1857

In the name of the Benevolent Father of all, I Caspar Eichelberger of Crawford County, Ohio do make and publish this my last will and testament.

1st I give and devise to my beloved wife in lieu of her dower all my property of every description during her natural life.

2. I give and devise to my granddaughter Sarah Mariah, daughter of Mary Bresler, the sum of two hundred dollars provided she continues to preserve and sustain a good respectable reputation to be due and payable to her upon the death of my said wife.

3. All the residue of my property I give and devise to my daughters Adaline Eichelberger and Sarah Ann Eichelberger share and share alike. Should either die without heirs before receiving what is hereby devised to her, the same shall be paid to the survivor of them.

4. Of the amount hereby devised to my said wife she shall pay all my just debts and costs of administration.

5. Having discharged my duties to my other children as my circumstances and sense of right have permitted I do not make any devise to them by this will.

6. I do hereby nominate and appoint John Trimble of said county executor of this my last will and testament hereby authorizing and empowering him to compromise adjust release and discharge in such manner as he may deem proper the debts and claims due me. I hereby revoke all former wills by me made. In testimony I have here unto set my hand and seal this tenth day of August AD 1857.

The STATE OF OHIO, CRAWFORD COUNTY:

We, Franklin Adams and Wilson C. Lemert being duly sworn in open court, the 6th day of April AD 1859 depose and say, that we were present at the execution of the last will and testament of Caspar Eichelberger hereunto annexed; that we saw the said testator subscribe said will, and heard him publish and declare the same to be his last will and testament, and that the said testator, at the time of executing the same, was of full age, and of sound mind and memory, and not under any restraint; and that we signed the same as witnesses at this request, and in his presence, and in the pressence of each other.
