The jury in the patent-right case, tried in the Circuit Court at Lyons, were out all night Thursday and came into court three times Friday morning and were directed to retire again by Judge RUMSEY for further consideration. At noon the jury again appeared and rendered a verdict of no cause of action, which

unless reversed by the higher courts renders worthless the $2,000 note held by Fred J. NICHOLS against John FREY.

In 1905, at the time of the death of his sister Elizabeth Frey Boeheim, John was known to be living in North Carolina.

BODY MUTILATED ON RAILROAD IN LYONS

Man Found Dead Perhaps of Newark, N. J.

Lyons, Aug. 7 - This morning about 4:30 o'clock the body of a man was found on the New York Central tracks near the Geneva street crossing. The man was about 30 years old, and had evidently been dead but a short time. Although men were at work near and had passed the place where the body was found, none had seen the accident or knew how the victim was killed. The body was badly cut up; both legs had been nearly severed just below the knee, the jaw and collar bone were broken and there were several bad bruises on the face and body.

Undertaker BOEHEIM was summoned, and took the body to his undertaking rooms, on Water street. On the man was found a plumber's union card, which was made out to Charles LANGWASSER, of Newark, N. J. He had $1.50 in money. The card was the only thing found to identify the man.

She was united in marriage March 1, 1939, in Clarinda, Iowa, to Walter L. Frey and he preceded her in death, September 4, 1994. Maxine and Walter farmed and she was the bookkeeper and an important part of the farm operation. Maxine had many activities through the years. She was a past member of the Eastern Star, IT Neighborhood Club, Nodaway and Villisca Band Mothers, Progress Club and the Shrine Auxiliary. Maxine loved to read, work crossword puzzles and do hand work. Maxine was a member of the United Methodist Church, Nodaway, Iowa.

Preceding Maxine in death were her parents, husband, Walter L. Frey, and sister, Carolyn Lackey. Survivors include her children; W. Curtis Frey and wife Shirley of Oskaloosa, Iowa, Cheryl Ann Lyall and her husband Robert of Indianola, Iowa, Lyle K. Frey and his wife Susan of Villisca, Iowa, five grandchildren, step mother-in-law; Golda Frey Clark of Villisca, Iowa, and a host of nieces, nephews and friends.

Wenban, Frederick - Frederick William 'Fred' Wenban, 90, died April 20, 2003 at Newark Hospital. Frederick was born October 10, 1912 in Newark, son of Frederick and Mary Stansell Wenban. He was a direct descendent of the first settlers in Wayne County. He was a WWII veteran, member of First United Methodist Church in Newark, Newark Masonic Lodge No. 83, F&AM, Newark Country Club, and Arcadia Historical Society. Mr. Wenban had worked for C.H. Stuart Co. for over 50 years, serving on the corporate staff as Assistant Secretary and Treasurer. He was an avid golfer and bowler, and he enjoyed his home, farm and bird watching. He is survived by his step-son William (Christine) Brightman of Newark, and step-daughter Jeanne Frey of Newark; sister Helen Rider of Lyons; seven step-grandchildren and 12 step-great-grandchildren; niece Mary VanNorman of Newark; nephew William Rider of Newark; great-nieces and great-nephews and many friends. Mr. Wenban was predeceased by his parents; by his wife Ruth Knickerbocker Wenban on October 15, 1996; and step-son-in-law Gerald Frey on May 15, 2000. Interment, Newark Cemetery.
