Widow's Claim for Pension Pension # 40338
The State of Ohio, County of Washington
On this 9th day of August, A.D. 1863 personally
appeared before the Probate Court,
a Court of Record within and for said county, Elizabeth Taylor aged
56 years, a
resident of Wesley Twp, in the county of Washington,
and State of Ohio, who, being
first duly sworn according to law, doth, on her oath, make the following
declaration, in
order to obtain the benefit of the provision made by the act of Congress
approved
July 14, 1862. That she is the widow of David Taylor who was
a private in
Company_____, commanded by Captain Lucas, in the 73rd Regiment of Ohio
Vol
Infantry, commanded by Col Orland Smith, in the war of 1861.
That her said husband
died at Decatur Twp Washington Co, in the State of Ohio,
on the 12 day of April A.D.
1863 after his discharge from the United States Service of
disease contracted as a
soldier while in the line of duty in the service of the United
States.
She further declares that she was married
to the said David Taylor, at Westmoreland
Co. Pa, on the 7 day of February A.D., 1829, by one Esq
Andrew Byerly, a Magistrate;
that her name before her marriage was Elizabeth Wilson, and that ever
since the death of
her said husband, she has remained a widow:
That during the existence of the aforesaid marriage there were born
to her and her said
husband the following named children, who are now under the age
of sixteen years,
viz:
Wilson P., born the 18 day of May 1850; Winfield Scott born
the 29 day of May
1853 Corrected date! Post office address Bartlett Wesley Twp Washington Co Ohio all
of whom are still living,
and reside in Wesley Twp. Washington Co O.
She also declares that she has in no manner been
engaged in, or aided or abetted, the
Rebellion in the United States.

Also
personally appeared Margaret A Scott of Parkersburgh Va and J
J Parker,
resident of Marietta in the County of Washington and State of Ohio,
persons whom I
certify to be respectable and entitled to credit, and who, being by
me duly sworn, say that
they were present and saw Elizabeth Taylor make her mark to the foregoing
declaration.
They further swear that they were acquainted with the said David Taylor,
deceased, in his
life-time, and know that he and the said Elizabeth Taylor, lived and
cohabited together as
man and wife, up to the time when he entered the service and that they
were generally
recognized as such by their acquaintances and neighbors, and
their marriage was never
questioned. That during the continuance of said marriage there
were born to them the
following named children, all of whom are now under the age of sixteen
years, viz:
Wilson P. and Winfield Scott.
That since the death of her said
husband, the said Elizabeth Taylor has not
married, but is still a widow; and that she is the identical
person she represents herself
to be. All the foregoing statements they make from their own personal
knowledge; and
they have no interest in the prosecution of this claim.

All to whom it may concern, I, J.W. Pickett having visited David
Taylor deceased in his
last illness and carefully examined his case would certify that the
said David Taylor died of
Bronchial affection[sic] complicated with pneumonia and
general debility and I am
satisfied the said diseases were contracted while in the service of
the United States acting
in the capacity of Soldier and I being called as physician in his case
do certify to the above
as true as I verily believe

The State of Ohio Washington County
Personally came William S. Heald before me, David Hildebrand, a justice
of the Peace in
and for the county and state aforesaid February 9th 1865 and was duly
affirmed according
to law to the following declarations as _?_ That he the said William
S. heald was a
volunteer in company F in the 73rd regiment Ohio volunteers and that
David Taylor was a
member in the same company and regiment and at the time he entered
the service he
was a healthy and sound man and remained so until the march
to Romney
[sic--is Rommey] and Moorfield [sic--is Moorefield] Va, came back
to camp very
unwell in March 1863[difficult to read the last digit] fell
into my hands who was
Regimental nurse at Clarksburg, Va and I verily believe that the service
performed by
said David Taylor caused his sickness and death.

Before me, Samuel Smith a Justice of the Peace in & for said county
and state aforesaid
personally came Alex A. Campbell March 17th 1865 & being duly affirmed
according
to law deposeth & saith to wit, That he the said Alex A Campbell
was a volunteeer in
Company F in the 73rd Reg of the Ohio Volunteers infantry.
& that David Taylor was
a member of the same company & regiment. & at the
time he entered the service he
was a healthy & sound man from all appearance & remained so
until we marched to
Romney & Morefield, Va, on which from exposure was he taking sick
& sent to the
Hospitoal at Clarksburg, Va, from which place he never returned to
his regiment but
was still reported sick until his death I think some time in the spring
of 1863. & further
this deponant saith not.

record made of the
marriage as she verily believes.

Personally appeared before a Justice of the Peace in and for the County
and State
aforesaid Jacob Wilson and Finley Wilson of the same
County and State who being
duly sworn state that they are brothers of Mrs. Elizabeth Taylor.
Her maiden name
was Elizabeth Wilson. That their home was formerly in Sewickly
Township
Westmoreland Co Pennsylvania. That they were present at the
date of her marriage
to David Taylor. That the marriage took place in Sewickly Tp
Westmoreland Co
Pennsylvania on the 7th day of February 1829 -
And they further state that she is the
identical person who applied for a pension as the widow of David Taylor
late of Co F 73rd
Ohio Vol Infantry. They further state that marriage ceremony
was performed by Andrew
Byarly as Magistrate. Jacob Wilson is uncertain as to the name
of the magistrate.
_?_ further state we have no interest in the claim of Mrs Elizabeth
Taylor for Pensions.

Twp, in the county
of Washington, and State of Ohio, do hereby constitute and appoint
AW McCormick
of Marietta, O, my true and lawful Agent and Attorney, for me
and in my name to
prosecute the claim presented by me for a pension by reason of the
service of my late
husband; and I do hereby authorize my said Attorney to examine the
papers, documents
and records relating to my said claim, No 40338 which may be found
in any Department
or Office of the Government; to appoint one or more persons to assist
him in the business
aforesaid; to file additional evidence or arguments when necessary;
to receive the certificate
which may issue in my name upon said claim; and to do any and all lawful
acts necessary in
effecting the object of his said appointment. Hereby revoking
former Power of Attorney,
given to G M[?]. Woodbridge, to which
Mr.Woodbridge consents.

On this day of September 1866 before the undersigned
authority within and for said County
and State personally appeared Dr. J. W. Pickett,
who being duly sworn states on oath that
he attended David Taylor, late Private Co F 73rd
Regiment, Ohio Infantry Volunteers, after
his Discharge from the army in the Spring of
1863, and up to the date of his death, which
occurred April 11th 1863. That said David
Taylor, came from the Army suffering from
Pneumonia and Bronchitis, from which diseases
he died. I further certify that I was the
attending Physician of David Taylor's family
previous to his entering the service,
and know that he was not then afflicted with
said diseases. That I certify from personal knowledge and I have
no interest in the widows claim for Pension or Bounty.

I certify on honor, that on the 5th day of February
A.D. 1862, I was Captain of
Company F, of the 73rd Rigiment of Ohio Infantry.
That on said day, while David Taylor
was a Private in said company, in the service
of the United States, and in the line of duty,
at or near a place called New Creek, in the state
of Virginia, he, the said David Taylor
was disabled as follows:
He contraced diseases ["of
the Lungs and Throat called Pneumonia and Bronchitis"
were crossed out probably because he was not
a doctor] from fatigue and exposure on
the march from Clarksburg, to Romney and Moorefield
about the 8 day of February 1862
for which diseases I believe he was discharged
February 11th 1863 and died as I learned
April 11th 1863, and I believe of the above named
diseases contracted in the service.
I Certify, from personal knowledge
as to the time ["disease" crossed out] and place and
manner contracted on the march from Romney to
New Creek that he became unfit for duty
and [I] have no interest whatever in the widow's
claim for Pension or Bounty.

I have the honor to acknowledge the receipt from your Office of application
for pension
No. 40,338, and to return it herewith, with such information as is
furnished by the files of
this Office.
It appears from the Rolls on file in this Office,
that David Taylor was enrolled on the
1st day of Nov., 1861, at Cutler, Ohio in Co. F, 73rd Regiment of Ohio
Volunteers, to
serve 3 years, or during the war, and mustered into service as a Private
on the 1st day of
November 1861, at Cutler Ohio, in Co. F, 73rd Regiment of Ohio, Volunteers,
to serve
3 years, or during the war. From Records on file, he is reported
Discharged for old age
& Genl. Debility at Genl. Hospl. Parkersburg, Va. Feb. 11th
[18]63. No evidence
of death on file.
