In the Name of God Amen I Phillip STANSBY of Dorchester in the County of Dorset being sensible of my frailty and mortal condition and in good understanding and memory (blessed be to God) do make and ordain this my last Will and Testament in manner and form following

Impremis: I commit my soul into the arms of Jesus Christ my dear and only saviour and redeemer in whom alone I trust and hope through his merits and satisfaction to attain eternal life and salvation

Item: I give and devise my dwelling house, shop, garden, and stable with the appurtenances wherein I now live which I purchased of Mr John BROWNE in a certain street called the High West Street within the parish of Trinity Dorchester and now in my tenure and possession unto my daughter Elizabeth SHEPPARD for and during her life without impeachment of or for any manner of waste and after her decease to all and every of the son and sons of the said Elizabeth SHEPPARD severally and respectively as they shall be in priority of age or birth, and to the heirs of the body and bodies of such son or sons lawfully to be begotten the eldest of such son or sons and the heirs of his body all moneys to be preferred before the youngest

    And in default of such issue then to the daughter or daughters of the said Elizabeth SHEPPARD and the hairs of the body of such daughter and daughters lawfully begotten

    And for default of such issue it is my Will that my son in law Thomas SHEPPARD shall enjoy the messuage and premises during his life and after his decease the said Messuage and premises I devise unto the right heirs of my late daughter Mary GOLLOP deceased for ever

Item: Whereas by agreement made between my self and Mr John GOLLOP of Dorchester Mercer at and before his marriage to and with Mary my daughter late his wife deceased in consideration of said Marriage was to pay unto the said John GOLLOP my son-in-law the sum of two hundred pounds at a day some time past with interest for the same until it was paid which said sum of two hundred pounds was to be for the use and benefit of the oldest son of the said John GOLLOP and Mary his wife in consideration and satisfaction of the said two hundred pounds with all the arrears of interest for the same I give and devise and direct all that Messuage burgage or tenement and one Cottage or new erected dwelling house in the back lane, one stable, two gardens, with the appurtenances lying and being together in the parish of St Peters in Dorchester therein the South Street or in the West side of the street now in the possession of Thomas DALLICOATE Gentleman and Mrs BYLES and Robert FFILBOW unto John GOLLOP my grandson the oldest son of the said John GOLLOP Mercer and Mary his wife, and the heirs of the body of the said John GOLLOP my grandson lawfully begotten

    And in default of such issue I give devise the said messuage and last mentioned premises unto Thomas GOLLOP the younger son of the said John GOLLOP and Mary his wife and the heirs of the body of him the said Thomas GOLLOP lawfully to be begotten
    And for default of such issue I give and devise the same last mentioned messuage and premises to Debrah GOLLOP daughter of the said John GOLLOP Mercer and Mary his wife and the heirs of the body of the said Debrah lawfully to be begotten
    And for default of such issue I give and devise the said last mentioned messuage and premises unto cousin James LODER of Haselbury Bryant and his heirs lawfully begotten for want of such issue unto [blank] the son & sons of Cousin Andrew LODER

Item: Whereas I was to give two hundred pounds unto my grandson John GOLLOP as before is mentioned yet was upon this consideration that my brother in law Mr Thomas GOLLOP Senior of Stroade should give him one hundred more to be paid unto my son in law John GOLLOP of Dorchester Mercer and interest or benefit of the whole three hundred to be paid unto my grandson John GOLLOP when come to be of age

    And in order thereunto my son in law John GOLLOP his father should give Bond for the performance of it which said Bond my brother in law Mr Thomas GOLLOP ordered to be left in my custody for the benefit of my grandson John GOLLOP when he came to be of age

Item: I give and devise my Land in Presson and Sutton Points [i.e.Preston with Sutton Poyntz ] in the said County of Dorset which I purchased of Andrew NAPPER Gentleman deceased and Thomas GILLETT deceased (now in the possession of John READE my tenant unto my daughter Elizabeth SHEPPARD during her life without impeachment of waste

    And after her decease Then I give and devise the last mentioned Lands to the son & sons of the said Elizabeth SHEPPARD severally and respectively as they shall be in priority of age and priority of birth and the heirs of the body of such son or sons lawfully to be begotten the elder of such son or sons and the heirs of his body lawfully to be begotten the elder of such son or sons to take place before the younger
    And for default of such issue then to the daughter and daughters of the body of the said Elizabeth SHEPPARD and the heirs of the body of such daughter and daughters
    And for default of such issue then I give and devise the same unto my grandson John GOLLOP for and during his life without impeachment of waste and after his decease to the son and sons of the said John GOLLOP my grandson as they shall be in seniority of age and priority of birth and to the heirs of the body of such son and sons the elder always to take place being lawfully to be begotten
    And for default of such issue I give and devise the Land with the said premises unto my grandson Thomas GOLLOP son of the said John GOLLOP of Dorchester Mercer and Mary his wife deceased during his life and after the decease of the said Thomas GOLLOP I give and devise the Land before mentioned unto Deberah GOLLOP daughter of the said John GOLLOP and Mary his wife deceased
    And after her decease I give and devise the same Lands last mentioned unto Richard MILLER's Children to be divided amongst the

Item: and of and for the personage and Manor of Presson with all other lands tenements and hereditaments in Presson the with said Manor and premises in Presson aforesaid were purchased by me of Jeremiah TERRANT of Wingfield deceased one of the Prebends of the Church of Salisbury for an Estate yet continuing in the name of Andrew LODER of Dorchester aforesaid Gentleman and Richard ATKINS of Dorchester aforesaid Apothecary such deeds in trust for me my executors and assigns my Will is that my daughter Elizabeth SHEPPARD shall have and enjoy the said Manor and parsonage the last mentioned premises for and during the (remainder) of her natural life if the Estate therein granted by the said Prebend shall so long continue subject nevertheless to the yearly rents and covenants in the original lease continued

    And that he shall keep Courts in the name of the said trustees and grant estates by Copy according to the Custom of the said Manor receive and take the fines rents issues and profits of the said Manor and premises during her life as aforesaid
    And in case my daughter SHEPPARD shall happen to die before the termination of the Estate of and in the Manor and premises granted as aforesaid and shall have and child or children of her body begotten then my Will is that such child and children of my daughter SHEPPARD equally to be divided amongst them shall have receive and take the whole rents issues and profits of the said Manor and premises to their own use and uses as freely and in such manner as my said daughter SHEPPARD ought or might receive the same by virtue of this my Will during the continuance above recited to be granted by the said Prebend but nevertheless to the yearly rents and covenants in the original lease contained,
    And in case the child and children of my daughter SHEPPARD shall die during the continuance of the Estate granted of and in the said Manor and premises as aforesaid then my Will is that John GOLLOP my grandson his heirs and assigns shall have and receive the rents issues and profits of the said Manor and last received premised to his own use for granting of Estates in manner as aforesaid but subject to the rents and covenants in the original lease contained during the continuance of the Estate of and in the same Manor and premises as granted by the said Prebend aforesaid
    And after his decease during the continuance of the said tenure it is my Will that my grandchildren Thomas and Debeitta shall have and enjoy the same premises to be equally divided between them their executors and administrators during the continuance of the lease then to be in being and for them to grant Estates as aforesaid
    And in case any of the lives by which I do hold the Estate do die that they with the advice of the Trustees do procure the lease to be filled up by the Prebend

Item: I am possessed and interested in one house garden and stable with their appurtenances situate lying and being in Dorchester which was formerly the house and lands of one William HASELBURY late of Dorchester aforesaid Clothier deceased for a certain long tenure of years yet to come and unexpired my Will is and I do hereby the use possession and ?????????? and yearly rents and profits of the said last mentioned house and premises unto my daughter Elizabeth SHEPPARD for and during so many years she the said Elizabeth SHEPPARD shall happen to live the said Elizabeth SHEPPARD yearly paying to An: HASELBURY Widow relict of Wm the yearly sum of four pounds during her life in such manner and at such times as I have paid the same

    And after the death of my said daughter SHEPPARD I give and devise the last mentioned house and premises for an during the rest of the said term and term of years unto the Children of my said daughter Sheppard
    And after the death of any child or children of my said daughter SHEPPARD yet is my Will that my Cousin Joane WEAVER's children which she had by Thomas WEAVER shall enjoy the aforesaid yearly sum of four pounds to the said Ann HASELBURY Widow for and during her life to be paid yearly unto the said Anne in Manner as aforesaid
    And after the death of such issue I give and devise the said house and premises unto the children of my cousin Thomas ATKINS

Item: Yet is my Will and desire that my Cousin Robert LODER now beyond the seas his life or any one of his children be put in reversion by my Executor into the Copyhold at Presson to hold after the decease of his mother and brother John LODER without paying any fine for the same and this to be done within three months after my decease

Item: I give and devise thirty acres of Heath in Turnerspiddle [i.e. Turners Puddle] unto my daughter SHEPPARD and her heirs for ever lawfully begotten and for default of such issue I give and devise the same unto my Cousin John LODER now beyond the seas and his heirs for ever being 20 acres my farther LODER gave me upon will and 10 acres I bought of my brother James LODER

Item: I give unto the poor of Trinity parish in Dorchester forty shillings

Item: I give unto the poor of Peters parish in Dorchester twenty shillings and unto the poor of Allhallowes parish twenty shillings to be distributed by the Overseers of each parish immediately after my funeral according unto their discretion and approbation of my Executor hereinafter named

Item: I give unto the poor of Lyme Regis where I was born three pounds to be distributed by the Overseers of the said town or parish by the approbation and discretion of my Cousin Mrs Joan WEAVER.

Item: I give unto Joshua CHUCHILL Minister five pounds and do also forgive him the five pounds which I formerly lent him as appears under his hand.

Item: I give unto the poor of the congregation with whom I have walked in fellowship of the Gospel two pounds to be distributed by Mr Joshua CHURCHILL, Mr John YEATE and my son-in-law Thomas SHEPPARD

Item: It is my Will that my servant maid Ann HALL be paid by my Executor the sum of Ten pounds in short time after my decease in regard she hath been my servant for many years and hath taken more than ordinary pains about my grandson John GOLLOP and that her life be put in reversion in the Copyhold Estate in Presson after the decease surrender or forfeiture of the widow MOCKETT who was put in by Wm [William] MOCKETT not above a hour before he died

Item: I do freely forgive Thomas WEAVER deceased his heirs Executors and administrators that thirty pounds which I lent him September 7th 1679 as appears on my book and do also forgive him whatever else is due to me from him as appears on my book

Item: I give unto the children of Thomas WEAVER deceased as many of them as be living one shilling a piece at the time of my decease; forty shillings a piece

Item: I give unto Richard MILLER his children as many as shall be living at my decease a piece to be paid by my executor and also unto the wife of Richard MILLER three pounds for herself and the good of her children forty shillings a piece

Item: I give unto my granddaughter Roberta GOLLOP daughter of the said John GOLLOP Mercer and Mary his wife deceased the feather bed bolster rug and curtains and valances table board and the great spurse those with the Drum chairs which are in the great chamber after the decease of my daughter SHEPPARD or when she shall come to age to make use of it

Item: I give unto my sister STANSBIE which my father had by his last wife the sum of five pounds to whom I do give after the decease of my daughter Elizabeth SHEPPARD and her heirs the estate at Haselbury during the term

Item: I is my Will that all the debts I owe at the time of my decease unto any person or persons either in Law on conscience being inconsiderable be paid in convenient time after my decease / my debts and legacies being paid and my funeral expenses discharged I give and bequeath all the rest of my goods and chattels whatsoever and wheresoever unto my daughter Elizabeth SHEPPARD whom I make my full and whole Executrix of this my last will and Testament revoking and making void all or any former will or wills by me heretofore made and I do hereby nominate and appoint the said John GOLLOP, Thomas SHEPPARD my sons in law and Mr Thomas DALLICOURT to be Overseers of this my last will and Testament desiring them to be aiding and assisting my Executrix in and about the performance of this my last Will and Testament and I give unto each of them a ring of twenty shillings to wear in remembrance of my love

In Witness : whereof I have hereunto set my hand and seal the 21st June in the first year of the reign of King James the Second over England or Anno Domini one thousand six hundred eighty six Phillip STANSBIE sealed and declared by the said Phillip STANSBIE to be his last will and Testament in the presence of Thomas GOLLOP junior, Richard GOLLOP Margaret BURGES


Genealogical Notes:-

(1) Mr PHILLIP STANSBY was buried at Holy Trinity Church Dorchester on 22nd Nov 1686 some 5 months after writing this will. His life is covered under Dorchester Trade Tokens follow link. A further copy of his will is held at the DHC Ref D/ASH:A/F22  1686/7

(1) His daughter Elizabeth was their 7th known child and baptised at Holy Trinity Church Dorchester on 10th Jun 1660.

(2) Mr. John GOLLOP of St Peter's parish in Dorchester married Mary STANSBY at Holy Trinity Church on 28-May 1674. See their marriage for more information about this family. Mary produced 4 children before her death on the 25th and burial at St Peters Dorchester on 28th May 1682 aged 29. John's pedigree is given in the History and Antiques of the Parishes of Netherbury & Beaminster on page 113 (available on ancestry.com)
