Notes

John (1742-1828), son of Samuel and Elizabeth Burks, was born in Rockbridge Co., VA and m. Elizabeth Cabell (1753-1828). He held patents for several hundred acres of land in Rockbridge Co., purchased more there in Botetourt County. A newspaper clipping has: "He was a man of steady habits, successful in farming and business, and accumulated much by good management". He owned a grist mill, saw mill, and a distillery. He and Elizabeth had seven children: John P., Nathaniel D., David J., Samuel C., Arthur L., Elizabeth, and Charles L.

John was very wealthy. He owned all the land that was known in later years as "Arnolds Valley", not far from Natural Bridge, Virginia. The Burks families of Arnolds Valley said it was named for a Mr. Arnold who was the first to come there. Later on a Mr. Crawford came, looked with favor on Mr. Arnold's wife, traded 10 gallons of whiskey for her, and took off.

John, his wife and other family members are buried on his plantation in Arnolds Valley, in the direction of what was known as Greenlee. May 30, 1961 John's great-granddaughter, Mary Francis Burks ("Duckie") and her cousin, Broaddus V. Burks and his wife, Pauline (who compiled Roots, Shoots and Runners), went to that Burks burial ground. They found the large vault set in the slope of the hill and the enscribed tombstones:

"Sacred to the Memory of John Burks who was born May 11, 1742, departed this life June 10, 1828; also his spouse Elizabeth Burks who was born August 19, 1753 and departed this life June 2, 1828"

"Sacred to the Memory of Charles L. Burks Born June 11, 1796 and departed this life August 10, 1815"

There was evidence of other tombstones that had crumbled with age; could see no names.

John's very lengthy will, recorded in Rockbridge Co., VA Will Book 6, p. 313:

IN THE NAME OF GOD, AMEN. I John Burks of Arnolds Valley, in the County of Rockbridge...considering the uncertainty of this mental life, and being of sound and perfect mind and memory, blessed be Almighty God for the same, do make and publish this my lst will and Testatment.

First, I give...unto my dearly beloved wife Elizabeth Burks during her natural life, the plantation whereon I now live, containing by patent, three hundred acres, be the same more or less...also five of the choicest slaves, the whole of my household and kitchen furniture, two of my best horses, and as many head of cattle as she may desire out of my stock.

Secondly, I give...unto my son Samuel C. Burks, the tract of land conveyed to me by Arnold, on which he now lives, and also the entry adjoining to said tract, containing by patent twenty eight acres...

Thirdly, I give...to my son Arthur L. Burks, my tract of land in Botetourt County, which I purchased of Charles Beal...one thousand acres...

Fourthly, I give...to my son in law Robert Irvine and his wife Elizabeth M. Irvine, my tract of land in Botetourt County which I purchased of Moses Allen, containing by deed two hundred and sixty nine acres...

Fifthly, I give...to my son Charles L. Burks...the tract of land which I purchased of George Good containing by deed seventy three acres...including my grist mill, saw mill and distillery, the machinery belonging to the said mills, and also the stills and still vessels. I likewise give...the entry that lies betwixt my home place and that of the Heirs of Jno. Tolley, dec'd containing by patent thirteen acres...also the plantation whereon I now live, after his Mother's Decease...

Sixthly, Whereas...land herein bequeathed to my three younger sons and son in law and daughter are more valuable than those...given by me to my three elder sons, I do...with a view of making the latter equal with the former...will and desire that my son Arthur L. Burks...devised the most valuable Tract...shall out of said devise pay One Thousand Dollars to my son John P. Burks, and also One Thousand Dollars to the heirs of my deceased son Nathaniel D. Burks, and that my sons Samuel C. Burks and Charles I. Burks...each pay Two Hundred and Fifty Dollars to my son David J. Burks, and that my son in law Robert Irvine...pay Five Hundred Dollars to my said son David J. Burks.

Seventhly, After my just debts and funeral expenses are paid...desire that the whole of my slaves and personal property...not herein already disposed of, be equally divided amongst the whole of my children...slaves and personal property wherein my wife has a life interest, be divided as aforesaid after her decease.

Lastly I...appoint my sons, Samuel C. Burks and Charles L. Burks, Executors of this my last Will...In witness whereof I...set my hand and seal this twenty first day of January in the year of our Lord One Thousand Eight Hundred and Twenty Four. John Burks (Seal) Signed, sealed...in the presence of us, who at his request...subscribed our names as Witness to the same. James Greenlee, Hugh Irvine, Jr., John Dugless, Samuel Tollu (By mark)

I, John Burks...publish this codicil to my lst will...my Three Younger sons, and son in law Robert Irvine are each to be allowed two years after my decease, by paying interest therefrom, before my two elder sons and heirs of...Nathaniel D. Burks can call on them for the payments...Negro woman Fanny and her children Jude and Maria, which I gave to my Daughter Elizabeth M. Irvine...continue vested in her husband, not to be considered any part of my property...Negro George...to son John P. Burks, Negro man Sharp to deceased son Nathaniel D. Burks, Negro man Dick to my son David J. Burks, Negro John to my son Samuel C. Burks, Negro man Davy to my son Arthur L. Burks, Negro man Jacob to son Charles L. Burks, continue theirs...set my hand and seal this Twenty first day of January in the year of our Lord One Thousand Eight Hundred and twenty four. John Burks (Seal) The same witnesses signed.

I, John Burks...this second Codicil to my land will...hereby revoke my devised of land to Robert Irvine and Elizabeth M. his wife...Two hundred and sixty nine acres...in lieu of said tract I give...said Robert Irvine and Elizabeth M., his wife, Two Thousand Dollars in Cash...said Tract, if not disposed of before my decease, shall be sold by my Executors, who are hereby directed to sell my House and Lot in the Town of Buckhannon and divide the amount...equally amoungst my sons and the Children of my deceased son who are to have one sixth of the amount aforesaid equally divided amongst them...set my hand and seal this fourth day of August...One Thousand Eight Hundred and twenty seven. John Burks (Seal) Witnessas were the same, Minus John Dugless.

Rockbridge County Court, November 5th, 1928

This writing purporting to be the last will and testatment of John Burks deceased, with two codicils thereto annexed, were produced in Colurt...on the motion of Samuel C. Burks and Charles L. Burks, the Executors...Bond in the sum of fifty thousand Dollars...granded them for obtaining probate...

Believe Susannah was married second to John Harrison. A handwritten document transcribing the Harrison Cemetery also has Susanah death date of Apr 17, 1837.
