In the name of God, Amen. I, Joseph Howey, Sen'r of Hardin County and state of Kentucky, being weak and infirm, but of perfect mind and memory, thanks be to Almighty God and calling to mind the uncertainty of life, knowing that it is appointed unto all men once to die, do make this my last Will and Testiment in the following manner viz. I commend my soul to Almighty God, who gave it and my body to the Earth to be buried in a decent and Christian like manner at the discretion of my Executors, hereafter to be named and as to such worldly estate as it hath pleased God to bless me with I will devise and bequeath in the following manner, viz. Just debts are to be fully and legally paid..
I bequeth to my loving wife, Lydia Howey, all my movebel Estate during her life and after her deth it is to bee, if any remains, divided equally among my children to wit; Robert, Elizabeth, Joseph, Margret, Lydia, Moses, Aron & James, and I do hereby constitute and appoint my wife and my son, James Howey executors of this my last will and testement and I do hereby ...them to execute the same and every part thereof according to the true intent mening of the same and I do hereby revoke and make null and void all by me here to fore made ratifing and confirming this and no other as my last will and testiment in witness where of I have set my hand and afixed my seal this 5 day of january, 1821.

Issued 9 September 1766. John filed the inventory and accounting for the estate Dec 1762 - about 3 years after Jacob's death (the estate went to probate 7 Dec 1759. 3 years is a pretty long time especially since the estate wasn't that large or complex.) This case was filed nearly six years after Jacob's death. It must have been the case that John Howey had filed (and signed) the final accounting but never actually delivered the share of Jacob's estate to Joseph and Eleanor's children. Perhaps there was some bad blood since Eleanor had remarried. Perhaps John was unreliable or a even a scoundrel.5 |

In the name of God Amen this ____teenth Day of February An. Dom. 1748/9. I Joseph Hovey of the Township of Abington & County of Philadelphia being sick and weak in Body but of sound Mind & memory and ____________ do make and ordain this my Last Will and Testament. First of all I _____ and recommend my Soul into the hands of Almighty God that gave it humbly beseeching & hopeing for the most Gracious acceptance of it through the mediation of the Lord Jesus Christ my only Saviour & my body I commend to the Earth to be decently Buried at the Discretion of my Executors hereafter to be named. And as for my Worldly Goods which it hath pleased God to bestow upon me in this life, I give and dispose of them in the following manner viz.
Imp. (Latin for First, I believe - RTH) my will is that all my just Debts & funeral Charges be duly paid.
Then, I give and bequeath unto Eleanor, my beloved wife one Feather Bed, with its Furniture, one cow which she shall choose and all the (flax?). Item, I give and bequeath unto my Daughter, Rachel all her mothers Cloathes and Forty Shillings in Money to bear Interest from the Date hereof till she arrive (?) of age to receive it It being a Legacy of my Father intrusted with me for her. Item my will is that my Land within the Forks of the Delaware be sold by my Executor as soon as may be and to best advantage for the use of my beloved wife and Children and I do hereby give my Executors presently to be named full power and authority to sell and dispose of said Land and make and Execute such Deed or instrument of conveyance as shall be needfull & requisite for that purpose. Item I give and bequeath the money _____ from the Sale of my Land aforesaid Together all my Estate in Good (line missing here?)Chattels not before bequeathed unto Eleanor my beloved wife and unto my beloved children Rachel, Maryan (now I see why this was transcribed as Morgan---RTH) , Samuel, Agnes & Margaret to be equally divided Between them save to my said wife two Shares which I hereby Bequeath, unto her with the use, Interest and profit arising or accruing from the whole to assist her in the Education of sd. Children till they are Capable of being put out to Service after which my Will is that the Interest & profit belonging to said share be applied for the benefit of sd. Children respectfully.
Lastly, I do hereby Constitute & appoint Eleanor my beloved wife and my beloved Brother John Hovey to be my Executors of this my Last Will and Testament. The within instrument of writing purporting to be the last Will and testament of Joseph HOWEY and was produced in court and proven by the oaths of John McMahan and Thomas Peters, two subscribing witnesses thereto and ordered to record. Whereupon I have truly recorded the same in my office.
