Jackson County Will Vol. 2- 238 & 239 OLIVER T. MILAM 1831 - 1887
Jackson County WVA July 3, 1887. Known all were by these presence, that I Oliver T. Milam being of sound mind and in view of the uncertainty of life, and the certainty of death, make this my last will and testament, and dispose of my property both real and personal as follows to wit:
1st:
I give and bequeath unto my son John W. Milam 75 acres of land from tract known as the Lem Green survey, said 75 acres to be take from south side of said survey the orchard on said survey to be included in the said 75 acres hereby bequeathed. I wish him to pay James L. McClain the balance due on said survey amounting to about $300.00 more
2nd:
I give and bequeath unto my daughter Martha E. Milam 25 acres of land more or less, said land to be the balance of the Lem Green survey.I further give unto her 5 head of sheep her choice from my flock, also all the household and kitchen furniture that is not here in after disposed of.
3rd:
I give and bequeath unto my son Robert T. Milam 50 acres of land, a part of the tract on which I now reside, to be taken from the east-end of said tract, to include furniture, the house where I now reside and the orchard. I wish him to pay to James Miller the balance of the trust deed on the home tract of land amounting to about $200.00. I further give unto him one bay mare about 10 years old now on the farm, also one young cow that I have formerly given him, also one bed and bedding.
4th:
I give and bequeath unto my Daughter Leathy Harriet the wife of John Dorsey one muley cow.
5th
I give and bequeath unto my son William H. Milam 50 acres of land more or less, the balance of the home tract, also one 2 year old gray colt, one bed and bedding, also one rifle gun. I wish that my other? two take the residue of my personal property not hereto for disposed of, my interest in the present ? (1/3rd) also the residue of my personal property not mentioned of or disposed of (except the household and kitchen furniture and five head of Hogs that I wish the family here at home to fatten for their own use and then be sold. The proceeds to be applied on my personal debts and what is left to be paid to my son Robert T. Milam.
I appoint George W. Boggess of Jackson County West Virginia and S. T. Beckwith of Kanawha County West Virginia my Executors of this my last will & testament.

A writing purporting to be the last will and testament of Oliver T. Milam descendant, late of Jackson County West Virginia was this day produced before the undersigned Clerk of said Court (in his office in vacation) by Geo. W. Boggess one of the executors named therein and the said will was found by the oaths of James K. Fisher and George W. Boggess subscribing witnesses thereto and is ordered to be recorded as and for the last will and testament of Oliver T. Milam deceased.
And on the motion of George W. Boggess executor named therein who made oath there unto and together with J. K. Fisher and I. N. Duff enter into and acknowledged his bond in the penalty of $500.00 conditioned as the law provides, and took the oath required by law.
Certificate is granted him for obtaining a probate for said will in due form, liberty being reserved to the other executor named in said will to join in the probate when he shall think fit.
