    In the name of God Amen I John Hanks the elder of Cold Aston otherwise Aston Blank in the County of Gloucester Yeoman being mindful of mortality Do therefore make & publish this my Last Will and Testament in manor & form following (that is to say) I do give unto my Son b>Thomas One Hundred & forty pounds to be paid within one year after my decease Also I do give unto my Daughter Elizabeth Reynolds twenty pounds to be paid within one year after my decease  Also I do give unto these my four Daughters following (that is to say) Ruth Hannah Ann & artha eighty pounds a peice or to each of them eighty pounds If they shall live to attain to their respective ages of twenty one years Also All the rest & residue of my Goods Chattels andpersonal Estate I shall dye possessed of after all my Legal Debts Segacies& Funeral Expences are paid & discharged I do leave unto my now WifeSarah & to be at her disposal by will or otherwise so long as she continuesto be my widow, But in case she my said wife should marry again, then I do giveher only fifty pounds & such apart of the Household Goods as she shall think proper to take and then all the rest & residue of my Goods Chattels & personal Estate I do give to be equally divided amongst All my Children then living share & share alike Also I do hereby make & ordain my said wife Sarah whole & sole Executrise of this my Last Will & Testament hereby revoking all other and former will & wills by me at any time heretofore madeIn Witness whereof I the said John Hanks the elder have hereunto sett my hand & Seal this twenty fifth day of August in the year of our Lord One Thousand Seven Hundred and Seventy.

    This will was proved the 8th day of July in the year of our Lord 1773 before the worshipful James Benson Doctor of Laws Vicar General in Spirituals of the Right Reverend Father in God Willima by Divine permission Lord Bishop of the Diocese of Gloucester and of his Episcopal Consistory Official principal lawfully constituted by Sarah Hanks the Widow Relict and sole Executrise & to whon & having first Sworn well and faithfully to Administor to the said Will and also to exhibit an inventory and rendor an Account.

     Thomas Hanks 1786   GRO Reference: Thomas Hanks Cold Aston 1786 / 138  

    This is the last will and testament of me Thomas Hanks of Cold Aston alias Aston Blank in the county of Gloucester Husbandman,made this fourteenth day of March in the year of our Lord Christ one thousand seven hundred & eighty six, First I give and bequeath unto my loving wife Catharine Hanks the sum of one hundred pounds of lawful money of great Brittain to be paid to her by my Executors herein after named within twelve months next after my decease Also I give and bequeath unto my said wife all my household furniture linen plate & wearing apparel of what nature or kind soever But on this condition that my Trustees herein after named shall have the use of the said household furniture for my children till the youngest child shall have attained to the age of twelve years if they see fit to require it and also that if my said wife shall marry again the clock shall be my son John's when he has attained to the age of twenty one years All the rest and residue of my goods chattels stock farming utensils monies securities for money and estate of what nature or kine soever not herein before Disposed of subject to the payment of my just debts & funeral expences I give and bequeath unto my Brothers Robert Hanks of Cold Aston and John Hanks of Bourton on the water and my Brother in law Edward Reynolds of Little Risington all in the county of Gloucester aforesaid and unto the survivor or survivors of them In trust that they shall make or cause to be made as soon as may conveniently be after my Decease a true inventory of all my property and effects and that they shall at their discretion either continue and carry on the business of farming or turn the whole of my effects and property in to money to be placed out by them on Government Land or other good securities as shall appear to them to be most for the fenefit and advantage of my children and that they use and apply to the best of their judgment my said property with all its produce fro the cloathing educating maintaining apprenticing or otherwise breeding up of said children and to no other use and purpose whatsoever until my eldest surviving child shall attain to the age of twenty one years and my farther will is that the whaole of my property with all increase shall be equally divided by my said trustees between such of my Children as shall attain to the age of twenty one years share & share alike their respective shares to be ascertained and paid to them as soon as they shall severally have attained to the full age of twenty one years And I do hereby order and direct that my said trustees shall be allowed all reasonable expenses which they my incurr in the execution of the said trusts and that they shall not be answerable for any losses that may occur except it be by their wilful default nor shall one be answerable for the acts or defaults of the other by only for his own acts and defaults And I farther will and direct that if either of my said trustees before the whole business hereby entrusted to them be fully compleated and ended shall die then the surviving shall as soon as may be after his decease chose and appoint another proper person in his place who shall have equal power and authority with them in all matters relating to the said trust And I do hereby make and appoint my said Brothers Robert Hanks John Hanks and my said Brother in law Edward Reynolds the survivors of them joint guardians of all my Children and joint executors of this my last will and testament In witness whereof I the said Thomas Hanks the testator have hereunto set my hand and seal the Day and year above written

    This is the last will and testament of me John Hanks of Cold Aston otherwise Aston Blank in the County of Gloucester Yeoman I give and bequeath unto my wife Thirty pounds of lawful money of Great Britain to be paid to her by my Executors within one month after my decease Also I give unto my said wife the use of such of my Household goods plate linen books and china as she shall choose for and during the term of her natural life and after her decease I give and bequeath the said goods plate linen books and china to my two Sons John and Robert to be equally divided between them I give and bequeath to my Sister Elizabeth Reynolds five pounds a year for and during the term of her natural life to be paid to her half yearly the first payment to be made within three months after my decease and I do hereby charge the whole of my property real and personal with the said annuity I give and bequeath unto my Brother Robert Hanks and my Friend Thomas Kyte of Slaughter Farm the sum of four hundred pounds of lawful money in trust that they shall pay and apply the interest arising from the said sum and such part or the whole of the principal money as in their discretion they shall judge proper to my Son Thomas and in case any part of principal or interest of the said sum of four hundred pounds shall remain in their hands at his decease my will is that they shall pay such sum so remaining to my child or children of him the said Thomas in equal shares if more than one at such times as they shall judge best but if he shall have no lawful surviving child then the said remaining sum to be equally divided among the surviving children of me the said John Hanks of their legal representatives And whereas my said wife has consented to grant a lease for the term of her interest therein of all that my house and lands setled upon her for her life at our intermarriage to the above named Robert Hanks and Thomas Kyte at the annual rent of one hundred pounds my will and desire is that they accept of such lease for purposes herein after specified I have also a term of years to come by agreement in the farm which I rent of Mr. Palmer and Mr. Beddome I give and bequeath unto them the said Robert Hanks and Thomas Kyte all my stock and crop? Upon the said farm now in my occupation and all my interest in them till the expiration of the lease to be granted by my wife, and the agreement, in trust that they shall act as in their discretion shall sum to them best either by occupying the said farms or otherwise so as to enable them to make the best of my property hereby entrusted to them which property when converted into money shall constituted a part of the residue herein after mentioned the estate also in Aston which I purchased of Edward Fox I give and devise unto the said Robert Hanks and Thomas Kyte until the expiration of the said lease when I give and devise as well the last mentioned estate as also all that my Houses Lands tenements hereditaments and premises situate and being in the parish of Aston blank or Cold Aston and now setled upon my wife unto my Son John Hanks and his heirs for ever but in case he should not live to possess the said Lands and premises then I give and devise the same unto my Son Robert Hanks his Heirs and assigns for ever Nevertheless my will is that all the said premises shall be charged with the sum of Thirteen Hundred pounds of lawful money of Great Britain or the sum of Six hundred pounds of like lawful money independent of any Sun or Suns with which they may be charged already under the authority of the act of parliament for enclosing the aforesaid parish to be paid in time and manner following that is to say my will is and I hereby direct that my Son John shall pay to my Son Robert the said Sum of thirteen hundred pounds within twelve months after he shall become possessed of the said estates and premises but in case my son Robert shall not live to receive the said thirteen hundred pounds then I will and direct that my son John shall within the time just before limited pay into my trustees Robert Hanks and Thomas Kyte the sum of Six Hundred pounds to be by them applied and disposed of in the same manner as the before mentioned sum of four hundred pounds is directed to be applied likewise in case my son John shall not live to inherit the said estates and premises then I will and direct that my son Robert shall within the time before limited pay and cause to be paid unto my trustees before named the sum of six hundred pounds to be by them applied for the benefit of my son Thomas and his issue in like manner as the four hundred pounds aforementioned All the rest and residue of my estates and effects of what nature or kind so ever whether real or personal in possession or reversion I give devise and bequeath unto my a forenamed trustees Robert Hanks and Thomas Kyte in trust that they shall as speedily as may be reference being had to the instructions before given concerning the Lease and the agreement either by converting the same into money or in any other way they shall judge most expedient after payment of all my just debts legacies funeral expences and all expences and all expences whatever which they may incur in the execution of this my will and the trusts hereby reposed in them divide the same into equal shares between my two Sons John and Robert Hanks one moiety? To each of them and my will is that they my said Trustees shall not be answerable for any loss incurred or accruing except it be by his or their own wilful default nor the one for the receipts acts deeds or losses of the other but each for his own only and I do hereby nominate constitute and appoint the aforesaid Robert Hanks and Thomas Kyte joint Executors of this my last will and testament contained in two sheets of paper in witness whereof I have to the first sheet signed my name and to this last set my hand and Seal this 22 day of January in the year of our Lord one Thousand Eight Hundred and one

    EDWARD COOKE, Master of Arts Vicar General in Spiritual, of the Hanble and Right Reverend Father in God; Henry by Divine Permission, Lord Bishop of Gloucester, and of his Episcopal Consistory Official Principal, lawfully constituted to our beloved in Christ Francis Edward Witts, Wadham Huntley, Thos Rickards Ireland, clks Greeting, We do by these Pesents commit our Power and Authority to you, jointly and severally, (in whose fidelity we fully confide,) to receive the Corporal Oath of John North Wilkins one of the Executors named, of and in the last Will and Testament of John Hanks late of the Parish of Cold Aston in the County and Diocese of Gloucester Gentleman deceased, well and faithfully to perform the said Will, and also to exhibit an Inventory, and render an Account according to the Tenor of the Under-written Oath; And what shall be done in the Premises by Virtue of these Presents; Ye shall duly certify the same to us, our Surrogate, or some other Competent Judge, in this behalf, together with these Presents. And the said Will hereunto annexed, on or before the twenty ninth Day of May distant? Otherwise this Commission to be void and of none Effect.     Mr John North Wilkins YOU DO SWEAR, that you believe ---Paper Writing hereunto annexed, contains the original last Will and Testament of John Hanks late of the parish of Cold Aston in the County and diocese of Gloucester, Gentleman deceased; That you are one of the Executors therein named; That you will well and faithfully perform the said Will, by first paying the Debts of the said deceased, and then the Legacies in the said Will mentioned, so far as the Goods, Chattels, Rights, and Credits - thesaid deceased will thereto extend and the Law charge you. That you will ex- hibit into the Registry of the Lord Bishop of Gloucester, a true and Perfect Inventory of all, and singular the Goods, Chattels, and Credits of the said deceased, and render a just and true Account of your Administration thereof, when law- fully required so to do. You do also swear that the Personal Property of the said deceased, at the time of his Death, did not amount in Value to the sum of One hundred Pounds

    WE Thomas Collett of Bourton on the Water in the
    County of Gloucester Farmer --- William Tindale of the
    same place Gentleman and William Wood of the City of
    Gloucester Gentleman are held, and firmly bound unto the Right Reverend
    Christopher Lord Bishop of Gloucester
    in Forty pounds of good and lawful
    Money of the United Kingdom of Great Britain and Ireland, to
    be paid unto the said Lord Bishop
    his certain Attorney, his Executor, Administrators, or Assigns.
    To which Payment, well and truly to be made, we oblige our-
    selves, and each of us by himself, in and
    for the whole, our and each and every
    of our Hers, Executors, and Administrators, firmly by these
    Presents, Sealed with our Seals Dated the fifth
    Day of April in the Seventh Year of
    the Reign of our Sovereign Lord --- the fourth by the
    Grace of God of the United Kingdom of Great Britain and
    Ireland, King, Defender of the Faith, and in the Year of our
    Lord, One Thousand Eight Hundred and twenty six

    The Condition of this Obligation, is such
    That is the above bound---? Thomas Collett the ------
    Administrator of all and singular the Goods, Chattels,a dn Credits of Mary Hanks
    (late Mary Collett deceased / late of Cold Aston in the County and
    Diocese of Gloucester.
    do make, or cause to be made, a true and perfect Inventory of all and singular the
    Goods. Chattels, and Credits, of the said Deceas'd, which have or shall come to
    the Hands, Possession, or Knowledge of him the said Thomas Collett
    or into the Hands and Possession of any Person or Persons for
    him and the same, so made, do exhibit, or cause to be exhibited, into
    the Registry of the said Lord Bishop at or before the last
    Day of May next ensuing, and the same Goods, Chattels,
    and Credits, and all other the Goods, Chattels, and Credits, of the said Deceased,
    at the Time of her Death, which at any Time after shall come to the
    Hands or Possession of the said Thomas Collett or
    into the Hands and Possession of any other Person or Persons for him do well
    and truly administer according to Law; and further, do make, or cause to be made,
    a true and just Accompt of his said Administration at or before
    last Day of April One Thousand Eight
    Hundred twenty seven and all the Rest and Residue of the said Goods,
    Chattels, and Credits, which shall be found remaining upon the said Adminis-
    trator's Accompt, the same being first examined and allowed of, by the Judge
    or Judges for the Time being, of the said Court, shall deliver and pay unto such Person or Persons respectively, as the said Judge or Judges, by his or their Decree
    or Sentence, pursuant to the true Intent and Meaning of a late Act of Parliament,
    made in the Two and Twentieth and Three and Twentieth Years of the Reign of
    our late Sovereign Lord King Charles the Second, intitled, "An Act for the better
    settling of Intestates' Estates," shall limit and appoint; and if it shall hereafter
    appear, that any last Will and Testament was made by the said Deceased, and
    the Executor or Executors therein-named do exhibit the same into the said Court,
    making Request to have it allowed and approved accordingly, if the said
    Thomas Collett above-bounden, being thereunto acquired,
    do render and deliver the said Letter of Administration (Approbation of such
    Testament being first had and made) in the said Court, then this Obligation to
    be void, or else to remain in Full Force and Virtue
