The Last Will and Testament of Daniel Zink
of Edgar County, Illinois
I, Daniel Zink, of County of Edgar, Illinois, do make-ordain-publish this my
Last Will and Testament in manner and form following, that is to say:
First, I Will all my just debts to be paid by my executor here-in after named.
Second, I Will to John C. Archer as the Trustee of my daughter Polly, my cow which I
now own if said cow shall be alive when I die and $30 out of my money that may
come to the hands of my executor, not necessary to the support, clothing and
education of my son, Andrew F. Zink, to be by said Archer applied to said Polly's
support.. Thirdly, I give and bequeath to my son Andrew F. Zink, the west one-half
of the Northwest Quarter of Section 15, containing 80 acres; the Southwest Quarter
of Section 15, containing 40 acres and the West one-half of the Northeast Quarter
of Section 28 containing 80 acres, all in Township 13, north of Range 12 West,
in County of Edgar and State of Illinois. All of said lands I deeded to my son
Andrew F. Zink. 4-28-1841, which deed is now on file in the Recorders Office in
said County. This item is here inserted to aid the claim if any aid is wanting
to my said son's title to the above described lands, the said lands having been
purchased by me with money I received by his late mother Elizabeth Zink, formerly
Elizabeth Cline. Fourthly, I authorize my executor to keep and preserve for my
son, Andrew F. Zink, all my tools of every description, including my wagon, harrow,
log chain, and half bushel. Fifthly, I authorize my executor hereby to sell all
or any of the personal property, which I may be possessed of at my death, unless
said executor shall believe it more to the interest of my son, Andrew F. Zink to
withdraw any of said property from sale after the same has been duly offered at
sale and fails to bring a reasonable price. Any article offered for sale and not
sold may be preserved for my said son or sold afterwards if a fair can be gotten
for it. Sixthly, I Will that my farm be rented out on the best terms to be had,
restricting the tenant and all others not to cut or injure any green timber on
same and prohibiting any stock from running in the apple orchard at any time.
I appoint my friend, Jacob Zimmerly, Sr., sole executor of this my Last Will and
Testament.
In witness whereof I have here unto set my hand and seal this 5-18-1841.

Published, signed and sealed in presence of us who have hereunto signed our
names in the presence of the testator as his last will and testament.

Codicil to Last Will and Testament of Daniel Zink:
I hereby give and bequeath to my son, Andrew F. Zink, all the estate, real and
personal of which I may die seized and possessed except so much there of as will
pay my debts and the legacy of this my Last Will here preceding, given to John
C. Archer as Trustee of my daughter Polly.
Witness my hand and seal 5-25-1841.

Acknowledged in the presence of George Rhoades and Isaac Zimmerly at a Court of
Probate held for Edgar County, IL, in Paris, 8-11-1841---present Samuel Connely, P. J. P.
This day the Last Will and Testament of Daniel Zink, deceased, was produced in
open court and proven by oaths of Jonathan Mayo and Andrew Cline, the subscribing
witnesses hereto, in due form of law and ordered to be recorded. And at the same
time a codicil to the Last Will and Testament of Daniel Zink, deceased, was produced
in open court and proven by oaths of George Rhodes and Isaac Zimmerly, the
subscribing witnesses thereto in due form of law and also ordered to be recorded

Daniel lived with his daughter Susan Zimmerly, who also cared for his youngest
son Andrew F. Zink born to the third wife Elizabeth Cline, when he separated from
his wife Margaret Stivers because of old age. Elizabeth Archer cared for Polly
his defective child.
