This
Indenture made the eighteenth day of May in the year of our Lord
one
thousand seven hundred and ninety five, between William Nixon of
the
Township of Hopewell in the county of Bedford and the state of
Pennsylvania
Farmer and Mary his wife of the one part and Henry Stover
of
Cumberland Valley Township in the County of State aforesaid-Farmer
of the
other part Witnesseth, Where as Thomas
Crossan and David
Steward
two of the Commisioners for the County of Bedford by their
deed-___
duly executed bearing date the twenty third day of June in
the
year of our Lord one thousand seven hundred and eighty seven for
the
Consideration therein mentioned did grant, sell, release alien
confirm
and deliver unto Hugh Barclay of the town and County of Bedford
and
State aforesaid Esquire, and to his heirs and asigns a certain tract
of land
situate on the waters of Yellow Creek in the Township of ___
Providence,
now Hopewell in the County of Bedford ____ other lands of
the
said William Nixon and Lands in the name of George Elder and the
Cove
mountain containing one hundred acres of land and the usual
allowance
of ____ cent on our ___, together with the
hereditaments
and
appurtiences of the same belonging ___ appurtiences to _____
the all
Hugh Barclay and to his heirs and assigns forever as in and of
the
said rated deed, as recorded in the office for recording of
deeds
in and for the County aforesaid in Book B, page 429 __ reference
being
thereunto and will more fully and at large appear (son?) And
whereas
the said Hugh Barclay by his Indenture duly executed bearing
date
the second day of Jan in the year of our Lord one thousand seven
hundred
and eighty eight, for the consideration therein mentioned did sell
release
alighn and confirm unto George Woods of the Town Cou____,
State
aforesaid Esquire and to his heirs and assigns forever the one
equal
half part of the first above described Tract of Land sold as
aforesaid
by the said Commisioners of the County of Bedford to the said
Hugh
Barclay Beginning at a white oak thence by other lands of
William
Nixon north forty three and an half degrees east fifty six
perches
to a Spanish Oak thence east seventeen perches to a white oak,
thence
by George Elders land north twenty of an half degrees east, one
hundred
and seventy nine perches to post thence
north eighty four and
a half
degrees west, one hundred and sixty seven perches to a post,
thence
south twenty and a half degrees west two hundred and five degrees
to a
post, thence by William Nixon’s land south seventy two degrees east
one
hundred and twenty four perches to the place of Beginning containing
two
hundred acres with the usual allowance of
___percent for roads, ___
Together
with all and singular hereditaments and appurteniances to the
same
belonging to hold the same with the appurtanances to the
same
belonging to hold the same with the appurtenances unto the said
George
Woods his heirs and assigns forever in and by the said ___
Indenture
as recorded in the Office for recording of Deeds in and for
the
county of Bedford in Book C, page 162, ___ reference being thereunto
held
with more fully and at large appear ___ And whereas the said
George
Woods by his Indenture duly executed bearing date the seventeenth
day of
January seventeen hundred and eighty nine for the consideration
therein
mentioned did grant sell alein and confirm unto a certain
Rebecca
Nixon and to the said William Nixon and to their heirs and assigns
all
that the last above described and bounded piece of parcel of ground
situate
on the Waters of Yellow Creek in the Township and county
aforesaid
so as aforesaid sold and conveyed by the said Hugh Barclay
unto
the said George Woods, containing two hundred acres and the usual
allowance
as aforesaid together with all and singular the hereditaments
and
appurtenances to the same belonging to hold the said tract of land
with
the appurtenances unto the said Rebecca Nixon and Wiliam Nixon
their
heirs and assigns forever as in and by the said cited indenture as
recorded
in the office for recording of deeds in and for the couty of
Bedford
in Book C, page 288 ___ reference geing therunto __ will more
fully
and at large appear ___ And Whereas George
__/ husband to the said
Rebecca
of the said township of Hopewell in the County aforesaid Farmer
and
Rebecca his wife by their deed ___ fully executed bearing date the
sixteenth
day of May in the year of our Lord one
thousand seven
hundred
and ninety five, on the consideration therein mentioned did grant
bargain
sell ____ release and confirm unto the said William nixon and to
his
heirs, assigns one equal half part of that the last above described,
and ____ piece or parcel of land, situate on the
waters of Yellow Creek
aforesaid
on the townships and county aforesaid beginning at a
white
oak thence north forty three and a half degrees east firty __
perches
to a Spanish Oak, thence east seventeen perches to a white oak,
thence
north twenty and a half degrees east forty eight perches to a
post
thence by other land of George Nixon north eighty four and a half
degres
west one hundred and twenty eight perches to a black oak,
thence
North twenty and an half degrees east one hundred and twelve
perches
to a post, thence North twenty and an half degrees west one
hundred
and eighty six perches to a post on the line of Land of Hugh
Barclay,
thence south seventy five degrees east one hundred and twenty
four
perches to the place of Beginning, containing one hundred acres
of Land
and the usual allowance of __ percent
for roads ___ Together
with
all and singular the improvements and hereditaents to the said
one hundred
acres of land belonging or in any wise appertaining to hold
the
same with the appurtenuences to the said Wiliam Nixon and to his heirs
and
assigns forever as in and by the said cited deed ___reference being
thereunto
and with more fully and at large appear
___ and whereas
the
Supreme Executive Council by their patent duly executed bearing date
the
thirteenth day of March seventeen
hundred and ninety for the
consideration therein mentioned did grant unto Hugh
Barclay of the Town
and county
of Bedford Eszuire and to his heirs and assigns a certain
Tract
of Land called ‘Conquest’ situte on the waters of Yellw Creek in
Providence,
now Hopewell Township in the county of Bedford adjoining
land of
John Piper the Warrior ridge, and lands of George Nixon
containing
one hundred acres of land and the allowace of __ percent
for
roads ___ with the appurtenances which said tract is part of a Tract
which
was surveyed in pursuance of a warrant to George Elder dated 8th
September
of 1762 who neglected to pay the taxes assessed on the same the
Commissioners
of the same county sold the above described tract at public
sale,
and by deed dated the 23rd of June 1787 conveyed the same to the
said
Hugh Barclay, he being the highest bidder for the same to hold the
same
with the appurtances unto the said Hugh Barclay his heirs and
assigns
forever as in and by the said cited patent and Commisioners
deed
reference being therunto respectively
___ will, more fully and
at
large appear. And whereas the Said Hugh Barclay and (Kathy?) his
wife,
by their Indenture duly executed bearing date the eighth day of
November,
sventeen hundred and ninety four for the consideration therein
mentioned
did grant bargain and sell unto the said William Nixon
and to
his heirs and assigns a certain part or parcel
or parcel of
that
last above described Tract of Land to be cut off on the side
adjoining
other lands of the said Wiliam Niscon Beginning at a white oak,
thence
by the Lands of the said William Nixcon south seventy
five
degreeswest twenty four perches to a post, thence north twenty
and one
half degrees east seventy six perches to a post, thence by
George
Elders land North seventy five degrees west twenty four perches
to a
post thence by lands of Rebecca and William Nixcon south twenty
and an
half degrees west sixty thre perches to the place of Beginning
containing
eight acres and the allowance Together with the improvements
hereditaments
and appertenunces to the same belonging to hold the
same
eight acres with the appurtenances unto the said William Nixon
and to
his heirs and assigns forever as in and by the said recited
indenture
reference being thereunto had will more fully and at
large
appear for this Indenture witnesseth that the said William Nixcon
and
Mary his wife for and in consideration of the sum of one hundred and
twenty
eight pounds lawful money of Pennsylvania to their ___ paid by
the
said Henry Stover at and before the sealing and delivery of the
receipt
whereof they do hereby acknowledge have granted bargained sold
released
aliened and confirmed and by these presents do grant bargain
sell
alien release and confirm unto the said Henry Stover and to his
heirs
and assign all that the first above described and bounded piece
or
tract of ground situate in the Township and County aforesaid on the
Waters
of Yellow Creek as aforesaid sold and conveyed by the said George
Nixcon
and Rebecca his wife to the said William Nixon and his heirs and
assigns
containing one hundred and the usual allowance as aforesaid and
also
all that the last above described and bounded piece of parcel of
ground
situate in Township and County aforesaid on the waters of
Yellow
Creek, so as aforesaid sold and conveyed by the said Hugh Barclay
and
Kelly his wife to the said William Nixcon and to his heirs and
assigns
containing eight acres and the usual allowance as aforesaid.
Together
with all and singular the inprovements Hereditements and
Appurtances
whatsoever to the said two last described pieces or parcels
of land
respectively belonging or in any wise appertaining to have and
to hold
the said two last above described pieces or parcels of land so as
aforesaid
situated in the Township and County aforesaid on the Waters of
Yellw
Creek aforesaid respectively with the appertences to the same
respectively
belonging unto the said Henry Stover and to his heirs
and
assigns to the only proper use and ___
of the said Henry Stover
his
heirs and assigns forever. Under and Subject to the payment of all
taxes
charges and assessments herafter to become due and payable on
the
same. And the said William Niscon and Mary his wife do hereby
covenant
and agree to and with the said Henry Stover and his heirs
and
assigns that they the above described premises pieces or parcels of
land
respectively with the appertunances to the same respectively
belonging
against themselves their heirs and assigns and against
all
persons lawfully claiming or to claim by from or under them or
any of
them and against all other persons whatsoever will by these
presents
forever warrant and defend.
In
witness whereof the said William Nixcon and Mary his wife have ___

their hands and affixed their seals the day and year first above

and acknowledged the said Indenture to be their act and deed the

Mary being of full aye and privately and apart from her said
husband
by me examined, declared that she acknowledged the same
voluntary
and freely without any comprehension of coercion other
said
husband Witness my hand of seal the same day, the Year
