Event-Misc: Applied for Homestead, 8 Aug 1901, Lawton, Comanche, Oklahoma, USA. 97 Event-Misc.: Homestead and Land Entry Document, 10 Mar 1903, Lawton, Comanche, Oklahoma, USA. 97
The Homestead and Land Entry document executed at the Lawton Land Office states in part that I, Claiborne Dewberry of Seward, Oklahoma, a registered homestead applicant, assigned number 375 under the President's proclamation of July 4, 1901, providing the manner of entry and settlement of the Wichita, and Kiowa, Comanche and Apache ceded lands, do hereby apply to enter, under Section 2289, Revised Statues of the United States, the Act of Congress, of June 6, 1900 (31 Stat. 679), and of March 3, 1901, (31 Stat. 1093), the NE Quarter of Section 8, Township 1 N, Range 12 @, I.M. containing 160 acres. The Register and Receiver fee was $14.00.

On January 29, 1903, Bert Howard as Publisher or Foreman of the Weekly Republican, a newspaper of general circulation, published at Lawton, Comanche County, Oklahoma swore an affidavit that a publication notice was published in said Weekly Republican once a week for six successive weeks beginning December 18, 1902 and ending January 29, 1903. The notice states that "Notice is hereby given that the following named settler has filed notice of his intention to make final proof in support of his claim, and that said proof will be made before the Register and Receiver of the U.S. Land Office, at Lawton, Oklahoma, on March 10, 1903, viz: Claybourne Dewberry, for the NE quarter of section 8, Township 1 N, Range 12 @, I.M. He names the following witnesses to prove his continuous residence upon and cultivation of said land, viz: General Harrison of Cache, O. T., George W. Crosby, David C. Crandell, and Frank Cal; all of Lawton, O. T. The Cash purchase of $200.00 was entered March 18, 1903, Land Entry Number 871.

On 10 March 1903, the witnesses stated that (a) the land was used for prairie farming and grazing, (b) the land was settled in Jan 1902 and occupied continuously since, (c) 20 broken acres were under cultivation, and that (d) improvements to the land included a two room box house (10x20 feet), a 2x14 foot dug-out, a 14x8 foot shed and stable, a well, a small orchard, and 1 mile of fence - total value $250.00 - $300.00. He also noted that 1 acre of land was set aside for school purposes.

By Jack Werkley

"I guess it's because we work so hard and stick together and sing all the time."

That's Clayburn Dewberry's explanation of how he and his 13 children have wrested a happy, plentiful living from a 40-acre homestead farm near Guthrie for the past 38 years, kept off the relief rolls and out of the jails.

The 67-year-old Negro brought four of his six sturdy sons to the Oklahoma Education Association Convention here Thursday and stole the show at the Oklahoma Folklore society's annual meeting in the Municipal auditorium.

Sustained cheers from an audience of 500 persons brought them back to the stage again and again for encores of Negro spirituals carried down through generations of southern slaves.

"Praise God, I'm satisfied For me He bled and died."

When the day's work is through, the Dewberry family, the six boys and seven girls and the 64-year-old mother, gather in their five-room farmhouse and sing those spirituals.

"No" Dewberry said. "I never did see the words in writin' and I don't know what I'd do if I did because I can't hardly read and neither can the boys. We're just workers."

Dewberry said he just picked them up while a boy on a Texas plantation. He came to Oklahoma in 1900 and settled on the homestead site the family still occupies.

As the boys grew up, Dewberry explained, he just kept them satisfied at home by sitting around the house and learning the spirituals.

A couple of months ago, Mrs. H. Seay Binion, supervisor of primary training at Central State Teachers' College, Edmond, heard about the Dewberry family.

She visited them at their home and after much argument finally got them to agree to come to the convention.

Heretofore, they only had sung at the Negro Methodist church near Guthrie.

The only way to keep out of trouble," the father philosophized, "is to keep busy. You don't have to go on relief if you works the land hard. We ain't had no trouble but I guess it's because we works so hard and sticks together all the time."

The sons who sang with Dewberry Thursday are Eddie, 23 years old; Marcellus, 25 years old; Frank, 27 years old; and Warren, 28 years old.

All work on the farm with their father except for seasonal employment in a cottonseed oil plant at Guthrie.

Their encores used all the time that Wayne Campbell, Oklahoma City University drama professor, and his students, left vacant Thursday by failing to show up for their spot on the program.

"I don't know what happened to them," said Mrs. Ethel P. Moore, Tulsa, society secretary, "but we got along all right without them."
