JESSE DANIEL'S WILL PROBATED
Leaves Good Part of His Prop- erty to Fayetteville Churches
The will of the late Jesse W. Daniel, of Fayetteville, was filed and probated in the county court, of Kanawha county Monday. Jesse W. Daniel was the son of the late N. Daniel, who was killed while serving as sheriff of Fayette county.
The will bequeaths to his wife, Jennie W. Daniel, the home property and directs that $5,000 be paid to her from the estate.
A parsonage lot for the Platt Memorial M. E. church at Fayetteville, was bequeathed to the trustee's of that church.
A small strip of land was directed to be transferred to A. M. Kincaid, at Fayetteville.
One thousand dollars was left to the Platt Memorial M. E., church at Fayetteville.
Two thousand dollars was bequeathed to Doshia Daniel, to be expended in securing for her an education.
Five hundred dollars was bequeathed to the Davis Child Shelter at Charleston.
J. H. Daniel was given three lots in the town of Fayetteville.
Five hundred dollars was given to the Fayetteville Cemetery Association for the purpose of improving the cemetery.
The residue of the estate was bequeathed to the trustee's of the West Virginia University, for the M. E. church at Buckhannon, to be used in building a hall, to be known as the N. Daniel Memorial Hall.
Chas. L. Phipps was named as the executor of the will, which was dated September 19, 1905.

Remembers Charity Institutions - Will of Jesse W. Daniel Probated
The will of the late Jesse W. Daniel, of Fayette county, was filed and probated in the county court of Kanawha county this week. Jesse W. Daniel, was the son of the late N. Daniel, who was killed while serving as Sheriff of Fayette county.
In the will, after leaving a comfortable sum to his wife and other members of the family and giving several sums to charitable institutions, among them being the Davis Child Shelter of Charleston, the residue of the estate was bequeathed to the trustees of the West Virginia University, for the M. E. church of Buckhannon, to be used in building a hall to be known as the N. Daniel Memorial Hall.

Last Will & Testament.
I, Jessee W. Daniel, of the Town of Fayetteville, County of Fayette, and State of West Virginia, make this my last will and Testament hereby revoking all former wills made by me and direct the payment of my just debts.
I, give, devise, and bequeath to Jennie Daniel all of the residue of the home place, except as hereinafter provided, formerly known as the M. T. Davis property which was conveyed to my father N. Daniel by J. H. Daniel and wife by deed bearing date the 24th day of August 1900, and recorded in Deed Book No. 25 at page 204, in the office of the Clerk of the County Court of Fayette County, West Virginia.
I, also give and bequeath to Jennie Daniel Five Thousand Dollars ($5000.00) to be paid her out of my estate, or if she prefers my Executor is authorized to assign to her Five Thousand Dollars ($5000.00) or any stocks now owned by me.
I, give, devise and bequeath to J. T. Grose, C. M. M. Fultz D. C. Hedrick trustees of the Platt Memorial M. E. Church situated in Fayetteville, West Virginia the lot marked "M. E. Church Parsonage Lot" on plat now in the possession of Jennie Daniel to which reference is here made for an accurate description of said lot. The said lot is out of the home place above bequeathed to Jennie Daniel.
I, also authorize my executor to convey to A. M. Kincaid a small strip of land under enclosure by fence and adjoining the lot of the said Kincaid, which I had heretofore agreed to convey to the said Kincaid for the sum of Five Dollars ($5.00). This strip of land and the Parsonage Lot are the only reservations out of the home place the residue thereof being above bequeathed to Jennie Daniel.
I, also give and bequeath to the Platt Memorial M. E. Church of Fayetteville, West Virginia, the sum of One Thousand Dollars ($1000.00) to be paid to said Church by my executor when in his opinion convenient to do so from the proceeds of my estate.
I, also give and bequeath to Doshia Daniel Two Thousand Dollars ($2000.00) to be used for the purpose of educating the said Doshia Daniel and to be paid to her at such times and in such amounts as my executor shall deem best.
I give and bequeath Five Hundred Dollars ($500.00) to the Davis-Child Shelter of Charleston, West Virginia, to be used by the said institution as the Directors or Trustees thereof may deem best.
I give and bequeath to J. H. Daniel the livery stable lot and the two lots adjoining it, including all of the improvements thereon, and being the same lots on which the said J. H. Daniel now resides, situate just back of the Court House in the Town of Fayetteville, West Virginia.
I, also give and bequeath Five Hundred Dollars ($500.00) to be used by my executor in improving and beautifying the Cemetery of the Fayetteville Cemetery Association to be used in the way designated by my said Executor.
All of the residue of my estate both personal and real property and wherever situated my executor is authorized to sell from time to time and in such manner as he shall deem best to promote the best interest of the estate and the money received therefor I give and bequeath to the trustees of the Western West Virginia University for the M. E. Church situated Buckhannon West Virginia to be used by said Trustees for the purpose of building a hall to be known as the N. Daniel Memorial Hall.
And I hereby designate and appoint my cousin Charles L. Phipps Executor of this my last Will and Testament and request that he be permitted to act as such executor without being Required to give bond. And I further give my said Executor the authority to sell and convert into money any of the personal property and real estate that he may deem best from time to time, as in his opinion the best interest of the estate will be promoted thereby, and to execute deeds as my executor for any real estate which may be sold by him.

Sealed, Published, and declared by Jessee W. Daniel as and for his last Will and Testament in the presence of us, who in his presence at his request and in the presence of one another, have hereunto subscribed our names as witnesses this the 19th day of September, 1905.

IN VACATION
In the Office of the Clark of the County Court of Fayette County, West Virginia September 23rd 1905.
This day there was presented before me, William Grafton, Clerk of the County Court of Fayette County, West Virginia, in my office, and offered for probate a paper writing purporting to be the last Will and Testament of Jessee W. Daniel late of this County, deceased. And after hearing the evidence upon oath of J. S. Phipps and S. L. Walker the two subscribing witnesses thereto, and its appearing from said evidence that said paper writing is what it purports to be, that it was signed by said testator in the presence of said witnesses and that they signed said paper writing as witnesses at the request of said testator and in his presence and in the presence of each other, and that the signature of the said testator, thereto is genuine and there being no objections thereto said paper writing is admitted to record as and for the last Will and Testament of him the said Jessee W. Daniel deceased. And it being provided in said Will that C. L. Phipps the executor therein named shall be permitted to qualify as such executor without giving bond as such executor and the said C. L. Phipps thereupon appeared before me and took the oath prescribed by law as the executor of the last Will and Testament of the said Jessee W. Daniel deceased.
And Jessee Legg, R. J. Thrift and S. L. Walker are hereby appointed appraisers of the said estate to appraise the value of the same and make their report according to law.
