This deed may be too early to be the Lewis SMITH who married Sarah HOLDERFIELD. They were married in 1850 and he was listed on the census that year as being 22/23 years old. If he was born ca 1827 then he was only 13 in 1840...a bit too young to be buying land. Could this Lewis be an uncle of my Lewis, or more likely, his brother? Is this the Freeman Smith who later needed help form Lewis in another deed where John Venable was a neighbor.? In the Mormon Church IGI there is a Lewis SMITH listed as being born in Rockford, Surry, North Carolina in about 1795. His parents were David SMITH and Charity WHITFIELD. Perhaps he is the Lewis who bought this land.

This Indenture made the twenty eighth day of September in the year of Our Lord, One Thousand eight hundred and ??thirty nine?? between Matthew M Heughes of the County of Surry in the state of North Carolina of the one part and Lewis Smith of the County of Surry and State of N Carolina of the other part. Witnesseth that the said Matthew M Heughes for and in consideration of the sum of ten dollars to him in hand paid by the said Lewis Smith the receipt whereof the Said Matthew M Heughes doth hereby acknowledge hath given granted bargained and sold, aliened and confirmed and by these presents doth give grant bargain and sell alien and confirm unto the said Lewis Smith his heirs and assigns forever all that tract piece or parcel of Land Situate lying and being in the County of Surry on the waters of Fishers River adjoining John Venable it being the place ?whereon? Edward Smith now lives. Beginning on a white oak in said Venables line & ?? East on his line twenty five chains to a ?? oak then South twenty Chains to a post oak then West twenty five chains to a stake and ?? in McCraw's line. Thence North along said line to The Beginning. Containing forty nine & one half acre more or less and also all the woods ways waters and water courses and all and ?? the appertenances thereunto belonging or in anywise appertaining and the ?????????

and profits of the aforesaid lands and premises and every part thereof and all the Estate right title interest claims property and demand whatever of the said Matthew M Hughes of in and to the land and premises hereby granted to have and to hold, the aforesaid land, and promises with the appurtenances unto the Said Lewis Smith his heirs and assigns to the proper use and behoof of the Said Lewis Smith his heirs and assigns forever and the said Matthew M Hughes for himself and his heirs the aforesaid land and premises and every part thereof against him and his heirs and against the claim or claims of all and every person or persons claiming from me or them to the said Lewis Smith his heirs and assigns shall and will forever Warrant and defend by these presents. In testimony whereof the said Matthew M Heughes hath hereunto set his hand and affixed his seal the day and year first above written.
