Will of James Vestal Senior, April 17, 1793

   The seventeenth day of ye 4th mo. in ye year of our Lord one thousand seven hundred and ninety-three, I, James Vestal senr. of North Carolina in Surry county, yeoman, being of perfect mind and menory thanks be given to the Lord; therefore calling unto mind ye mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament and as touching such worldly estate as providence has blessed me with in this life I give, devise, & dispose of the same in the folowing manner & form -- First of all my debts and funeral charges must be paid ---Item, I give to my son David Vestal, ye improvement he now lives on with thirty acres of land at the west end of my plantation joining JOhn Thomas Longinos line by him freely to be possessed and enjoyed without any molestation.
   Item, I give to my son Thomas Vestal, the imporvement he now lives on with eighty-five acres of land at ye east end of my plantation joining Simon Hadleys line he paying my son James Vestal ten pounds in trade in five years from this date; Likewise to pay to my son William Vestal, my daughter Sarah Whitehead, my daughter Elizabeth McDaniel, my daughter, Mary Chapman, my daughter Rachael Bullock ye sum of ten shillings a peace as their full legacy paid by him.
    Item I give my son John Vestal a note of thirty-five shillings that I have against him for his full share.
   Item I give my son Jesse Vestal ye remainder part of my land where I now live containing about fifty acres with all the appertenances thereunto belonging by him freely to be possessed and enjoyed except ye privilege of ye house we live in & seven acres of cleared land with necessary wood and water I except and leave to my beloved wife during her widowhood & no longer; likewise it is my will that my wife shall have one cow & two year-old calves, three sheep, her horse & saddle, one chest & little box & Pot & a sow & four pigs, one mare, colt for six years & then to give her up to my daughter Rebecca Vestal also a wheel & a reel during life also a bed & bed clothes during her widowhood then the bed & clothing to be given to my daughter Rebecca Vestal: And further it is my will that my above said son Jesse Vestal shall pay to my son Isaac Vestal one horse worth twenty pounds & a good new saddle when he arrives to twenty-one years of age.
   And further it is my will that my son Thomas Vestal shall have the care & tuition of my daughter Rebecca Vestal till she arrives to ye age of eighteen yeaers & of her goods. Further it is my will that my son Isaac be bound out to a trade. And further it is my will and desire that all ye residue of my goods that is not willed away by me in this will and one half of my crops shall be sold at public vandue to defray expenses and if then should be any over pluls it is my will my son Thomas Vestal shall have it with my saddle, & further I leave my hatchet to Ann Vestal my daughter-in-law. Likewise I constitute, make and ordain my son Thomas Vestal & my trusty friend, Thomas Hadley my only and sole executors of this my last will & testament and do hereby utterly disallow, revoke & disannul all & every other former testaments, wills & legacies, bequests and eecutors by me in any wise before this time nominated willed and bequested ratifying and confirming this and no other to be my last will and testament.
   In witness where of I have hereunto set my hand & seal ye day & year above written.

I Jesse Vestal in considering the uncertainly this mjortal life and being of sound mind and memory (blessed be unto Almighty God of the same) do make and publish this my last will and testament in manner and for following that is to say
   First I have divided and give unto my eldest son William Vestal all his portion and *or of) part that I ever intent to give him. Second I have given unto my son Solomon Vestal all of his part of my property that I intend for him. Third I have given unto my daughter Nancy Vestal all her part of my property that I intent for her. Fourth I have given unto my daughter Phoebe A. Vestal all of her part of my property that I intent for her. Fifth I have given unto my daughter Sally Vestal all of her part of my property that I intent for her. Sixth I have given unto my daughter Martha Vestal all of her part of my property that I intent for her. Seventh I have given unto my son Jesse Vestal he being last of my seven children that I had by my first wife, all of his part of my property that I intent for him. Eighth I give and bequeath unto my son Isaac Vestal, he being the only child I have by present wife all my deferent tracts of land in my possession, also one other tract of land containing one hundred acres with a provision that if Caroline Jones daughter of John Jones should ever call on my said son Isaac Vestal or authorize him to sell the land for him to do so by the said Caroline Jones paying my son Isaac what is yet due me. And I also give and bequeath unto my son Isaac Vestal all of my other property now in my possession or may here after have. I give and bequeath unto my beloved wife Elizabeth Vestal her dowry in the above willed land dureing her mortal life also all of her household property of all kinds for her to enjoy during her life time, then the above named property to return to my son Isaac Vestal as named in the will. I appoint my son Isaac Vestal & my wife Elizabeth vestal executors to this my last will & testament in witness were of I have her unto set my hand & seal this the 24th day of August A.D. 1837.
