  • Feb 10, 1800 DEED Father William deeds land to John and mentions all the other children.
  • In division of slaves from Father William Whitmell receives:
    Negro Arthur Also 1/6 of his father's household.

    In 1808 William (the brother) divides his land NO mention of Whitmell or Blount.

    In 1817 when Starkey died in Martin County there is NO mention of Whitmell or Blount.

    In Jan 1819, when his sister, Sarah King died he received 1/6 share of 45 acres of land in Martin County. We have the records where James, John, Henry and Thomas sold their shares to Luke Harrell in Martin Co, but we've never seen what happened to the 2/6 that Whitmell and Blount would have owned.

    According to my calculations they would have been over 21 or just about that at the time.
    I think they were living with their mother and counted in the 1820 census with all their slaves.

Tyler are held and firmly bound unto William Sparkman, Anthony Copeland & Thomas L. West Esquires, Justices of the Peace for Bertie County, the survivor or survivors of them, their Executors and Administrators, in trust for Whitmell Ruffin in the sum of Ten Thousand Pounds: To the which payment well and truly be made, we bind ourselves, our Heirs, Executors and Administrators, jointly and severally, firmly by these Presents. Sealed with our seals, and dated this 14th day of Febry in the year of our Lord One Thousand Eight Hundred and Sixteen Whereas the above bounden John Ruffin hath been this day appointed by the Worshipful Court of Pleas and Quarter-Sessions of Bertie County, Guardian to Whitmell Ruffin orphan of William Ruffin deceased; the above named justices being in Court and granting the said Guardianship: Now the condition of this obligation is such, That if the said John Guardian as aforesaid, shall well and truly discharge his said Guardianship, by taking care of and improving all the estate belonging to the said orphan; and shall also settle his Guardianship accounts with the Court of said County, as is required by law; and that he will deliver up to the said Whitmell orphan, as aforesaid, when he shall attain lawful age, all such estate as he ought of right to be possessed of, or sooner if required, agreeable to law; then this obligation to be void, otherwise to remain in full force and virtue.     TJP Smallwood sells what I think is this very same land back to Joseph B. Ruffin....for $1.00 "known as Joshua Outlaw land" borders Isaac Freeman, Silas Hobbs, William J. Pritchard

    We don't know what happened to this land between 1843 and 1857....but perhaps West Mizell is connected to TJP Smallwood.

    Thomas J. Pugh Smallwood's parents were: John Smaw Smallwood and Mary Lockhart PUGH....but he had 2 sisters: Mary Winnefred
    Sally Elizabeth who married Wm Peterson GURLEY
    His brother is Charles Smallwood.
    West Mizell is the son of Hezekiah Mizell.
    Judath Brittan 10 Feb 1811 will:

    sister: Ann Mizell
    West Mizell (son of Hezekiah Mizell) Negro Hardy when he is 21, but if my mother should die before that time I lend the said Negro to his father until the said West comes of age. Executor: Hezekiah Mizell (must be husband of sister Ann)
    Wit: Hardy Freeman, John Holley So West Mizell must have lived to be buying the land in 1843....and was approximately 50 years old at that time.
