In the name of God, Amen I John Fisher of Kanawha County, State of Virginia, being of sound and disposing mind and body, to make this to be my last Will and Testament as follows:
I direct that all my just debts by paid out of my estate, as soon after my decease as may be convenient. First I bequeath to my five daughters, to wit Rebecca Miller, Mary Ann Fisher, Rachel Hall, Lucinda Carney, and America Milam all my money, bonds and accounts, to be equally divided between them, except Two Hundred and Fifty dollars, which I give and bequeath to the three children of Leathy Fisher deceased, which said sum I desire my Executor herein after named, to collect immediately after my death, and place the same out at interest in the hands of good and responsible persons, and as the said three children respectively arrive at the age of twenty one years, his or their proportion, is to be collected and paid over to him or them.
And I do hereby nominate and appoint Joseph Miller Sr. to be my Executor, of this my last Will and Testament. And I do hereby revoke and make void all former and other Wills by me at any time or times heretofore made, and do hereby declare these presents to be contain my last Will and Testament.
In witness whereof I the said Testator John Fisher have to this my last will set my hand and seal this 22nd day of August 1861.

The foregoing will of John Fisher was signed, sealed published and declared by him in our presents, and in the presence of each other as and for his last Will and Testament and we believe that at that time that he the said John Fisher was of perfect sense and memory and fully capable of making his will.

Will of John Fisher
The within paper writing purporting to be the last Will and Test- ament of John Fisher Sr. deceased, this day presented to me in this office and thereupon came James L. Davis and Thomas Patterson, subscribing witness thereto.
Who after being duly sworn by me, declared that the said John Fisher, acknowledged the same as and for his last Will and Testament and that he made his mark thereto, in their presence and in the presence of each other, and that they and of them then and there signed their names as witness thereto in his presence and at his request.
That they believed at the time of doing so he was of sound mind and disposing memory: and thereupon came Joseph Miller the executor named in said Will, who made oath thereto, and took the oath pre-scribed in the act passed 16th Nov. 1863 prescribed for offices and together with Alexander Wallace Jr. and his security, entered into and acknowledged a bond in the penalty of $1,500.00 intended for his faithful execution of the said will as required by law.
Deaths from the WV Journal
Wednesday January 24, 1866
JOHN FISHER SR. of this county, was found drowned in Two Mile Creek below Charleston, at the edge of the ford above the Turnpike Bridge.
When thus discovered he lay on his back, his head scarcely submerged in the shallow water, and his feet upon the bank. This occurred on Friday last, about 4 o' clock in the evening. Some two hours earlier in the day, Mr. Fisher had been noticed to start on his way home, which was about 12 miles north of Charleston and appeared to be in fine spirits.
The body of the deceased was removed to the home of Mrs. Littlepage, and on Saturday morning an inquest resulted in the following:
Verdict of the coroner's jury-that the said John Fisher, Sr. in the opinion of this jury, came to his death by accidental drowning in Two Mile Creek, in this county, aforeside, on the 19th of January, 1866. Mr. Fisher was 74 years of age etc.
