LAST WILL AND TESTAMENT OF JOHN TABOR, Sr.
In the name of god, Amen, I John Tabor of Rutherford County and State of North
Carolina being sick and weak in body but of perfect mind and memory, thanks be
to god, calling unto mind the mortality of my body and knowing that it is
appointed for all men once to die do make and ordain in my last will and
testament, that is to say, principally and first of all I give and recommend
my soul into the hands of the allmighty god that gave it and my body I
recommend to the Earth to be buried in a decent Christian burial at the
discretion of my Executor nothing doubting but at the general resurrection I
shall receive the same again by the might power of god and as touching such
worldly Estate wherewith it has pleased god to bless me with in this life I
give, demise and dispose of the same in the following manner and form. First,
I give and bequeath to Elizabeth my dearly beloved wife all my land and my
other estate for her while she remains a widow during her life and afterwards
to be equally divided among all my children which said divide shall take place
at a time if she do marry again with the allowing her a childs part with them.
Also, I do allow and give my youngest son Ely, one young horse beast not to
exceed fifty dollars value at some convenient time before he comes of age
exclusive of his equal part at such time as my executor may think most proper
and I do hereby utterly disallow revoke and disanul all and every other former
testament, wills and legacies, bequeaths and executions by me in any
wisebefore named will and bequeathed ratifying and confirming this and no
other to be my last will and testament. In witness whereof I have hereunto
set my hand and seal. I do hereby nominate and appoint my wife Elizabeth , my
son, Solomon Tabour and Thomas Tabour as my executors all witness my hand and
seal in above written in the presence of all and who in his presences and in
the presence of each other hereto subscribed and named this 24th day of
September one thousand eight hundred five.

Known all men by these presents that we Thos. & Joseah Capshaw and
Elizabeth Capshaw all of the States of Tennessee and Kentucky do hereby
nominate constitute and appoint Eli Tabor of the County of Rutherford and
state of North Carolina to be our true and lawfull attorney for us and in
our name and stead to bargain and sell to John Moore of Rutherford County
State of North Carolina all our rights and Interest to and in that tract or
parcel of land lying on both sides of the south fork of White Oak Creek in
the County of Rutherford aforesaid whereon John Tabor Senr. resided at the
time of his Death and which sd. tract or parcel of land has been since his
Death occupied by his widow Elizabeth Taber and lately by her sold to John
Moore aforesaid and we hereby give and grant to Eli Tabor aforesd. full
power and authority to sell bargain with and dispose of to the sd. John
Moore all Rights claims and Interests which we have or may hereafter
possess in the sd. tract or Tracts of land whither derived from the last
will and Testament of John Tabor Senr. Decd. or as his natural heirs as
well for ourselves as our heirs Extrs. an binding them and ourselves to
abide by and perform any contract for or sale of Sd. land that Eli Tabor
aforesd. may make with sd. Moore in as full and ample manner as we could
have done ourselves had we done it in person in witnexss whereof we have
herewith set our hands and seals this 3rd of Nov. 1815-
