This Indenture made this twenty eighth day of March A.D. one thousand eight Hundred and sixty five by and between Michael Hawk of the County of Wayne in the state of Ohio of the first part and Amos Walter of the County of Wayne and State of Ohio of the second part. Witnesseth that the said Michael Hawk for and in consideration of the sum of ten thousand five hundred dollars to him in hand paid the receipt whereof he do hereby acknowledge has given granted bargained sold released and conveyed and do by these presents give grant bargain sell release convey and confirm unto the said Amos Walter and his heirs and assigns forever all that tract or parcel of land situate and being in the county of Wayne and State of Ohio to wit. the north east quarter of section four, township sixteen of range twelve with the following exception from the southeast corner of said quarter north four chains and fifty links to a stone, the beginning of a road for the use of the herein described grave yard, thence south eighty nine and one fourth degree west five chains and eighty nine links to the grave yard. thence south four degrees west one chain and seventeen links to a stone thence four degrees west one chain and seventeen links to a stone thence (S 88½ W) south eighty eight and a half degree west one chain and forty links to a stone thence north five degrees east one chain thence north eighty five degrees east one chain and forty links to a stone the place of beginning containing fifteen hundredth of an acre. also twenty feet wide for a road to this grave yard on the south side of the line above described going to the grave yard also excepting the water privilege of spring water about ten rods south of the north line and the right to lay down tile or repair the conductors for the water to the north line at any time it does not destroy or do any damage to any crop in the ground. said Trustees to the grave yard are to put up a gate at the entrance of the road to the grave yard & keep it in repair unless used by the grantee or his assigns. to have and to hold the said premises hereby sold or meant or intended so to be with all the privileges and appurtenances thereunto belonging or in any wise appertaining unto the said Amos Walter and unto his heirs and assigns forever and the said Michael Hawk does for himself and for his heirs executors and administrators covenant promise and agree to and with the said Amos Walter his heirs and assigns that he the said Michael Hawk is legally seized of the premises aforesaid and that the premises are free and clear of and from all incumbrances whatever. and further that he the said Michael Hawk will well and truly warrant and forever defend the premises herein and hereby granted unto the said Amos Walter and to his heirs and assigns against the lawful claims and demands of all and every person whomsoever. In testimony whereof the said Michael Hawk party of the first part has hereunto set his hand and seal the day and year first above written.

[The mentioned grave yard must be the Boydston-Bodine Cemetery. In 1972 the cemetery was in bad shape. Just recently I tried to find it. If what I found was the cemetery, there weren't any stones. There were two large base-like stones, but no actual grave stones. I will have to investigate more.......Susie]

This is the house on the above property. I was told by
the current owner that it is 138 years old. So it must
have been built by the Hawk family in about 1862.
