Last Will and Testament of Frederick Holtz
I Frederick Holtz of the Town of Irondequoit, in the County of Monroe and State of New York, being of sound mind and memory, do make, publish and declare this my last Will and Testament, in manner following, that is to say;
First -- I direct that all my just debts and funeral expenses be paid.
Second -- All the rent, residue and remainder of my estate, both real and personal, I give, devise and bequeath for and during the term of her natural life to my beloved wife, Mary Holtz; and at her death for and during the term of her natural life to my daughter Fredericka Holtz; and at her death, I devise the same in fee to my adopted son Frank Kleinfield Holtz. In case my said adopted son dies before my daughter, Fredericka Holtz, then and in that event I give, devise and bequeath all my said property to my said daughter, Fredericka Holtz, in fee.
Lastly, I hereby appoint Herbert Leary of Irondequoit, N.Y. executor of this, my last Will and Testament; hereby revoking all former wills by me made.

We, whose names are hereto subscribed, Do Certify, that on the 22 day of November 1904, Frederick Holtz of Irondequoit, N.Y. the testator, subscribed his name to this instrument in our presence and in the presence of each of us, and at the same time, in our presence and hearing, declared the same to be his last Will and Testament, and requested us, and each of us, to sign our names thereto as witnesses.

Whereas, Herbert Leary the executor named in a certain instrument in writing, bearing date November 22, 1904, late of the Town of Irondequoit in said County of Monroe and State of New York, deceased, and relating to both real and personal estate, has lately made application to the Surrogate's Court of the County of Monroe, to have said instrument proved and recorded as a Will of personal and real estate, you, and each of you are cited and required to appear before the Surrogate of the County of Monroe, at his office in the City of Rochester, in said County of Monroe, New York, on the 30th. day of October 1923, at 10 o'clock in the forenoon of that day, then and there to attend the probate of said last Will an Testament. And if any of the aforesaid persons are under the age of twenty-one years, or insane or otherwise incompetent, they will please take notice that they are required to appear by their general guardian, if they have one, and if they have none, that they appear and apply for the appointment of a special guardian, or in the event of their neglect or failure to do so, a special guardian will be appointed by the Surrogate to represent and act for them in the proceedings for the probate of said Will.
