Brunswick County, Virginia, Deed Book 25, Page 386, Harrison to Harrison. This indenture made and entered into this 6th day of August in the year of our lord, one thousand eight hundred and twenty-two between Benjamin Harrison of the county of Brunswick and State of Virginia of the one part and James S. Pearson and John Phipps of the second part witnesseth that the said Benjamin Harrison for an in consideration of the sum of one dollar to him in hand the receipt whereof is acknowledged at or before the ensealing and delivery of these presents and for divers other considerations moving thereto but more especially induced by a desire to provide for his wife and children hath bargained and sold and by these presents doth bargain and sell unto the said James S. Pearson and John Phipps all the right title and interest in and to all the property and possessions of every kind both real and personal which may descend and come to the said Benjamin Harrison from the estate of his father John Harrison (looks like Tobo.?), dec'd. And the said Benjamin Harrison for himself and his heirs doth hereby covenant and agree with the said James S. Pearson and John Phipps that he will forever warrant and defend unto them all the rights title and interest above mentioned and conveyed and to their heirs against the claims and demand of him, the said Benjamin Harrison and his heirs and all other persons whatsoever but the said Benjamin Harrison hath made this conveyance to the said James S. Pearson and John Phipps upon trust that they will permit his wife Polly Harrison to have the free and unrestrained use of all the property which may come to them in virtue of this instrument during her life and that she shall for the support comfort and advantage of herself and children be permitted to take and without restraint or impediment to use all the profits emoluments and conveniences which may in any wise result and accrue from the enjoyment and occupation of the said property and further that in case the said Benjamin Harrison should survive his wife Polly Harrison that the said James S. Pearson and John Phipps shall permit him from and after the death of the said wife during the remainder of his the said Benjamin Harrison's life to use and enjoy the said property and to take for his own comfort and support all the profits an emoluments arising and resulting from the said property. And further that at the death of the said Benjamin Harrison and his wife Polly or at the death of the survivor of them the said James S. Pearson and John Phipps shall convey to the lawful children of the said Benjamin Harrison an unconditional right to the property aforesaid without favor partiality or distinction between the said children. In testimony of the several premises herein set forth the said Benjamin Harrison, James S. Pearson and John Phipps have hereunto scribed their names and affixed their seals the day and year first above written. Signed sealed and delivered in presence of Jesse M. Taylor, Stephen A. Smith an Drury Pearson: Benjamin Harrison (seal), Jas. S. Pearson (seal), John Phipps (seal). Brunswick County Court September 23, 1822, this deed in trust was moved by the oath of Stephen A. Smith a witness thereto and having been proven before by the oath of Jesse M. Taylor and Drury Pearson also witnesses thereto, the same is ordered to be recorded. Exam. Teste R. Turnbull, Clerk
