Last Will and Testament of Arthur Murphey

In the name of God Amen. I, Arthur Murphey, of the County of Franklin, State of North Carolina, being weak in body but sound and perfect mind and memory, blessed be almighty God for the same, do make and publish this my last will and testament, in manner and form following.

First: I give and bequeath unto my beloved wife, Charity Murphey, all the lands whereon I now live during her natural life and after her decease to Martin Murphy, my grandson, and his heirs forever.

I also give and bequeath to my wife, Charity Murphey, one bed and clothing, also one mare by the name of Dangle and sadle.

I also give and bequeath unto my son, Arthur Murphey, the sum of one pound, all the rest of my property is to be sold at public sale and the money to be put out upon interests and the interest thereof to be given to my wife, Charity Murphey during her natural life, for her maintenance and if the said _________ of the money above mentioned is not enough to keep her from suffering, the money or interests to be given her and after her death the money or interest (if there is any) is to be divided equal among my six children and one grandson, viz: Sarah Wood(?), Mary Masters(?), Maria Edwards Molly Do???, Parker Murphey, William Bird Murphey and _____ _____ Barnard, grandson.

I hereby appoint Parker Murphey and William Clumps? my Executors to this my last will and testament hereby revoking all former wills by me made.

In witness whereof I have hereunto set my hand and seal this sixteenth day of March in the year of our Lord one thousand eight hundred _____________.

Ordered that it be opened as has been laid out by the jury and that Thomas Robinson be overseer of the same, and it is also ordered that the hands of . . . Nicholas Murphy . . . assist him in opening and clearing the same.

12 Feb 1777: William Wood acknowledged a Deed to Nicholas Murphey on whose motion the same is ordered to be registered.

13 Feb 1777: Nicholas Murphy is appointed Constable in the room of Peter Goodwin, and ordered that he be sworn before some Justice of the Peace for this County before he enter into the execution of his said office.

14 May 1777: . . . Nicholas Murphey . . . Each and every of them produced a Commission from under the hand of Richard Caswell Esq'r., Governor and Cap't. General and over the State of North Carolina, took the oath appointed to be taken in the said State and subscribed the same.

12 Nov 1777: Arthur Murphy acknowledged a deed to James Murphy at whose motion the same is ordered to be registered.

12 Nov 1777: A deed from William Walker to James Murphy was proved by the oath of Drury Vinson a witness thereto and on motion the same is ordered to be registered.

12 Feb 1778: Stephen Gupton is appointed Constable in the room of Nicholas Murphey and ordered that he be sworn before some Justice of this County before he enter into the execution of his said office.

14 Aug 1778: Christopher Strother acknowledged a deed to James Murphey at whose motion the same is ordered to be registered.

11 Feb 1779: A deed from William Walker to Drury Vinson was proved by the oath of James Murphey, a witness thereto, and on motion the same was Ordered to be registered.


Oath of Allegiance - Bute Co. NC
The Oath
I will bare faithful and true allegiance to the State of North Carolina and will truly endeavor to support maintain and defend the Independent Goverm't thereof against George the third King of Great Britain and his successors and the attempts of any other persons, prince, power, State, or potentate who by secret are treason conspire copies or by open force shall attempt to subject the same and I will in every respect conduct myself as a peaceful orderly subject and that I will disclose and make known to the Governor (or) some member of the Council of State or some Justice of the Superior Courts or of the peace all treason conspiracies and attempts committed or intendedagainst the State which shall come to my knowledge, so help you God.
