Will of David Boles, Greene County, TN 1829.  Transcribed and Submitted

In the Name of God Amen
I David Boles being sick and weak in body but of sound mind and memory
and calling to mind the mortality of my body and that it is apointed for
all men once to die do make and order this instrument of writing to be
my last will and testament and first of all I commit my soul into the
hands of allmighty God who gave it (nothing?) (doubting?) but at the
great day of the resurection I shall recover it again by the power of
God.
I will and bequeath my body to the ground to be buried in decent
Christianlike manner at the discretion of my Executors and as for such
worldly estate as it hath pleased God to bless me with I will and
bequeath in the following manner vis.
1st  I will and order that my just debts be paid out of my (miserable?)
property.

2nd.  I will and bequeath to my beloved wife Elizabeth all my estate
both real and personal to have and to hold during her widowhood to
ennable her to bring up to years of twenty one my beloved children
namely Sarah, Jesse, Jacob, George, John, David, Daniel, Elizabeth,
Polley, Elinor and Joan or as many of them as have not arrived to the
age of twenty one and that she actually do so.

3rd  I will and order that after the marriage or decease of my widow as
the case may be all my estate real and personal shall be mutually sold
to the highest bidder by my executors herein often named and that the
money arising from the sale of said estate is to be equally divided
amongst heirs as above named as soon as they or any of them arrive to
the age of twenty one.

4th. I will and bequeath to my wife Elizabeth if in case she should
marry after my decease one equal part of the money arising from the sale
of my estate as above with rest of my heirs.

5th I will and order that after the sale of my lands my executors make
and execute (decisions ?) on (deeds ?) unto the (purchasers ?) or
(purchased ?) of the same.

6th  I hereby constitute and apoint my beloved wife Elizabeth Boles and
my two sons Jesse Boles and Jacob Boles to be my executors and executors
from and after my decease.

7th I will and order that the office of executive of my wife Elizabeth
Boles shall cease immediately if in case she marries after my decease.

8th and lastly I hereby make void and (?) all former wills by me
heretofore (?)  (rattifying) and confirming this and no other to be my
last in testimony whereof I have (hereunto) laid my hand and afixed my
seal this 4th day January 1829.

Know all men by those present that Elizabeth Boles, Jesse Boles, Jacob
Boles, John Shields and Charles (Loves?) of Greene County and State of
Tennessee, are held and firmly bound unto (?) Hale Governor of said
State for the time being and to the (survivors? successors?) in the sum
of ( Two?) thousand dollars.  To which payment will and truly to be made
we bind ourselves, our (lives?) executors and administrators, jointly
and severally, firmly by these (?).  Sealed with our seals and dated
this 27th day of April 1829.

The conditions of the above obligations is such that whereas David Boles
late of said County hath departed thy life having first made his last
will and testament in writing and therein and thereby appointing the
said Elizabeth Boles Executor, Jesse Boles and Jacob Boles Executors
which will hath been duly proving and admitted to record in the Court of
(Pleas? place?) and (Quarter ?) (Sessions ?) of said County.  If
therefore the said Elizabeth, Jesse and Jacob Boles shall, well and
truly perform the said will by paying the Testators just debts and then
this Legacies contained in said will as far as the goods, chattels and
are (?) of the testator will thereunto (actin ?) ( of ?) and (of ?) this
law charges and (furthers ?) make a true and perfect inventory of all
the said goods chattels and credits and (?) the same to the (court ?) of
( aforesaid ?)   and in all things will truly and faithfully administer
the said estate agreeable to the will aforesaid and the Law.  (?) the
above obligations to be void otherwise to be (in force ?).
