The Last Will & Testament of Jacob Zimmerly Sr.
of Washington County, Virginia

In the Name of God Amen. I, Jacob Zimmerly of Washington County & State of Virginia being very sick & weak but in perfect mind and memory thanks be to God calling to mind the mortality of my body & knowing that it is appointed for all men once to die do make & ordain this my last Will & Testament. That is to say principally & first of all, I give & recommend my soul into the hands of Almighty God who gave it and my body I recommend to the earth to be buried in a decent
Christian burial at the discretion of my Executors nothing doubting but at the General Resurrection I shall receive again by the Almighty God. And as touching such worldly estate wherewith it has pleased God to bless me with in this life I give and dispose of the same in the following manner.
First it is my desire that my beloved wife Eve shall have sufficient maintenance and with a comfortable room in the lower story of my present dwelling house with all the house furniture now in my possession
also one hundred and fifty dollars to be paid her by my executor whenever called for. The whole to be disposed of by her as she thinks proper if anything left at her decease to be divided amongst my children.
Also I give to my daughters namely Catherine Lower, Elizabeth Zimmerly, Eve Mompower, Mary Sanders, Margaret Booker, the sum of forty dollars each, also I leave to my son Georges four children the sum of fourty dollars which is to be equally divided amongst them. Also I leave to my Grand
Daughter Susannah Zimmerly one bed and furniture one new saddle & bridle, one three year old heifer and one new spinning wheel. Also my Daughter Susannah Shelby Equal share with the rest of my children. Also I give to my son Jacob Zimmerly whom I likewise ordain the sole Executor of this my
last Will & Testament all & singular my lands & tenements by him freely to be enjoyed by paying the sums above mentioned allowing him five years to pay the same. And I do utterly revoke & disannul all & every former Wills & Testaments by me on anywise before named ratifying
confirming this & no other to be my last Will & Testament. In Witness where of I have hereunto set my hand & seal this third day of April in the year of our Lord one thousand eight hundred & nineteen.

At Court held for Washington County the 18th day of May 1819. The last Will
& Testament of Jacob Zimmerle deceased was exhibited in court & proved
by the oath of Joseph Gray jr & Henry Mumpower two of the witnesses thereto
and ordered to be recorded. And on the motion of Jacob Zimmerle the Executor
therein named who took the oath of executor presented by law and entered
into & acknowledged his bond in the sum of five hundred dollars with
Joseph Gray & Henry Mumpower his securities conditioned as the law directs.
A Certificate is therefore granted him for the probate of the said Will in
due form.
